Cranston, Attorn& 4-19-57 -- Suggesting firthor changes in the San BtIarcos Contract. The Etxecutive Secretary announced that tho suggest ions had been relayed to the San Narcos District. Attorney Dais said the Contract is ready and awaiting the approval of the San Marcos District Board, - 5. Irrigation Districts Association -- Ninutes of Semi-annual Convention, Sn Jose, December 12, 14, 1956. 4. County of San Diego: 4-17-57 -0 Bill for inspect ioo in March totaling $6.89, I 4-23-57 =- Beport of insEction this date. 5. Pacific Snvostwnt Company (Terramar), 4-22-57 - Application for watqr service to Kelly promrty. A general discussion re! policy ensued. Dirsctor Rogers noted that the Watsr Problopls Cormaittse has bqen gathering inforration from other Districts to be used as a guide in ths final establis'hmant of a pol- Te rramar icy with regard to the sale of water, He cited four things which must be ;?rovidod for or considered: wholnsaling, retailing, tempor- ary retailing, and extension agreements. Fie pointed oat that there will have to be a determination of certain rgquiremqxbs which would have to le fulfill4 by appli- cants, and statnd that th+se things must be worked out before water can be served. Ib said b bsl$ves 'lerrsmar should be served as it complies with the requirements, Attorney Dsnnis stat4 that it will be nscnssary to revise the rate Ordinance and noted that thre. will be many problens to solve including that of policy with re- gard to the delivery of retail water to an individual wbrs multiple dwellings are involved. He said this might be hand14 by multiplq ratqs. Hs pointed out that the fact that a wholesale connection is granted does not constitute a,n exclusivs franchise. To a question by Chairman Fry, Kr. Cannon answered that Terra;nar Watw Company now serves 1,600 acres, He stated that t'k Kglly land is contiguous to that which is now served and that hr! has stat? a-.r3, county pgrait s to sell watar to thq people who consumq in Terramar. Ha noted that his lake now has about 300 acre feet in storage. Director Bogers suggested that Er. Director Rogers pointed out that it would take a fill week to draw the -2- I requird rsgulations. Director Btvald suggested that th work of the committee be confined to the problems with rsgard to the distri'Sution of Wholesale water since wholssaling is our established policy making this the logical part of €;ho problem to settle first, Director Zahlqr agreed. Airport Director Rogers refqrred to the application of the Airport and Sug- gest& that the Mutual be hired to hand19 the delivery of water to ths Airport b Terramar Attormy Dennis asked Bir. Camon wheth9r Terramar Watnr Company is certificate of convenience a& necessity prescribing the sqrvice area is hsld, and Cannon affirm& that it is. Cannon stated also that he now has 182 connsctions. Dirdct or RogRr s indicated that Mr. Cannon should show proof of the area which he is entitled to serve since wp must know what area is to be served in order to avoid overlapping of agencies, a corgorat ion. Cannon said it is. The Attorwy then asked if a Director Bwald volunteered to work on the committee and u.pon advice of Attorney the Chairrnsn named a special committee of the whole to work out the details. It was adopted on the follow- ing roll call v@.f;o: Ayes: Dirsctors: gwald, Fry, Rogers, Zahler Eoe~s : Dirsctor s : None Absent: Directors: Kelly Att orwy It was reported by Diroctor Rogers thst Attorwy Dgnnis had agreed to serve as consulting and policy attorney for the District at the rate of $100 per month; this would involve attendance at two msstings per month and ggnsral legal advice. Anything of a special nature would be charged for at an hour- ly rate. Attormy Dennis was asked to prsssnt a bill for services in connection with Improvement District No. 1. He stated that hs could not submit a bill at this time bscause there may be further work before completion of the system. I New Director Iwald reported that he had t alkd with two local attorneys : Attorney Glgn R. Peist ad Paul Swirsky. He said that Feist hEbd stated he b rsportd, has weed to tab the position if offered an3 would attend meetings and do thq detail legal mrk for the District at ths rat5 of $200 psr month. The possibility of conflict of interests was brought up in view of tb fact that he is a partmr of the City Attorngy. Attormy Dennis advised that on any matters wkre a conflict might exist, he (Dennis) could handle the work. Dirclctor Zahler stated there is nothing to be done about it since it is to thq Bistrict *s advantage to have a local attorwy who will be available wlsn needed. On motion of Director Blvald, second4 by Director Rogers, it was unanimously asad to retain Attorney Swirsky on tb terms as outlied by Director dwald during this discussion. A let- ter of notification to Swirsky was ordered by tb Chair, did not wish to be considered for the position available. Swirsky, tbt tha possibility of such conflict is 8 distubhg factor but said he rscognise.8 Finance On recornendation of ths finance committee it was moved by Director Committee Rogers, and second& by Director OJwald, that tho sum of $41.87 be immediate bill. On motion of Director Bogers, seconded by Director dwald, the Fi- nancq Committee was authorized to reinvest Improvemmt District No. 1 firxis as in- dicatd by the status of funds at ths date of investment taking into account the recommendat ions of thp engineer. Imp. Dist, tnginesr Curtis reported that the Reservoir is now 40$ completed and Status that testa will be run between valve sections and that Hallaark has arranged with San Xarcos for t& wcessary water. The pipe will be tested at a pressure 50 pounds in excess of normal pressure. Curtis stated that there are two qng-ers now aupervising the work and that a third mn will be added on Xay 6th. T& Residast Ingineer in charge is a.
