The meeting was called to order at 2:OO P.Y. by ?resident Kelly with Directors toe,
Greek, Naerkle and Phillips answering roll call.. Also present were Acting %nager
Kubota, Engineer Ford, Legal Counsel Grosse, Yr. Dmie). :.diegand, Pire Uhland ?elton,
and Office Secretary.
I Upo~ motion by Director Coe, secor?ded by Director Phillips, and manirnou-sly carried,
the minutes of the adjourned meetings of December 3, and 9, 1963 and regular
meetings of December 17, 1933, and Janvary 7, and January 21, l%4 were approved
as tr'anscribed by the Secretzry.
Reports of Legal Counsel:
On tke natter of the sewer e2.semer.t ?or the Ma Len property, Legal Counsel reported
that a letter has been forwarded to ?.%. Len explaining the District's position in
regard to the changes requested on tTle easemnt document, but has had co reply.
Legal Counsel reqvested tl-e Board's permission to file a lawsuit for the collection
of tbe delincpent accomt for Imoto Brothers as other attempts to collect tFis
account have failed. after disccssion, upon motion by Director Fhillip, seconded
by Director Yaerkle, arid una.nimously carried, it was moved. that the Board
authorize the Attorney to po ahead and collect this account.
In discussillg delinqxent zxcovnts, Director Maerkle snqgested the possibility of
reqv-iring a deposit at %e time water service is commenced. Legal Counsel pointed
out the difficulty invo1ved in determining the amount of the deposit for different
water users and that some procedure would have to be set up which would be non-
discrirrinatory. The possibility of requiring a bond for corporations involved in
the farming ventures i-r, t5e Tistrict was also discussed, 3u.t t;ere was 2 uu-estion
as to whetper this wot.ld be ademate vitk0u.t the persond ,rruara?ty of the stock-

Sewerage Engineer Ford reported th.e easement docxments for tbe Enclnas Canyon
Program trunk line have all been ?repared and are behg svibmitted to the property
reports from the Title Cornpa~y fcr We Agua Sedionda easements, but t'ney will be
completed as so02 as the reports 5ave been received. He informed the Board that
he did talk with the County relative to rigb-ts of way in Flncirmas Canyon and Yley
are agreeable to some type of joint easeEent over the properties in Encinzs Canyon.

the Bozrd tbt he had talked with Dewey Xelly and he is willinq to give th-e 10 feet
for access %ut not the easement to construct. A letter kas also been received from Max Len and the County %as come to him for an easemnt and he wants to make sure
tbat they will be one and the same for both districts. The F'anager reported that he
also talked with Fr. Robert Kelly and he is ready to approve the sewer easement but
wou.ld like io have it moved over closer to t3e power pole, but from this location
there wovld be a 35 foot crt involved which is impossible for construction. In the
meantime he is attempting to get a land exchange with Yax Len which might allow him
to grart this easement witbork cw-tting up his property too badly with utility
easements. A meeting was also '7eld with Paul Ecke and he is very receptive to havin8
the sewer line go through his land.
The Yana,qer read a letter from ?ka '.:'arren Barney of the Department of Special
District Services, representing tbe Buena Sanitation District, in response to the
District's formal request to them concerning joint pzrticipation in We Encinas
line, offering to work wit!! the District on areas of cooperation.

Observance of the progrm for t%e District's 10th anniversary celebration
event the Board reviewed t?"e gxest list and tentative program and noted possible
changes .

entire program as the Committee 5as basically ou.tlined. After further disccssion
on tbe invitation list and the mem to be served, upon motion by Director Yaerkle
seconded by Director Creek, arZ. mmimously carried, it was moved thzt the CommLttee
be authorized to go ahead and poceed with the preparations.
The 14anager passed copies of a draft of a questionnaire and accompanying letter
to be sent to Distyict property ovmers ir! nScing tyhe survey of agricultural lands
available for leasing. After discvssiig the pro,ject and the cost involved in
preparing a brockre for distribvttop, the Board aareed that Director Phillips
shonld look into tb.e costs for the broc'rure and. bring the fzcts back to the Board
for a detednation as to EYI ai1ocatio.n of funds for this project.
Yeadquayters Landscaping ;olans and proposals were reviewed by the Roard as
Project -- Land- sc.bmitted by 'Jdt Pearcy and the Oceanside ?hnsery. After
scaping Proposals disccssion, it was agreed to with3old a decision 011 the matter

The Manager explained that the cresert janitorial service is being performed by
Pete Sotelo 2r.d is averagipg abovt 254.00 per month for twice a week service,
not including the window washing, After discmsion, it was decided to use the

The Nanager informed tke Soard t'-at several persons have inqvired about purchasing
the old construction sXed which he estimated would be worth at least ?:50 -00 to $60 .OO. After discussion, the Ya1;ager was zethorized to dispose of the shed at
tb.e best price obtainable. P,n incuiry was also received yegarding the bat3room
fixtures i3 tke State Street bu.ildin.g, but tk'e aoard felt that not?-ing else
should be removed from the building since tbe sale has already been advertised.
Vater Service and Operations :
In reporting on t'ce general operation of -be %.strict, t3e Fanager reported there
was a leak in I. I), KO, 2 last week on the Bressi Ranch where the thrust p1u.g came 0e.t and th.e line floode6 the new golf cou.rse under construction. Legal
Counsel suqgested the insurance company be pvt on notice.
The Xanager reviewed the water accounts wf:icl; 8re now delinquent, buLt explained
that collection on most of t?em is anticipated shortl37.
The Board again reviewed the lnztter of a re-financing program on District bonds as poposed in a letter from J, 3. Fanzuer Company, but it was the general
opinion of the Board that t?e Estrict would cot need svcb. a program at this time.

The plans for the new freeway location, 2s mbmitted by the State Division of EighwEys, were reviewed by the Board and the Board agreed that tkte District
sbodd go alead and get t'le sewer crossing in before the final plans z.re approved.

An~ouncement was read from the Count? Tax Collector's office to t'se effect that
there will now be a detailed breakdown on the tax rate for each special district.
A-nnomcenent has been received of the Annua.1 Conference of the American Xaterworks
Association to be held in Toronto, Cznsda on ?ay 31 thru Ju.ne 5, 196.4..
