HomeMy WebLinkAbout1960-01-06; Municipal Water District; MinutesINFORMATION MEETING HELD IN THE CITY COUNCIL CHAMBERS OF THE CITY OF CARLSBAD, AT 7:OO P.M., ON WEDNESDAY, JANUARY 6, 1960, WITH REFERENCE TO FORMATION OF AN IMPROVEMENT DISTRICT, BY THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT AND VOTERS AND TAXPAYERS WITHIN THE AREA OF THE IMPROVEMENT DISTRICT NO. 3, AS PROPOSED. The meeting was called to order at 7:07 P.M. by President Kelly. He advised the audience the purpose of this meeting is to get the viewpoint of the people. He stated we had had numerous requests for water and after quite a few discussions the Board felt the best way would be to form a new district. He then turned the meeting over to Don Short, the District Engineer, who gave the details: Don Short passed financial schedules around to everyone. On a map posted on the wall he pointed out the area to be included in the proposed Improvement District No. 3, which was outlined in green. The red lines on the map, together with blue circles represented the water facilities proposed to be constructed - the blue circles being regulatory reservoirs. This combination of water facilities were estimated to be $1,200,000.00. The mehtod of financing would be the authorization of bonds within this area. Engineer Short explained that each one of these lines and regulatory reservoirs is a part of the master plan primary distribution system which was conceived sometime ago -- at the time the District -first brought water to Carlsbad. These lines if constructed I would actually complete the master plan of primary distribution system. Engineer Short continued with respect to financing, stating we had projected the water revenue and assessed valuation of this territory. In making up this schedule he had considered that the District would use from the bond proceeds an amount equivale to the first year's interest. He projected that the first tax rate would commence at $1.50 the first year and diminish to 10~ at the first half of the last year. $he first tate of $1.50 for the year 1960-1961. However, he pointed out that it would be necessi that this Improvement be on the assessment roll the early part of this year and stated that it was doubtful we can form the district that rapidly. If the district is not formed by that time and missed getting on assessment roll, we would have to raise the amount of taxes shown in the first year. By raising it the following year, 1961-1962 t $2.25, the tax rate 1962-1963 would be $1.60, and thereafter the same as shown on the schedule. Representatives of the City Council of Carlsbad asked if the District intended to retai water. Engineer Short replied the District had never attempted to retail water in the City of Carlsbad, and had no intention to compete with the City. The district has a responsibility to furnish water if those land owners come to the District and request water service. There is no advantage for a land owner to come to the City or the District, it would cost hime just as much. The District is attempting to provide the . trunk facilities to the area of the district as a whole, unless the City can be these transmission lines in themselves. Graham Kelly at this point suggested that the City of Carlsbad be taken out of the pro- posed area. In this way it would cut down the cost by lo%, and relocate boundaries. Engineer Short pointed out also, that the District could not sell water retail to anyo1 being serviced by the City of Carlsbad or served by another water agency, and in the event of annexations of areas by the city, agreements could be worked out between the City and the District. Engineer Short stated he thought it might be well to review the history of the Districl From the very beginning the District has rated itself as being a wholesale agent. Engineer Short replied the individual or applicant for water would apply to the District for water service, to some one of these lines. At that time hejwould pay a connection charge based on the size of the connection he wanted - maybe 1" or 6". Graham Kelly at this point stated he couldn't see any cheaper way of getting water. Carroll Kelly also stated the same thing and said he was in favor of it. The question was raised by a member in the audience. What would happen if he was a I half mile from one of the lines and another owner is in between and won't give an easement. Attorney Swirsky advised the audience if an easement would not be granted the District has the power of condemnation. Graham Kelly advised he was all in favor of it. President Kelly stated at this time, if we were to go ahead with the forming of this new Improvement District No. 3, we want to know we have some backing. Clty Attorney, Barbara Hayes, stated at this time the City Council had asked her, Engineer Jenkins, and City Manager Slater to be present at this meeting as they did not favor the District retailing water and they would have to report back to the Council and requested a time limit be set in order that they might make any reports or requests for exclusion, or bring up other points of interest to the City of Carlsbad February 3rd. was set as the dead-line. Mr. Weiss, representing the City of Oceanside also asked for a Gentlemen's agreement that they be permitted to present their report, for exclusion from the area at the above date, February 3rd., for exclusion. A vote was then taken. President Kelly asked for all in favor of forming this new prop Improvement District to raise their right hands. 24 were in favor. President Kelly then asked for those not in favor to raise their right hands. As no-one raised their right hand the vote was unanimous to go ahead and form the new proposed district. It was decided to adopt the first Resolution on February 16, 1960, calling for a public Short would have engouh time between February 16 and March 22 to determine the actual boundries.
