HomeMy WebLinkAbout1978-03-15; Municipal Water District; MinutesMINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL MATER DISTRICT, HELD ON MARCH 15, 1978, AT 2:OO P.M., AT 5950 EL CAMINO REAL, CARLSBAD, CALIFORNIA: The meeting was called to order at 2:03 p.m. by President MacLeod, with Direct0 Engelmann, :Kel ly , Maerkl e, MacLeod and Uhl inger answering roll call . A1 so pres were Legal Counsel Swirsky, District Engineer Kubota, Public Relations Consulta Mitchell and Office Secretary. Utilities & Maintenance Director Greer of the C of Carlsbad, Mrs. Margaret Bonas (2:ll p.m.) and Mrs. Ruth Honnold (2:ll p.m.) the League of Women Voters, and Ted Donald (2:05 p.m.) of Calavera Hills, were present. Approval of Minutes Upon motion of Director Maerkle, seconded Director Engelmann, and unanimously carri the minutes of the regular meeting of March 1, 1978, were approved as corrected 1 Oral Communications from the Audience None Committee Reports : S.D.C.W.A. Director Kelly reported on his attendance the recent Water Authority meeting. Mrs. Bonas and Mrs. Honnol d arrived during this report (2 :11 p.m. ) . Public Information Pub1 ic Re1 ations Consultant Mi tchell repa on the breakfast meeting held this mornin Oceanside; the guest speaker was Mr. Jarvis. An informal poll taken at the mee indicated 80% would support the Jarvis-Gann Initiative, 12.5% would not support and 7.5% were undecided. Mr. Mitchell recalled that he had advised the Board at the last regular meeting that District school tours were to be held on March 9, 10 and 13. These were c celled due to road conditions. Possible rescheduling is being considered for t month of May depending on school cirriculum. Tri -Agencies Pi pel i ne Director Maerkle reported that a meeting the Tri-Agencies Pipeline Project Special Committee was held today and referred to a memorandum from the committee, which furnished to the Board and Staff. The Water Authority would like each of the IT agencies to advance their respective shares of the cash contribution directly t the Water Authority prior to the award of the contract, which will be made on April 13, 1.978. It is understood that any funds received by the Water Authorit would earn interest during the period of non-use in favor of the party. In the case of our District only, the funds are not readily available The amount of funds that the District has available (approximately $500,000) will not be suff cient to complete construction as originally planned. Additional funds needed amounting to approximately $500,000, if borrowed, would be repaid in part with proceeds from bonds that are to be sold under the current year's budget. After discussion, upon motion of Director Maerkle, seconded by Director Kelly, and ur imously carried, it was moved that: I 1. The special committee and District staff proceed with the negotiations for the borrowing on a short-term basis of $500,000. 2. The staff proceed with the sale of $300,000 in authorized bonds. 3. The Water Authority be requested to amend the current advertisement fc bid to permit a reduction in the total scope to match our avai lab1 e fund of $5C Further discussion followed. Engineer Kubota explained the route of the pipe1 i use of a diagram and estimated that funds available would finance construction point approximately at our District "C" tank. u Water Conservation', Reclamation Director Uhlinger stated that the next me and Reuse of this committee will be held on March i Mr. Mitchell advised that another respons been received for one of the unclaimed water conservation awards. District/City Joint Committee No report P President MacLeod called for a brief recess at 2:52 p.m. The meeting was resul at 3:14 p.m. Legal Counsel : Conflict of Interest Code Legal Counsel Swi rsky call ed the Board's Financial Disclosure Statement attention to a postcard received from th Clerk of the Board of Supervisors, San D. County, copi.es of which had been previously distributed. The postcard is a reminder that annual Financial Disclosure Statements are due no later than Apri 1 30, 1978. The annual statement covers the period from December 2 , 1977 through December 31, 1977. Informational material and the statement to be filf will be furnished each Board and staff member. District Engineer: Development Program Japatul Corporation District Engineer Kubota reported that a letter has been sent to Mr. Robert Ellis the Japatul Corporation advising of the Board's policy position regarding mast€ planning the entire property. An excerpt of the Minutes of the Board of Direct Meeting of March 1, 1978 was forwarded to them. Carri 11 o Estates District Engineer Kubota reviewed for the (Ponderosa Homes) Development , stating that approximately 150 homes are under construction. Last fall, arrangements were made with La Costa Land Company allc ing Carrillo Estates to hook-up the first 50 homes to the Alga Road pipeline or a temporary basis. They will now be ready for interim water service for the second increment of 50 homes. Inasmuch as La Costa Land Company funded this pi line and owns the capacity rights, they will be contacted concerning this matte and Mr.. Kubota will report back to the Board. Pal omar Airport Industrial Park District Engineer Kubota advised that Point I'D" Pressure Reducing Mr. Gilmore of the Palomar Airport Indust Station Park has made inquiry concerning possible reimbursement for the Pressure Reducing S Mr. Kubota will review this matter further and make specific recommendations to Board at a later date. District Property Improvement By use of a diagram and map, Engineer Kub explained present District facilities and the proposed County road. He suggested a new road be developed off of the Coun, road to be used by District trucks, and also suggested the existing driveway be designated for "entry only" with a separate exit and additional paved parking SI provided. Further plans will be prepared concerning this. c Board the status of the Carrillo Estates 1 General Manager: In the absence of General Manager Henley, Engineer Kubota reported the foll owing : Communications: Metropolitan Water District Engineer Kubota said that a formal notice Water Conservation Program has been received from M.W.D. advising tht their water conservation program is no lor effective as of February 1 , 1978. State Water Project Engineer Kubota called the Board's attenti to the recent issue of METER which states that Southern California will be receiving Northern California water. Aqueduct Shutdown Engineer Kubota advised that the Water Aul will be shutting down pipeline #4 for 10 ( starting in April 1978. San Diego County Archaeological Engineer Kubota stated that a formal reque Society, Inc. has been received from the San Diego Count Archaeological Society to review any and a Environmental Impact Reports sponsored by the District. L.A.F.C.O. Engineer Kubota reported receipt of notifi Spheres of Influence Hearings tion from L.A.F.C.O. that public hearings be held on the recommended Spheres of Infl for the City of Vista on April 3, 1978, and for the City of Carlsbad on June 5, I -2- March 15. A.W.W.A. Booklet Engineer Kubota referred the Board to a Works Research Foundation containing water reuse highlights. Sundesert Nucl ear P1 ant Engjneer Kubota reported that information has been received from the Water Authori t: regarding the Sundesert Nuclear Plant, and advised that the Board of Directors 1 the Water Authority has endorsed construction of the Plant. After discussion, motion of Director Kelly, seconded by Director Maerkle, and unanimously carried it was moved that Legal Counsel prepare a Resolution in favor of the Sundesert booklet received from the American Water 1 Nuclear P1 ant. Meetings : L.A.F.C.O. Independent Special Engineer Kubota reminded the Board of the District Selection Committee Independent Special District Selection Committee meeting to be held on April 19, Board action will be required at the next regular meeting so that our voting mer can provide written authorization to.cast the District's vote. "208 Water Management Study" Engineer Kubota stated that a meeting of ' Water Quality General Assembly will be he' on March 27, 1978 at the Hi1 ton Inn, Mission Bay. CPO will present their "208 I at this time and Mr. Kubota will be in attendance. In this regard, our Distric, indicated their support for the Water Authority's position that they be designa. the water management agency. The only other matter that involves the District 1 cerns the institutional report of J. B. Gilbert & Associates which makes specif reference to the "a1 leged" problem of the Water District and the City of Carl sbl Mr. Kubota said that District Special Consultant Skip Schmidt is of the opinion that the Board should present their position at this meeting, namely that the concerns raised in Mr. Gilbert's report are not a problem from the perspective I this water agency and the entire area due to the fact that there are four water agencies serving water in the City of Carlsbad, and to talk about one specific problem is not appropriate. Upon motion of Director Maerkle, seconded by Direc Engelmann, and unanimously carried, the District Engineer was authorized to pre the District's position on the Gilbert report as recommended by the District Spl Consul tant. Director Kelly read aloud a letter from Mr. Burzell of the Water Authority, Sub; Final Decision on 208 Planning at CPO. The letter explained the weighted vote [ cedure in the event it becomes necessary. Association of California Water Engineer Kubota advised that an announcemf Agencies Spring Conference has been received concerning the A.C.W.A. Spring Conference which will be he1 d May . in Monterey. More information will be received later regarding the program schf Directors are to notify office secretary if they wish to attend. Rainfall for the pt of March 1 through March 15 measured 5.34". Mr. Kubota advised that three property owners along Sunnycreek Road have indicat their desire to discuss construction of a permanent road. A "wash out" was reported today on line 'ID", I.D. No. 3, which is the line that up the hill behind Irwin Kelly's house. Fifteen feet of water line was undermir There was a line rupture in La Costa Meadows in a subdivided paved street area r quiring emergency repair. There is also a very bad "weep" condition in Alga Ro? by La Costa Reservoir and pressure tests are being run on our two water lines. Rancho Carl sbad Mobile Home Park Engineer Kubota referred to recent publici about Rancho Carlsbad Mobile Home Park anc their concern for Lake Calavera and Squires Dam. Mr. Kubota paid a visit to the I -3- March 15, 1 park and extended an invitation for their representatives to visit the Dam site as soon as road conditions permit. He further suggested to the Board that con- sideration be given to expanding the District education program to include seni citizens. Emergency Services Organization Engineer Kubota advised that Foreman Muss Disaster Re1 ief represented the District at a meeting he1 in San Diego at 1O:OO a.m. today conducte by the Emergency Services Organization regarding disaster relief. The District has estimated its storm damage at between $10,000 and $20,000. Mr. Kubota requ Board action to appoint the office of the General Manager as the District's off representative to review this program and process an application on the Distric behalf for reimbursement of our actual expenses to restore services back to nor1 After discussion, upon motion of Director Maerkle, seconded by Director Uhlinge and unanimously carried, the office of the General Manager was so appointed. Personnel Engineer Kubota reported the Personnel Commjttee's recommendation that Allen Her Waterworks Trainee,be designated as a permanent employee of CMWD as he has serv his probationary period of six months, and also that his salary be adjusted by approximate 5% raise to $682. per month retroactive to March 1, 1978. Upon moti of Director Maerkle, seconded by Director Uhlinger, and unanimously carried, th Personnel Committee ' s recommendati on was granted. Ratification of Checks Upon motion of Director Maerkl e , seconded Board ratified Checks No. 2543 through 2600 covering the period from March 2, 1 to March 15, 1978, in.the sum of $57,417.41. Purchase of Water Bill ing Forms Engineer Kubota requested approval of the Board to issue Purchase Order No. 2312 in amount of $540.85 to Moore Business Forms for 12,000 water billing forms. Upon motion of Director Maerkle, seconded by Director Engelmann, and unanimously car1 the Engineer's request was granted.
