Also present were Legal Cowel Grosse, General Manager Wood, EBgineer Ford, Jack Kubota, SuperilatendeBt Tucker, and Office Secretary. Sewerage At this the Presideat Kelly operaed a general public discussion regardilrsg Propam the sewerage program for Improvement District No. 0-7. Property Gwner Property her Presideat Kelly explaiaed tkat the proprty owners were invited to atteBd this meeting so that the Board of Directors could have their coments in regard to the sewerage program ia makiag a final detemiBatioB as to the future course of action OB the matter. He then asked if the City wished to speak as to what they are prepared to do. Mr. Uape Lill, Cozasulting EBgimer for the City of Carlsbad, took the floor a23d gave a gmaeral- summation of the Joint Powers' sewer program BOW underway aBd how it will affect the U-7 Mstriet. He poiEted out that the plapds have beea prepared to construct a truak lime in the Agua Bediokada watershed aBd will extegd as far as the Shelter Cove Development, with capacity for the ezatire watershed. IB the EnciRas Caqox area, the City has joiBed with the Bueaa Sanitatiora District md has reserved capacity to serve the EnciBas Cayon area ad additional capacity also, Vith these facilities, he explained, the City can expand up El Camiao Real, and even further, and cagd also serve the Encinas can yo^ area with the Buena line. Coaditions governhg the use of these sewer facilities would be only that my area that wmts to coaanect to the sewer should be atzmexed to the City of Cmlsbad. It is contensplated there will be BO amexatioR fee for obtaining sewer service, but there will be a standard eomectioa fee as it BOW exists iB the City of Carlsbad, There was considerable discussioa on the matter of amexatioLa asd the problem which could arise ad the follawirng items were brought out: (1) the fact that some of the laad owBershiips are so situated that there would be BO growth coRtinuity to allow then to ammx to the City; (2) that for sore of these properties Bot coatiguous to the City, amexation would iruolve obtaiging a corridor annexation across aeighborilag properties to get to the City boundaries; aBd (3) that in some imstances amexatiom by certain property omers would surrowsd and lock iB the remaiaiag properties thereby creating a situation where they would be forced to mmex to the City. City Maaager Mamaw explained that the City could not completely eBcircle such properties aad wou-ld have to leave a 200 foot openiag. Several property owaers indicated tzley would Bot be opposed to allowing the 200 foot corridor amexatioma through their lands which, igt some areas which abut 01 Palomar Airport Road, could consist of 100 feet of right of way aEsd 100 feet of lmd. The -@estioB arose as to whether the aewly formed Local Agency FamatioB Commission would approve strip anexation of this type but the City Manager indicated this would not be a problem. I EaLginecsr Ford asked if there my be some fee attemdw-t to the amexation which would cover the obligatior of the property owrser for the back taxes, &. Lill explained that the boBd comultants, Stoase md Youagberg, bad recormneaded some type of papelat for this purpose but the City Corncil has aot acted OR it. It was suggested that perhaps the U-7 District could be used to comtruct the Agua Hedionda truak liBe and the spur collectioE lines included ia the I?-7 plam and make arrangemerats with the City to put them i8n use whea the properties annex. City Mamager Mamaux ikltticated that the City of CzPlsbad would not be receptive to any plegot9atiow OB such a plaB. After fwther discussioB, Mr. l?&x Lea offered a motioB that he would favor a vote of the property owners preseklt OB 8 recomvendatim to the Board of Directors that, if and w'res, the City of CEirlsbad provides a fim eoBtractud agreement with a certaiR time lim.it built in for providing sewer facilities ia accordance with the City Manager's verbal conamitneat, t'le Board be authorized to go ahead and dissolve the U-7 Sewer District. The motlox was ddy secoBded by Mr. Robert Clark, and passed by a vote of 12 Ayes ad 1 No . The discussion OE the sewerage program was declared closed and a taEs rnilaute recess aas called at 4:OO P.M. The meetiBg was reconveaed at 4:15 P.Y. Paul Ecke The Maager explained that sime the last meeting a problem has come Me tern up regarding the Paul Ecke meters which were turlasd over to the City of Carlsbad, It was fomd that the subject meters are being used to tramport water to both I. D. No, 3 a3sd I, D. Ma, 1 lands, thereby makilag it im- possible to detemiae the rate differentials which would apply to the water served through these meters. Fr. &mer of the Paul Ecke Ranch has beers asked to provide the District with a map outlining the areas of the Rach to be served by these meters. After further discussion, upon motion by Director Maerkle, secoBded by Director Phillips, it was moved that OB all temporary connectioas the District charge them the regular agricultural rates and that the Attorney be directed to prepare 810 ameadmemt to the Water Service Ordinance OR same. The nxotioa was passed by the following vote: Ayes: Kelly, Greek, Bkerkle, Phillips. Noes: Director Coe. Ratification of Upon motioB by Director Greek, seconded by Direetor Phillips, Checks aBd unaainously carried, the Board ratified Checks No. 378 thru I No . 397 h the amount of $29,619.70.
