I Upo~ motion by Director Coe, secor?ded by Director Phillips, and manirnou-sly carried, the minutes of the adjourned meetings of December 3, and 9, 1963 and regular meetings of December 17, 1933, and Janvary 7, and January 21, l%4 were approved as tr'anscribed by the Secretzry. Reports of Legal Counsel: On tke natter of the sewer e2.semer.t ?or the Ma Len property, Legal Counsel reported that a letter has been forwarded to ?.%. Len explaining the District's position in regard to the changes requested on tTle easemnt document, but has had co reply. Legal Counsel reqvested tl-e Board's permission to file a lawsuit for the collection of tbe delincpent accomt for Imoto Brothers as other attempts to collect tFis account have failed. after disccssion, upon motion by Director Fhillip, seconded by Director Yaerkle, arid una.nimously carried, it was moved. that the Board authorize the Attorney to po ahead and collect this account. In discussillg delinqxent zxcovnts, Director Maerkle snqgested the possibility of reqv-iring a deposit at %e time water service is commenced. Legal Counsel pointed out the difficulty invo1ved in determining the amount of the deposit for different water users and that some procedure would have to be set up which would be non- discrirrinatory. Sewerage Engineer Ford reported th.e easement docxments for tbe Enclnas Canyon Program trunk line have all been ?repared and are behg svibmitted to the property reports from the Title Cornpa~y fcr We Agua Sedionda easements, but t'ney will be completed as so02 as the reports 5ave been received. He informed the Board that he did talk with the County relative to rigb-ts of way in Flncirmas Canyon and Yley are agreeable to some type of joint easeEent over the properties in Encinzs Canyon. A letter kas also been received from Max Len and the County %as come to him for an easemnt and he wants to make sure tbat they will be one and the same for both districts. The F'anager reported that he also talked with Fr. Robert Kelly and he is ready to approve the sewer easement but wou.ld like io have it moved over closer to t3e power pole, but from this location there wovld be a 35 foot crt involved which is impossible for construction. In the meantime he is attempting to get a land exchange with Yax Len which might allow him to grart this easement witbork cw-tting up his property too badly with utility easements. A meeting was also '7eld with Paul Ecke and he is very receptive to havin8 the sewer line go through his land. The Yana,qer read a letter from ?ka '.:'arren Barney of the Department of Special District Services, representing tbe Buena Sanitation District, in response to the District's formal request to them concerning joint pzrticipation in We Encinas line, offering to work wit!! the District on areas of cooperation. 10th Anniversary A written ,report was suhnitted by the Committee for the plarming Observance of the progrm for t%e District's 10th anniversary celebration event the Board reviewed t?"e gxest list and tentative program and noted possible changes . After further disccssion on tbe invitation list and the mem to be served, upon motion by Director Yaerkle seconded by Director Creek, arZ. mmimously carried, it was moved thzt the CommLttee be authorized to go ahead and poceed with the preparations. The 14anager passed copies of a draft of a questionnaire and accompanying letter to be sent to Distyict property ovmers ir! nScing tyhe survey of agricultural lands available for leasing. After discvssiig the pro,ject and the cost involved in preparing a brockre for distribvttop, the Board aareed that Director Phillips shonld look into tb.e costs for the broc'rure and. bring the fzcts back to the Board for a detednation as to EYI ai1ocatio.n of funds for this project. After discussion, the Ya1;ager was zethorized to dispose of the shed at tb.e best price obtainable.
