March 9, 1953
Meeting called to order by Chairman Sutton at 7:05 p. m, Present
besides the Chairman were members Gronseth, Bond, McClellan, Smith,
Stringer, and Barter.
Secretary Smith reviewed Notice of Public Garing on the applica-
tion of B. F. Binkley, et al, for reclassification from R-1 to R-2
of the area bounded by Las Flores Drive, California State Highway -
XI-SD-2B, Lagma Drive, and the easterly boundary of Buena Vjsta Gar-
dens and the southerly and northerly prolongations thereof. Appearing
in Pavor of the reeo;ling were Raymond R. Binkley, of OceansiCle, and
W. E. Wlering, 2541 Jefferson Street. Protesting were Finis': Johnson,
2637 Jefferson, Mr. Segerblorn of 2535 Jefferson, Mps. Evelyn bffatt,
2634 Jefferson, and G. E, Seaberg, 2585 Jefferson, Chairman Sutton
explained the uses and purposes of R-2 zoning and pointed out on the
map the area under consideration. Col. Smith asked to be temporarily
excused from the Commission In order to express hia views as a/resident nearby
-, and protested against the proposed zoning which would
allow duplexes, stating he would approve a reduction to 6000 square
feet building site, restricted to single-famlly dwellings and with
some restriction as to minimum frontage. Col. Cfronseth reported the
recommendations of the comfttee appointed to study this matter, as
follows: a recomendation of denial of the Binkley application; and
a furtbr recommendation that a zone be created, to be designated R-IB,
with building site area 6000 square feet, and single-family dwellings
on a minimum lot frontage of 50 feet, Col. Gronseth moved that the
Plannbg Cornissfon recornend to the City Council the denial of the
application of B. F. Binkley, et al, for rezoning from R-1 to R-2 of
the area Be8Cribed in the Notice of Public baring, Seconded by Nr.

Stringer. All ayes, motion carried.
Dol. Gronseth moved that a hearing be set on March 23rd, at 7 p, m.,
at the City Hall, to consider the rezoning of the property described
in tbe above Notice of Public bering, from R-1 to 8-lB, with 8 mini-
mum fratage of 50 feet, with single-family dwellings to be ereoted
abutting on a dedicated street. Seconded by Bnr, Stringer. All ayea,

c-1 of Lots 3 and 4, Block 49, Carlsbad Townsite, and the request of
the Planning Commission to include Lots 29 to 32, inclusive, in Block
38, Lots 17 to 20 Inclusive, in Block 39, Lots 13 to 16, inclusive,
in Block 48, and Lots 1 and 2 in Bloc& 49, Carlsbad Townsite, according
to Map 535, in said reolassification. There were no protests. mb,,
Stringer moved that the Planning Commission recommend to tho City
Council that the application of Robert G. and Maida A. Cutler, and that
of the Pianning Comnisslon, for rezoning from R-3 to C-1 of the property
adwrtised, be granted, Seconded by Xr. Bond, All ayes, motion carried,
Secretnry Piaitki reviewed the Motice of Public Hearing on the ap-
plication of '3m. R. Dindinger, et al, for reclassifioatfon from R-1 to
R-2 of Lot 1, Block C, Lots 5 and 6, Block B, of Al'les Avocado Acres,
and the requast of the Planning Commission to include in said reclassi-
fication all of Block A and all other portion8 of Blocks B and C, of
Alles Avocaao Acres lying westerly of California State Highway XI-SD-BB,
Map 2027. There were no protests, Col. Smith moved that the applica-
tion of William R, Dimlinger, et al, and the Planning Commission, to
reclassify from R-1 to R-2 t roperty as advertised on February 26th,
be recommended to the Council for approval. Seconded by Col. Gpometh.
All ayes, motion carried.
Secretcry Smith reviewed the Notice of Public Hearing on the appli-
cation of Bernard L. Robinson and Anita Rob?.nam for zone variance to
permit reduction of frcnt yard setback from 50 feet to 25 feet, and for
a special use permit to allow construction of a traller oourt on the
following described property, located in 8 C-1 zme: Lot 24, Seaside
Lands, at 2630 State Street, Opinion of the Commission was sharply di-
vided as to advantages and disadvantages to the cornunity of trailer
courts, some members feeling that they sbuld be permitted and strictly
regulated a8 to type of developmat by imposing conditions, and the
tax loSs,!.:8xS -compared to Other uses, overcome by setting an adequate
business license tax based on a certain ammt per space; and others-
feeling that trailer courts as a wble are a disturbing, undesirable

a committee- be appointed to study this question very thoroughly and
come in with recomendations. Seconded by Mr. BoM, After discussion
on the motion, it was agreed that rather than appoint special commit-
tee to study this question, the entire Commission should give it the
most serious consideration, All ayes, motion carried., A question of
interpretation arose over whether, under the ordinance, trailer courts
cou3d be constructed in a C-2 zone without a 'special use permit, It
was decided to send a memo to the City Attorney, asking for an opinion
on this question.

yr, Barter was asked whether he had contacted "rs , Stookey on the
matter of the widening of Gpan.3 ,',v6rAue between Hope and the end of
Grand, Ee stated that hehad done so and she had agreed 'GO give to the
City the 11% feet of he,r property o.dwlde her fence, but would not
grant 15 feet; but that he would see her again. Col, Smith moved that
the petition for the dedication of 15 feet of the southerly portion of
Grand Avenue, submitted by property owners living on the south side of
Grand Avenue, be forwarded to the City Council with the information
that action cannot be taken due to the mluctanoe of one property owner
to dedicate her property to the City far this purpose. Seoonded by
Mr. Stringer , All ayes, motion carried,
A petition presented by Mr. an3 %e. V. L. Scritameier to change
the name of Sumac Drive and extensions Larch Drive and Ponderosa
Street to Shore Drive, signed by fourteen owners of property on the
street, was discussed. Col, Gronseth mved that the Planning Commis-
$ion r8cO~nmend to the City council that the name of Sumac Drfve, wlth
extensitma Larch Drive and Ponderosa Street, be changed to Shore Drive,
as requested in the petition, Seconded by Mr. Bond, The question of
the difficulty In numberiae; the houses was dlscusaed, and Mr. Barter
asked to work out the numbering system aa soon as possible. All ayes,
motion carried.
A ten-minute recess was called by Chairman Sutton, during which
there was conaiderable informal discussion with Mr. *aul Eckes, Mr.
Arrdrews from the off ices of Freeland, Peterson Evenson, and sr;
Allen 'I[ellg, as to their desires in regard to zoning of thslr untoned
property in the Terramar area. Mr. Eckes spoke at length with reference

to his negotiations with the San Diego Gas & Electric Company and with
Mr. W,D. Cannon, and his tentative plan to put 5x1 a trailer court on a
seven-acre portion of' his ,land) and stated that he felt it would be to
everyone's advantage to defer any zoning of the area until these nego-
tiations have been concluded. &I stated that he would not do anything
in the meantime that might hurt the Ciw in any way; that he might
want to put up a flower stand, or lease some of the land lor flower-
raising. The matter of smg which might result fPom the San Diego Gas
& Electric Company*s future operations, or other industrial usm, was
discussed, and suggestions made as to regulatory measures.
Chairman Sutton reconvened the Commission, and Col, Smith moved
that, beoause of the apparent reluctance of the owners of unzoned
property to have their property zoned at this time, furOher zoning of
this area be deferred and. not be considered earlier than Monday, April
13th. Seconded by Mr. &Clellan. All ayes, motion carried.
Mr. Andrews asked about the subdivision ordinance, and was advised
that it is still under study by the Council, but that It was hoped
that action could be begun on it at the next meting,
Secretary Smith read a letter written by Lawrenoe, Felt, requesting
a special use permit to allow construction of a trailer park on the
Royal Palm property., Mr. Bond moved that the matter be set for hear-
ing on March 23, 1953, at 7:OO p. m. Seconded by hdr. Stringer. All
ayes, motion carried.
Secretary Smith read copies ol three letters from t'he Department
of Education approving a site for a high school in Carlsbad, described
as Tracts 248 and 249, Thum Lands.
Secretary Smith read a letter from Barbara Lane; Hayes, attorney for (3. C, Hill* a643 Adaxus Street, owner8 of Lots 18 and 19, Block B,
Alles Avocado Acres, accompanied by a drawing showing proposed division
of the property into six lots, The drawing was exadned and tb lot
design discussed, after which MP. Bond moved that a recommndatlon be
made to tb City Counail that the lot plan be not approved, for ths
reason that four lots have a frdntage of only 53 feet on Palm Avenue;
and reeomrnending that the above-mentioned four lots be divided into
thrae lots, each having a frontage of approximately 70 feet. Seconded
by Mr. kSleUan. A11 aye8 , motion carried.

Chairman Sutton announced the meeting of the Sari Diego Planning
Congress in San Diego at 6:45 p. m. on Thursday, March 19th, in the
Rlviera Room at the U, S, Grant Hotel, Reservations are to be mailed
in not later than Friday, the 13th, and Mrs. Verlldlyea was asked to
check with the membemr on that date and send in the reservation list,
There being no fbrther business to cow before the Commission, the
meeting was declared adjourned at 10:25 p. m.
