Commissioner Lawson arrived at 5:10 p.m. Absent: None. Staff Present: Dave Bradstreet, Director, Parks and Recreation Keith Beverly, Senior Management Analyst Doug Duncanson, Parks Superintendent Mark Steyaert, Park Planner APPROVAL OF MINUTES; Minutes of the Regular Meeting held December 19, 1988, were approved as presented. The Scribe Report was approved by the same motion. APPOINT SCRIBE; Commissioner Welshons was appointed Scribe for this meeting. PUBLIC OPEN FORUM; There were no requests to address the Commission. PRESENTATIONS; There were no presentations. APPROVAL OF AGENDA; Parks and Recreation Commission, by consensus, accepted the Agenda as presented. CONSENT CALENDAR; Commissioner Welshons requested Item 13 be removed from the Consent Calendar. Chairperson Dahlquist requested Item #4 be removed from the Consent Calendar. Parks and Recreation Commission affirmed the action of the Consent Calendar, with the exception of Items #3 and ft, as follows: 0005 Dahlquist Castner Knox Morrison Strayer Welshons Dahlquist Castner Knox Morrison Strayer Welshons MINUTES PARKS AND RECREATION COMMISSION 3anuary 16, 1989 Page 2 COMMISSIONERS WAIVER OF AGENDA TEXT READING: Parks and Recreation Commission waived the reading of the text of Agenda items at this meeting. 1. AB 0189-1 - DIRECTOR'S REPORT. The Commission accepted and filed the Director's Report for December 1988 - 3anuary 1989. 2. AB »169-2 - CANNON ROAD UPDATE. The Commission accepted and filed the staff report on Cannon Road Development. ITEMS REMOVED FROM THE CONSENT CALENDAR: 3. AB J189-3 - RECREATIONAL FACILITY FINANCING COMMITTEE. Commissioner Welshons requested standards on other items besides golf and tennis. Commissioner Strayer stated that under Proposition M, other recreational facilities were to be considered by the Council, and recommendations made by this Committee, which was formed by the City Council and the Mayor, will probably give them an insight as to additional needs to be defined at Committee meetings. He suggested that Commissioners could attend one of those meetings to give input. Commissioner Strayer stated he would keep this Commission informed of the Committee's recommendations. AB »189-» - ANNUAL C.P.R.S. DISTRICT XII AWARDS AND INSTALLATION BANQUET. Chairperson Dahlquist stated she would like staff to elaborate on this banquet for the benefit of the new Commissioners, and staff explained the program for the banquet. Parks and Recreation Commission accepted and filed the report on the Recreational Facility Financing Committee and acknowledged the invitation to the California Park and Recreation Society District XII Awards Banquet, (one motion) PUBLIC HEARINGS; 5. AB #189-5 - CALAVERA HILLS COMMUNITY PARK USE Kennlth Chriss, Carlsbad Softball Association and Carlsbad Bobby Sox Association, requested an amendment to the CUP to allow extended play and use of the facilities at Calavera Hills park; including lights until 10:30 p.m. and field lights to be used on the weekends. Dahlquist Castner Knox Lawson Morris Straye, Welshons MINUTES PARKS AND RECREATION COMMISSION 3anuary 16, 1989 Page 3 COMMISSIONERS PUBLIC HEARINGS; (Continued) Dave Bradstreet reported that according to the Recreation Division, no youth or adult groups had requested use of the Calavera fields during the evening hours on Saturday and Sunday, nor was any use justified for weekend use. There will soon be a third field option and there will be some requests for night use by adults. Chairperson Dahlquist opened the Public Hearing at 5:17 p.m., and issued the invitation to speak. Robert Ragosta, 2953 Cape Cod Circle, stateu he had nothing against the use of the park, but had difficulty with the usage of the facility encroaching upon the enjoyment of his property and the other homeowners in the area. Mr. Ragosta mentioned the compromise reached by the homeowners and the City and the agreement to place additional foliage to take care of the mis-planned aspects of the park. Mr. Ragosta stated that the weekends are the only time the homeowners can enjoy their own yards, and he did not feel the users of the facilities at the park had a right to encroach on the owners' rights. He felt the use of the park Is sufficient and the agreement reached in good faith should be continued as is. Helene Panell, 295* Cape Cod Circle, Board Member on the Cape Homeowners Association, speaking for herself, stated she had been told this would be a natural park and was not notified about the approval of the park. She stated there is noise and the lights from the park are disturbing to her as well as her neighbors. David Stoffel, 4705 Edinburgh Drive, representing several homes on Edinburgh Drive within the Colony, stated he appreciated the recreational service to the community. He said he realized there was some misunderstanding as to the type of park this would be. The issue of lights and noise associated with ballfields has been brought up for several years, and although there was to be spill-over from the lights in this park, the City has tried to correct such problems—particularly in the Cape. He said there is one section of the Colony that is next to the park where there is spill-over from the lights. Mr. Stoffel felt the agreement and assurances shoul'd be kept. Sharon DeVoung, 4706 Edinburgh, presented a petition signed by 14 residents of Calavera Hills asking that requests to extend use time be denied. the Ken Chriss, P. 0. Box 240, Carlsbad Softball Association, told of the uses of the park at this time, stating that the request to extend the time to 10:30 p.m. would only be under special circumstances. He said that once in a while there is a need to continue with a game, such as a tournament, or some other event that Parks and Recreation would be well aware of. Mr. Chriss said he would like more flexibility at the times when special events call for activities past 10:00 p.m. 0006 MINUTES PARKS AND RECREATION COMMISSION January 16, 1989 Page 1 COMMISSIONERS PUBLIC HEARINGS: (Continued) Mr. Chriss said the request to extend the lights during the week to 10:30 p.m. would be under special conditions and with special permission. Mr. Chriss said the weekends are a problem and he felt relief was needed. Play on weekends is from 8:00 a.m. to 6:00 p.m., and with the additional enrollments, leagues cannot be run without having more time available on the fields. He said that as the major user, they are being asked by Parks and Recreation to cut down their use time to allow for more women's leagues. In response to query regarding length of the seasons, Mr. Chriss said it is almost year-round at this time. play starts in late February to the end of Ouly, with the regular season and tournament play. The winter leagues play on weekends. Mr. Chriss said the leagues use Kelly and one other field as practice fields. 3ames Courtney, 1861 Southview, Carlsbad Athletic and Recreation Association, stated he has been involved In the youth associations for many years, and stated that between 80 and 90 percent of the youngsters involved in the sports programs do not end up in trouble. Mr. Courtney said there are not enough ballfields and he asked play on the fields not be curtailed and children shut out. He said he supported the normal cutoff time for regular play, but felt tournaments should be allowed to continue until 10:30 p.m. Mr. Courtney commented there will soon be a shopping center open in that area and this park was planned a long time and was in the General Plan. He felt that for the inconvenience to a few neighbors, the children should not be handicapped. Since no one else wished to speak on this matter, the Public Hearing was closed at 5:<4.9 p.m. Commissioner Strayer stated he did not understand why the park was not used on weekends, as he felt It should be used then more than during the week. He felt the Commission should recommend using the park since the money has been spent to build it. Dave Bradstreet stated that the matter would have to be returned to the Planning Commission for an amendment to the existing Conditional Use Permit. He said that his department had worked with the homeowners and there were a lot of negotiations to come up with the policy of no night lights at this park on weekends. Commissioner Knox stated the agreement hammered out by this Commission and staff should be respected. She said she could support another compromise--but it was not necessary to extend hours or open nights on weekends-- but deal with each event on an individual basis. Those requests could be made, but keep to the original agreement. ~~~- MINUTES PARKS AND RECREATION COMMISSION January 16, 1989 Page 5 COMMISSIONERS PUBLIC HEARINGS; (Continued) Commissioner Castner acknowledged the need for ballfields, and added that an agreement had been reached with the homeowners, who wanted no lights. That was unreasonable, as this park had been planned for a long time, and if the homeowners did not know about the park when they purchased their property, that was between the purchaser and the seller. He asked if the time were extended, where would that stop? He felt the compromise reached by staff and the homeowners did entitle the homeowners to a good night's sleep and peace and quiet on the weekends—two nights out of seven. Commissioner Welshons suggested that perhaps there could be a compromise to accommodate the children in tournaments and allow the lights to be extended for an exact time. Commissioner Morrison stated she felt the park cost a lot of money and should be used to the maximum. She felt 10:00 p.m. was late enough, except perhaps during tournaments, where it would be considered an exception. In answer to query regarding an amendment to the CUP, Dave Bradstreet said that would be an expensive process. Mr. Bradstreet said the issue of the noise would not be addressed. The landscaping was not heavy enough to begin with, and Mr. Bradstreet said it has been agreed that additional foliage will be planted. He referred to Mr. Stoffel's request for additional landscaping and said he would work with them on that. Commissioner Lawson commented there were a lot of unanswered questions that needed to be addressed. An amendment to the CUP Is not easy, and he stated he leaned toward the existing agreement. Chairperson Oahlquist asked why the hours were different at the different fields and not consistent. She felt there should be a policy within the City that all lights should be consistent and equal. Mr. Bradstreet said the CUP gives the hours and this Commission and his Department can limit the number of hours, as long as they don't go beyond the hours set. Commissioner Castner said he could not agree to lights every night—with yes for tournaments, but no for Saturdays and Sundays. Commissioner Lawson stated he was fearful of the message this might give to the community. He felt additional information was needed in order to support the requests. Commissioner Castner made a motion to honor the previous agreement with the homewners and turn the lights off at 10:00 p.m., as agreed. Commissioner Lawson seconded the motion. Mr. Castner amended the motion to state keeping the time as agreed upon within the Agenda Bill and CUP and not using lights on weekends. At this point, Commissioner Lawson withdrew his second of the motion. Commissioner Knox seconded the motion as amended. 0007 MINUTES PARKS AND RECREATION COMMISSION January 16, 1989 Page 6 COMMISSIONERS \ \ &V&r.Vi\ \£\$»\£\3> PUBLIC HEARINGS: (Continued) Commissioner Lawson stated that due to the complexity of this item, he questioned whether it should be continued or whether action should be taken. Dave Bradstreet said that the CUP set the time at 10:00 p.m., and he asked whether the Commission wanted lights on the weekends. He added that if the Commission agreed with the request for extending the time to 10:30 p.m., that would have to go to the Planning Commission. The request for lights on the weekends is not controlled by the CUP. Mr, Bradstreet said the motion was to stay with the original agreement for lights to 10:00 p.m., week nights, and no lights on weekends. Commissioner Knox reiterated her opinion to keep the agreement with the homeowners and make special permission for tournament days. Motion was made to keep the original agreement to use lights at Calavera Hills Park ballfields to 10:00 p.m., and not allow lights on weekends. Motion failed. The Commissioners voting against the motion felt this did not solve Mr. Chriss' problem. Parks and Recreation Commission recommended the lights at Calavera Hills Park ballfields be allowed to 10:00 p.m. seven nights a week. Commissioners Castner, Knox and Lawson voted "no" as this violated the previous agreement with the homeowners. Commission discussion centered on how to modify the CUP in this instance and for the Commission's future guidance in such cases, with staff directed to provide information to the Commission with regard to the proper procedure for modifying the CUP. The question was also asked how to make exceptions for tournament play to extend the use of lights for a period of time. Staff indicated any change in the hours would require an amendment to the CUP. Parks and Recreation Commission denied the request for an extension of time beyond the current 10:00 p.m. hour for the use of lights at Calavera Hills Park. Commisioners Morrison, Strayer and Welshons voted "no" as they would like exceptions to the time limit on lights during tournament play. Dahlquist . PUBLIC HEARINGS: (Continued) 6. AB #189-6 MACARIO CANYON PARK MASTER PLAN REVISION. Dave Bradstreet introduced the item, stating the study was done in-house. Mark Steyaert continued the report, stating staff had identified the current recreational needs and had developed a new plan. He said he would compare that new plan with the old plan, as contained in the report attached to the Agenda Bill. Chairperson Dahlquist opened the Public Hearing at 7:19 p.m., and issued the invitation to speak. Oim Courtney, 1861 Southview, referred to the initiative on the ballot for Macario Canyon, and said the original map had certain years for certain things to happen. He said there is a shortage of recreational facilities both active and passive in the northwest quadrant and will be at buildout. He asked for approval of the concept and get it to Council. The citizens want this and there is a need for recreational facilities. He said there would be another sports complex on the next ballot, and would cost more that way. The City owns Macario Canyon and has the money to develop the park. Since no one else wished to speak on this matter, the Public Hearing was closed at 7:25 p.m. Dave Bradstreet explained that this was a conceptual, preliminary plan, and he commended staff for doing an outstanding job at no cost for outside consultants. He said this plan de-emphasized privatization—with the City developing the park. He explained the exhibits attached to the report and outlined the amenities recommended. Parks and Recreation Commission approved the conceptual Master Plan Revision and directed staff to finalize the revision map and initiate environmental studies and review prior to the development process. 7. AB #189-7 - GOLF COURSE STUDY REVIEW. Dave Bradstreet gave the staff report as contained in the Agenda Bill, using wall charts and transparencies to show the sites. In answer to Commission query regarding which site has strong disadvantages, Mr. Bradstreet answered the County property, due to the environmental review and negotiations with the landowners. 0008 Dahlquist Castner Knox Law son Morrison Strayer Welshons X MINUTES PARKS AND RECREATION COMMISSION January 16, 1989 Paqe 8 COMMISSIONERS PUBLIC HEARINGS: (Continued) The Commission, during dicussion on the goif site study, commented, that they felt the Lake Calavera site was the best site for a large golf course and the Executive Course should be located at the County site. The Commission further stated that the City should concentrate their efforts in developing the Macario Canyon Park as outlined by staff, that would not affect or displace proposed recreational amenitites or community parkland. Parks and Recreation accepted the Golf Course Site Study. Parks and Recreation recommended staff consider the Lake Calavera site for the large regulation golf course. Parks and Recreation Commission recommended staff Investigate the possibility of an Executive Golf Course within the County property. The Commission commented that the Executive Course was in addition to the golf course at Lake Calavera, giving the City two different types of golf courses. DEPARTMENTAL REPORTS: 8. AB #189-8 - CAR SHOWS AT PARK FACILITIES. Parks and Recreation Commission adopted staff recommendation to uphold previous Commission action of not allowing car shows in public parks. That appeals will be handled on a case-by-case basis, with a fiscal impact statement that would require, if an appeal is granted, that the applicant would be required to pay full costs of any park damage. COMMITTEE REPORTS; A. Budget Review Committee - January 25, 1989. Dave Bradstreet reported that the committee meeting will be held and members will be called.
