Putnam Henck, representa- tives of S. W, Welding Wg. Co. s 3iner Construction Company, et al, and John Nchren of the Blade Tribune. In view of this, he asked Pr. Guerip what effect delaying the official Statement Until the 23rd would have on the sale of tb bods. herin said if the official stateme& is in the mail by the 25th it would have no effect. He said that if final Copy on the Brochure .is at the printer by the 22nd it could be ready by Friday. Bid8 Letters from Ward Construct ion Company and X. P. Ban Valkenburgh were moved that the letter8 be considered received ard filed. The motion, unit nA" read in which their respective bids were clarified. Director ilogers seconded by Director Kelly, carried unsnimously. Late Bids The bid of the South West Welding Mfg. Co, which had arrived too late for opening on January 17th was discussed with representatives from that firm who stated that they hd checked with t& post office at LO8 Angeles and had been advised that their bid would arrive in Carlsbad by 1 :00 P.X. on that date. On the out side of the envelope it hEpd been clearly stated that the bid was to be opened at 2:30 P.N.. It was assumed t'nat it would arrive in time. They cited cases in which under similar unusual circumstances (such as late trains, @tc.) such bids had been accepted. However, he noted that in California bid8 must 3e in the hands of the specified recipient by the time set. He said he bad checked the mileage between tb Carlsbad Post Off ice and the City Hall where bids were to be delivered, and it is a di&ance of 9 mile. It was observed by all board members that the Carlsbad post mark on the envelope was 1:OO POL, 1-17-57. The aecutive Secretary's notation on the envelope msde at the time of delivery was: "arrived at 2:40 P.E., too late to be considered". The South Pasadena post mark (where the envel- ope was mailed) was undeciphersble, Attorney Dennis stated that on the 17th he had talked with South West Weld- Hfg. CO, by telephone and htld been told to open the for steel reservoir. J. PutPam Henck stated that in most cases where late bids are accepted it is 90 speci- fied in the contmct document;^ ard then announced at the time of the opening of the bids and this was nut &ne. The representatives of South West Welding Wg. Go. (Messers Brock and West) stated that the reason for mailing their bid in this Gage was that two of their executives were away and they would have fiad to hire someone b deliver it per.sonally; uswlly, they admitted, they do deliver bids in person. Attorney Dennis was asked for an opinion as to the legality of awe$ ing this bid but was not prepared to make a definite statement . Be said it would boil down to whether it was a matter of substantiaJ compliance or not, or whether an irregularity existed which might be waived, or whether it is a matter &r the benefit of the District VS. the bidders. Director Hiwald saggested thwt in view of the fact that there is some irregularity about this matter, the District should consider readvertising. Hr. liner objected and said it would cast doubt on the integrity of the Board of Direc- tors ard would be an improper mve. Director Rogers agreed that CUWD should not reject tbe bids in order to readvertise. ICngineer short announced that the statements of Mr. liner were not valid and if the Board feels it is best to readvertise it should feel free to do SO. Tht, he said, is their prerogative, Director Rogers noted that it bad been a mistake on the Drt of the Board not to have open& the bid at the time it arrived. The bid l.ad been rejected upon advice of attorney. Director &ald stated that the first responsibility of the Board is to the taxpayers ard tk.t in all fairness-the baard should readvertise, Attorney Dermis statedB that readvertisemnt would not assure better bids than those received. On mot ion of Director Bogers, seco ded by Director IJwald, in view of the que stion con- cerning the acceptance of this bid, the natter was turned over to the Attorney for study and recommendat ion. If connection to *e Sari Bkrcos lina is made, there would be a deduction of $166,000 and it would then be necessary to sell only $1,200,000 worth of bonds, (These figures do not include interest.) Unit wA" According to Short's analysis, on Unit "A", the low bidder, providing With the alternates offered by Van Valkenburgh, their total bid would be reduced to $453,213.64. Short; recornended that if this altemtive is used, Ward shotlld be awafied the contract on Schedule "Aw (140 days) On the 3rd alternate to construct a line to the Twin Oaks Boad In San mcos, Short said Valley Bngineers, Inc, were low with a bid of $163,199.50 on time Schedule 'A", with a reduction of +$ for time Schedule %" bringing the bid down to $162,290.97. Short said the reduct ion is not sufficient to justify taking the extra 60 days. He said tbt, subject to further investigation of the qualifications, etc., he would re- commend that Valley liln@;ineers, Inc. be awarded the contract. Unit 9" For Unit "B", Blngineer Short recommended the use of concrete-lined coated steel pipe, The low bid for this unit, on time schedule "An came from Hal hark Construct ion Company in the amount of $641,807.70. Under time schedule "B", hoaever, the low bid was from Ward Construction Company in the amount of @635,6=53. This unit includes the contigent it em of resurfacing the San Ddarcos Road which is not yet surfaced, but there is no guarantee that it will not be surfaced before our construction begins. The bids from these firms for resurfacing tho road, should it become necessary, were $2,079. (Hallmark) and $5,775 (Ward). - - Director Wsald s&ed the engineer if there auld be any tiavantage in awarding both contract s to the aame firm. Short said there roulCl be a slight advantage in that the work would then be assured of better coordination. The Chair recognized B. Ward who stated that he bad been assured that the paving of the Sa,n EBarcos Road wm begin until June 15th and that his firm could definitely have the line built before that date. I&. Stoddard, also of Ward Construction Company said their firm had also been guaranteed that pipe will be supplied in adequate time to avoid repaving the road. He reported tbt originally pipe was scheduled for de- livery at the rate of 1,200 feet per day but that they have a guarantee now that the supply will be enlarged to 1,500 feet per day. lngineer Short aLed Nr. Ward if he were awarded t ke contract on Unit "B" (time schedule "B" ) he would need the fill 200 days for completion o f construct ion. Ward said '%ow ard that they could complete the construct ion as qrtickly as anyone. Stoddard said the line could be built well within the 140 days allowed but it would be well to have the full 140 days in order to dress up the job properly, D$rec+or Rogers recommended isming bods in the amount of 41,250,000. I Director %ald asked if the board might legally consider the letter submitted by Van Valkenbwa ark3 was informed that this muld be legal only if they were the low bidders anyway or if the contract were being awarded to them anpay. Mr. Ward &at& that his letter bad been submitted for information purposes only and thLtt-Fhep realirte it has no effect on the actual bid. Bond s In view of the pending action of the San Wrcos County Water District the Authority on the relocat ion of the second aqueduct and recommenclat ions of the state re location of transmission facilities in San Diego County, Director Rogers move& that the Board establish the bods to be sold in the amount of $1,250,000. The motion, seconded by Director Bwald, carried unanimously, as outlined in their letter of January 17, 1957, and the action of -4- Revision of the mturity schedule was discussed. Xr. Guerin said the changes should be distributed approximately evenly and this was deened agreeable. Guerin said that on Monday morning (1-21-57) his firm will inform O'Baalvany & Nyers and the CNWD Board of the revised debt service schedule and maturity schedule and with the Board's ap- proval these muld go into the off iciaf stat errrent. Attorney Dennis noted that we must give a letter of intent to award on the 31st of January and 1st of February and that awards must be mde on the 15th and 16th of February. It was genc!ra;lly agreed that sale of the bonds should be February 14, 1957. Be servo ir Btngineer Short then walgz4 the reservoir bids. The low on the steel Bid 8 came from U. S. Steel Corp., and the low for the concrete came from J. Putnarn Hack. Short recommerded that the award be made strictly on the basis of cost since there is virtually no advantage to having one (concrete or steel) over the ut her. 1 paying The attorney read an agreement submitted by the Bank of America Agents which dssignates paying agents. On motion of Director Rogers, seconded by Director Zahler, the Pirst Hational City Bank of mew York and the First; National Bank of Chicago were designated as paying agents and the President and Secretary were authorized to negotiate the agresment. The motion carried un- animously. Minutes of the meetings of January 16th and 17th were referred to the Attorney for review on motion of Director Wrrald, seconded by Director Rogers. Finances On mot ion of Director Rogers, seconded by Director Ewald, it was agreed that the Carlsbad Xunieipal Water District should mrticipate in the ~O&S of entertaining representat ires of-the Metropolitan Water District when they are here on Sunday.
