MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT, HELD ON SEPTEMBER 21, 1977, AT 2:OO P.M., AT 5950 EL CAMINO RE CARLSEAD, CALIFORNIA: The meeting was, called to order at 2:08 P.M. by President MacLeod, with Direct Kelly, MacLeod, Maerkle and Uhlinger answering roll call. Director Engelmann absent. Al.so present were Assistant General Manager Henley, Legal Counsel Swi District Engineer Kubota, Public Relations Consultant Mitchell and Office Secr Uti 1 ities and Maintenance Director Greer, of the City of Carlsbad, Mrs. Margar Bonas of the League of Women Voters, Mike O'Hara (Tara LaCosta), Ted McDonald Calavera Hills), Gil Davis, of the Blade Tribune and Neal Ball (2:51 P.M.) of San Diego Union, were also present. Approval of Minutes : Director Maerkle made a motion to approv minutes of the regular meeting of August 1977, and the regular meeting of September 7, 1977, seconded by Director Uhl in and unanimously carried. Oral Communications from the Audience : Tara LaCos ta District Engineer Kubota introduced Mike Carlsbad Tract 77-3 who was in attendance regarding Greencas Ltd.'s condominium subdivision of Lots 1 188 and 189, which are involved with a dead1 ine from the City of Carlsbad Engi Department and the sewer district. Mr. Kubota recommended that the Board'acce the agreement (which includes a $10,000 bond) for the construction of the pub1 water system for this subdivision so the City will release the final map. Dir Maerkle made the motion to approve the map for Tract 77-3, seconded by Directo I .. Kelly and unanimously carried. Committee Reports : I S.D.C.W.A. Director Kelly reported on his attendanc this meeting and read some pertinent sta from various reports put out by the Authority. Of special interest was the de the Mexican aqueduct. The Mexican government has asked that we continue to SL them with water for an additional year to which the Authority has agreed. He read a letter from Mayor "Pete" Wilson of the City of San Diego, addressed to E. Bergman of the Qual ity of Life Board of the City of San Diego, en1 isting hi in the conservation of water. Tri -Agencies Pi pel i ne and District Engineer Kubota reported that 1 South Aqueduct Connection office has prepared progress reports on these projects. Our committee on these will be meeting again today. The draft EIR is out on the SAC Project and is r the response period. The original EIR referred to growth-inducing factors of South Aqueduct Connection but this is not really true for Carlsbad, according Kubota. Manager Henley informed the Board that a copy of this.EIR is availabl the District office for public perusal. Water Conservation and Reuse Director Uhlinger reported on this comi meeting of September 13, 1977. We ordered them and wi 11 be reimbursed for our cost. Mr. Uhl i nger said committee had discussed touring the northern California area to view the drous damage but with the recent rain they have had, some of the impact would be 10s I He then asked if we had written to ACWA regarding the issue of mandatory me of water. Mr. Henley responded that this was done on September 8, 1977, bu have had no reply as yet. Mr. Uhlinger went on to suggest that the Water C vation and Reuse Committee should meet only once a month as there is no lon need for more. frequent meetings. Director Kelly concurred and it was decid hold the meetings on the first Tuesday of each month from now on, which wil the next meeting October 4, 1977. Dis tri ct/Ci ty Joint Committee President MacLeod said nothing has bel from the City as yet, District Enginl Kubota reported that at the adjourned .City Council Meeting of September 13, Dr. Packard had said that the City's committee would be meeting for discuss the City's next procedure in this matter. Legal Counsel : Resolutions No Report Other Matters Proposed Conflict of Interest Code Legal Counsel Swirsky said that the sp committee for this matter has met with staff and the required notices have been published. A copy of the proposed is here in the District office if anyone wishes to see it, The public heari set for September 28, 1977, at 2:OO P.M., and Mr. Swirsky requested that toc meeting be adjourned to that time. A public stenographer will cover the put: hearing portion of the adjourned meeting, Mr. Swirsky explained that there three parts to the code: (1)-the code itself; (2) Appendix A, which is a li individuals; and (3) Appendix B, a legal definition of items. Since the District's offices will be in the pattern of this new runway, the County will be 1 ooking at our property with t of taking it over, necessitating relocation -of our offices and warehouse. The test period will be four months. Director Maerkle made to contribute $25.00, seconded by Director Kelly and unanimously carried. Palomar Airport - Transient Manager Henley reported there will bc Parking Apron on September 29, 1977, at 11:OO A.M., this. He will attend and report back next regular Board meeting as to what it concerns. I Meetings : City Counci 1 Manager Henley reported on his attend night at this meeting which lasted un night. Bzckinans expressed. their concern to the Counci 1 , over possible rod traction'to the solid waste transfer station. The Beckman Industry is stri monitored due to the nature of their product. The County representative st this would be taken care of. Also discussed was a proposed shopping center LaCosta Boulevard and El Camino Real. Mr. Kubota then reported on the prev council meeting which he attended during Mr. Henley's absence (vacation). meeting the Lake Calavera Hills developer offered to fund a study of a wast reclamation master plan for the entire city. The Council accepted the prop it is subject to some agreement as to how the study will be conducted. The flow is 18 with the lake level at 486.5' this morning. He will write an open letter t customers, thanking them for their cooperation during the water shortage. was also very complimentary of our crew, which handled the crisis in a very manner. Copier Manager Henley directed the Board's a to the need for a new copy machine an mended the Xerox machine we have been using as a demonstrator. Director Ke a motion to lease this machine for $155.00 a month, seconded by Director Mat and unanimously carried, Ratification of Checks Director Maerkle moved for ratificatic checks numbered 1850 through 1940 for period covering September 8, 1977 , to September 21, 1977, for a total of $1; seconded by Director Uhlinger and unanimously carried. Other Matters: Altamira Unit No. 4 District Engineer Kubota overlooked ti during his "Development Programs" pori the meeting. He reported the second increment is finished and asked for apl temporary occupancy of the second 40 units. There will be 57 more. The wal is done and people are waiting to occupy their homes.
