Present besides the Chalrman were Commissioners Gronseth, Bond, Stringer, Smith, Ivlagor &Clellan and Public Vilorks Director. Absent, Commissioner Robin- son. Minutes of the meeting of Nlarch 23rd were approved as briefed. Chairman Suttcm announced that Bill Fry, contractor for Mr. John A. Eier, had requested that hearinp on the Hier application for varianc6 in rear yard. setback be delayed. until 9:30 to permit kim to attend, Pro- tests to the granting of the variance were registered by the following persons, som of whom were unable to remain for the hearing: blps. Lena Sutton, Mr. Arthur C, Rest, b. and Krs. Z. T. hyd, Secretary Smith read the liotice of P-dblic Hearing on the applica- tion of X. H. and Jane C. Sorineman for reclassification Prom X-2 to C-2 of Lots 29 to 32, inclusive, in Block 56, Car1sba.d Townsite, behg the northwest corner of Hardinp: and Elm Avenue. The question:of the advisability of granting C-2 zoning in that area was discussed., and hfys. Sonneman consented to amend her application, substituting C-1. It was agreed that the Planning Commission should initiate the reclassification of a larger area than that covered by the Sonneman application, Col. Gronseth moved that a hearing be set on April 27th, at 7:OO p. m., to consider tne reclassification from R-2 to C-1 of 100 feet on both sides of Elm Avenue from the presently zmed C-1 to the California State High- way XI-SD-2B; and that the amdnded application of R, I?. and Jane C, Sonneman be tabled for two weeks, until April 27th. Seconded by Col. Srni’k. All ayes, motion carrien. No protests. Time of hearing, 15 minutes. Secretary Smith read Notice of Public Hearing on tb application of Security Trust & Savings Bank of San Diego for variance in front yard setback from 50 feet to 40 feet, There were no protests, Col. Gronseth moved ’chat the Planning Commission recommnd to the City Council approval of thc application of the Securitv Trust & SRvinzs Bank for variance. Sccanded by hk. Stringer. Secretary Smith read the application of E, Thacher for reclassifi- cation from E-2 to X-lB, anrd lettea with s:’_x signatures supporting same, - 1- of an area descl3ibed as follows: north boundary, Tamarack Street; east bound-ary, California State Highway XI-SD-2B, south boundary, the southern boundary of Thum Lands; and west boundary, the wnter of tile Atchison, Topeka eC. Santa Fa Railroad right-of-way, It was pointed out that one signer had asked for R-1 zoning, Dusenbury, representlug the ap- plican-c, was asked to contact other owners in the area to ascertain their wishes, and agreed to do so. Col, Smith moved th&t ahsaring be set on the 27th of April, at 7:OO p. m., on the application of E, Thacher et al, for reclassification from Zone E-2 to Zone R-1B of the property bounded on tb.p;"narth by Tama'rack Street, on the east by California State xighway XI-SD-2B, on the south by t?le southern 'oound.ary of Thum Lands, and on the west by the center of the Atchison, Topeka & Santa Fe 2ail- road right-of-way, Seconded by Mr. Bond. Ayes, Bopd, Smith, lkCl3llan, Barter, Sutton, Stringer. Nap, Gronseth, Absent, Robinson. Motion carried. Secretary Smith reviewed the Notice of Public Baring on the ap- plicatiou of Bernard L, and Anita Ribonsin for special use pemit to establish a trailer court, and variance in front yard setback from 50 to 35 feet on property described as Lot 24, Seaside Lands. Chairman Sutton explained that the Commission members had held a conference, at which nearly all members were present, to study and recommend to the City Council stipulations to be attached to the approval of the special use permit, These recommendations are as follows: "BASIS = STAT? TRAILEX ACT. 1. Area - 1200 square feet. 2, Width = 30 feet, 3. Drive width - 30 feet. Hard surface, asphalt or cement. 4. Side yard - 5 feet, 5. Rear yard - 25 feet. 6, Distanoe betweex tsvo trailers or trailer and 7. Toilets = 10 each sex. All toilets mst be connected building - 6 feet. to public sewGr system, Minimum 4"cast iron sewer connections to each trailer space, cast iron soil lines only permitted, 8. Fees - $5.00 per space per :nu~th. 9, No trailer may be placed in court for rental purpos8s." bfr, Robinson was present Wd objected to the 30-foot street width, stating that the State minimum is 15 feet, and the 1200-square-foot area, wbreas the State requirement is 750 square feet. C, C. Walters also objected tc imposfng requimments greater than the State minimums. After considerable discussion, Col, Gronseth moved that the cozditions -2- as embodied in this proposal be maommended to the City Council as re- quirements for the Bernard Robinson trailer court. Seconded by Mr. Barter. Ayes, Gronseth, Bar,ter, Bond., "IClellil;F, Sutton, Smith. Nays, Stringer. Absent, Er. Eobinson. i%?. Walters was invited by Chairman Sutton :;o examine the data on which the decision of the Commission was based. Time of hearing, 25 minutes. No protests, Secretary Smith reviewed the application of G. C. Hill. for approv- al of lot desipp, and. the recommendation of the City Council reTerring the matter back to the Planning Conmission for furtLkr consideration. After taking into consideration the fact that one of the lots has been sold, rendering any other division of the lots than the suggested one impractical, Mr. Stringer moved that a recornmenciation be mad.@ to the City Council thst Mr. Ri111s plot plan be approved as submitted, Seconded by Col, Smith. It was agreed that the kfty Attorney should be asked for an interpretation of bs. Lang's statements as to approval of the plot plan permitting division of this property without comifig under the Subdivision Act. Vote on the mtion; ayes, Barter, Sllttm, Smith, Stringer, Bond, Granseth, Mr. XcClellan having been excused at 8:45 to attend a Sanitary Board meeting. Secretary Smith read 9 letter from Fo,ter & Kleiser requesting tht outdoor advertisinn be declared a permitted use in C-1, C-2, IvI-1, and X-2 zones. Tr+ zoning ordinance was examined for any reference to this type of business, md. none was found, although such operations am licensed under Section 35 of the business license ordinance 6005. After discussion, Col, Gronseth moved that the letter from Foste~ & Kleiser be referred to the Ci5 Council with the inforP2t;ion tht the Flaming Com- mission finds no permission in the zoning ordinance for the emction of signs in excess of 6 square feet; and suggesting that the letter be re- ferred to the City Attorney for his interpretation of the erection of commercial signs, referring the letter back to the Planning Commission for furather recommendations to the City Council, Seconder? by Col. Smith, A11 ayes, motion carried. It was suggested that the City Clerk be requested to ask for more copies of the County Zoning Ordinance 371, ad.opted by the City as Ordinance 9005. Secretary Smith re3d a memorandum from the City Council asking - 3- that that the Commission consider an amendment to Ordinance 9025 (Subdivision Ordinance) providing for exceptions to the requirements of Section 111-C-1 under special circumstances. Chairman Sutton, who had been present at the City Council' meeting at time of adoption of the ordinance, gave some background on the matter, After discuss Ton, Col. After a 10-minute recess, during which Mr. McClellan returned, tht Commission was reconvened at 9:30, - Secretary Smith read the Notice of Puklic Rearing bii the Jo'm A. Hier application for variance in rear yard setlbwk from 50 to 34 feet, XPY, 3. T, Boyd read a letter, virl'sten by her hsbad, protesting against granting of the variance, and stated that their specific objection was that tb variance would be pointless unless the applicant was planni-ng to cut a street through his propartg and builc' 3maller homes on the re- maining property, if a zone change could be obtained, which would not be in keeping with present homes in the area. Mr. Hiep stated smphati- cally that he had no such plans . iGr. Hier's contention was that, should he comply with the regular setback of 50 feet, the view wo~tld be con- siderably impairerl, as the site chosen for the house was thc high spot of the property and afforded an excellent view of the ocean. Kr, Barter stated that he had inspected the area and, while he had not put an in- stllument on it, he believed. that about 18 inchss of altitutde wau1.d be lost in the 16 feet; and that three other pieces of property would be adversely affected by the Zact that this building, as proposed, would be 16 feet closer to the rear property line than it should be, Mr. Arthur West also objected on the ground that :Jro Hier may later cut through a street and face houses 011 it. h. Claltd Fennel stated that the Hier home would be a very nice home and a credit to the neigl-ibor- hood; that the property was too fixe Lo degeneral;e by patting in poor homes. After a lengthy discussion, Idr, Bond moved that the setback be - 4- be as reqzlired undcr present zoning, snd that KT. Rierl, request for variance be denied. Seconded by Mr. Barter. Col. Gronseth -reminded the Conmission that many similar variances had been granted., specifical- ly pointing out the Palm Vista Tract; and it was also brought out that, in the past, securing a variance was practically a mtter of routine, boLh undcl- the County and in the early days of the local administration, and that this fact had encouraged oimers to draw plans with this idea in mind. Chairman Sutton temporarily relinquished the chair to Secre- tary Smith. Vote on the motion, ayes, Barter, Bo,d; nays, Gronseth, Stringer, Smith. Not voting, XcClellan and Sutton. fiiotion failed. Smith moved the? the Planning Cornmission recom- mend to the City Council that a variance be granted to Mr. John Hier to refluuce the rear yard setback ?porn 50 feet to 40 feet, instead. of 34 feet as requested. Seconded by IGr, 3tringeia . All aps, motion carpied. Time of hearing, 45 minutes. Chairman Sutton announced that new officers would be elected for the ensuing year, and. that nominations for Secrotary were in opder. XP Stringei? was nominated, anr: it was moved and. seconded that nomina- tions be closed, an3 Kr. Stringer was unanilaously elected. For the office of Chairman, the following nams wer&laced in nomination for Chairman: Col. Smith, Col, GroEseth, and Xr. Bond. Vote by secret ballot: Smith 3, Gronseth 2, Eo,d 2. Col. Smith elected..
