AT 57m EL CMIXO XEAL, CARLSBAD, CALIrnR8IA : The meeting was called to order at 2.935 P.M. by Elresident Maerkle, with Oirectors Coe, Kelly, Phillips and Cdchael answering roll call. Also present were GeEeral Eanager Vood, Legal Counsel Grossa, 3%. Jim Downing of Sm-Del Corporation, and Office Secretary, Reassessment Director Kelly introduced Fro Jin Downing of the San-Del Corporatton S tu.dy of Del I4k~ &ich has been retained by the Emergency Tax Association to do a study on the reassessment of this area. W. Downing then took the floor and made a presentation on the graphs am3 information which they compiled for this study and pointed oEt some of the inequities they found in the differences in value of the improved and udmproved property, Director Kelly asked if the Board wodd consider writing a letter to the Board of Equalization asking Vnat they take under consideration t'case facts and what they are doing to the agricultural industry ove~ the Covnty. After disct7ssionY upon motion of Director Kelly, seconded by Director Phillips, and unanimously carried, it was moved that the Attorney be in- structed to write a letter to the Board of Equalization asking that they give seriou consideration to thse ineqmtties in the aasessslent of improved and unimproved land and pin-pointing some of the complaints based on these studies that have been done. Directors Coe and Telly were appointed as a Comaittee to work with the Attorney in drafting an appropriate letter on this matter'. Legal Counsel's Report: City Neter Legal Counsel reported that the Cotzcil has acted on the meter agreement Agreement for the City of Carlsbad and a signed copy is now on file. Delinquent Account In regard to the delinquent account for Yasukochi, Inc. now in 'le?sukochi, Inc. the hands of the bankrupcy trustee, Legal Counsel reported that he had talked to 14r. Hellen, the Trustee, and he indicated that the District's claim will probably be settled for about @ to 5) cents on the dollax as e lmge claim by one of tle members of th.e Corporation was paid off first . Water Ordinance Legal Counsel informed the Board that he is in the process of atten acd 2esolution ing to rmfte t5a District's ordinance covering line extensions and sv-bdivisiom and has obtained copies of similar ordinances fron other agencies. He requested that a Cormittee be appointed to work with him in the preparation and redraftiag of these documents. President Eaerkle appointed Erector Casmichael and General Hknager Wood to work with the Attorney on this project. Chlorine The Ymger presented for t%e Board's consideration a cor_tract submitted Contract by t5e Tops Chemical Company covering deliveries of chlorine to the 3131.00 to 3136.00 per ton over last yeax. It was his recommendation that the con- tract be sfgned as the service and product are good and there is no otl?er supplier in this area. After discussion, upon motion of Director Coe, seconded by Erector Kelly, and unanimously carried, it was moved that the contract with Tops Chemical Company be approved for the next fiscal year and that the Hanager be authorized to sign the contract. Proposed The l~mager read in full a letter scbmitted by Robert Kelly concerning a Tipelbe proposed water line to serve a trailer park and certain commercial buildi~ During the discussion the 31mager pointed out that the Cit;; of Carlsbad may wish to serve this development since >bo Xelly will be obligated to amex his property to the City to obtain sewer service. It was the >knagerfs estimate that the line pro- posed by &. Kelly would run between $9,000 30 to $U,OOO.OO for an @! line extezdil appyoximately 2,000 ft., but he suggested that the matter be referred to t'ne Engine4 for a look 8% the project as to the sizing and t;Qe of line, After discussion, tke Manager was directed to refer the mtter to the Engineer with a request that he havt a recomerdation ready for the Board's review at the next meeting. La Costa The $!imager submitted for the Board's review a copy of %%e meter &Ta.dT=g Expansion plan for Planning Area Fo. 1 of the La Costa Project and pointed out the Propm proposed development. Ile pointed out that with this increased activity the Board shodd be thinking about the location and finzxcing for anotkiel tank to serve that mea. This infomatioxl. has been passed on to the EngiReer for h.ie review and a recornvendation as to the future needs of this area. I In comection with the construction program now anderway at La Costa, the kager informed the Board thEt he had expected to have a request from them on a change in the condominim metering, It seems they have been considering the Corporation that owns the land for the coaaox&niu.m as the single ownership reqniring a meter rather than the individual condominium living units as defined in om ordinance. It is therefore, expected that they will request th8.t it be metered collectively which would be a change back to fewer mters and not individual unit meters, After discussion, it was decided tkat no action would be taken until a formal request has been received from. La Costa on this matter. I Water Agencies The Nanager znnounced the regular quarterly meting of the Water Vee ting Agencies Association will be held on Jd. 29, 1%5, with the south Bay Water District as host agency, and members are asked to mike their reservations by July 23, ~ YYater Service !?he &wager read in fu.12 a letter written by Xac Carnohan which %orth Carlsbad had been submitted to the State Health Department regarding the Area condition of the water zow being served from the San Luis Rey Wells that after this letter was rrade public, e call was received from the Garlsbad Jownal eisking about the Xorth Carlsbad amexation prograor to I. Do No. 1. firector Phillips informed the Bawd that an effort is. still being made to get the required signatures on the ptitions for amexation but the progress has been slow. Legal Counsel Grossa pointed out that the City of Carlsbad is ming the fact that they are not in Improvemenl District No. I and the District will not allow them to serve the water, as a reason for withholding Colorado Hver from North Carlsbad, He queskioned whether it was fair for the District to allow any area which is within the ?Bstrict boundaries and thereby eligible for Colorado River water, not to be sened and suggested that perhaps some arrangement could be made whereby the North Carlsbad residents could pay their obligations to I. Do KO. I thru an override on t'nair water, and thereby the District would be agreeable to their using the I. D. Xo. 1 facilities. There was considerable discussion as to the method of passing this override on to the City and two ideas were advanced; (1) that the charges should be based on a flat rate pr acre foot with a meter installed in the North Cwlsbad line, or (2) that a monthly charge of $1.00 per meter for the North Carlsbad area be added to the City btlling. after further discussion, upon motion of Director Fhillips, seconded by Director Kelly, and unanimously carried, it was moved that the Attorney draft u.p a Letter to the City of Gzlsbad regarding service to Xorth Garlsbad alorgthe lines discussed, Caretaker's Residence President 3herkle reported that he has a prospective tenant Squires Dam for the trailer residence and asked uhat rental fee the set the rental fee at $@.OO per month, with the tenant to pay all utilities. Ratifit5ation Upon motfon of Director Coe, seconded by Director Phillips, md of Checks mi.mousIy carried, the Board ra-bified Checks Wo. Dl9 thru Bo. by the City of Carlsbad to the North Carlsbad area. He explained I Board wished to set. After discussion, it was decided to 1029, in the mount of $1,336,77. President Fkerkle passed for the Board's review a letter from the Fallbrook Utility District giving details of their recent settlement on the lawsuit on water rights azainst the United States Government.
