Gronseth moved, BSCQnded by gagor bclellan, that Cmr, Bond take the chair for this meeting. All ayes, motion carried. Minutes of the meetlng of May 25th were read and approved. Secretary Stringer read Notice of Public Hearing on the appliaa- tlon of Herbert L, Cole for special permit to allow use of premises at 399 Elm Avenue a8 a cabinet shop, There were no oral or written pro- tests. Cmr, Grmssth mved that the request of' Herbert L, Cole for special use perait be recommended for approval to the City Council, with the proviso that no work will be performed after 11 p. m,, or during such hours as will interfere with neighbors' rest at night, he would be permitted to build an additional house on hfs 75 x 150 lot at 1073 Buena Vista Drive, in an R-1 zone, He was advised that b could add to the present house ad keep up to five roomers, but could not build another house or an addition with kitchen facilities In that zone. He also asked about garbage and rubbish collection by the City and was advised that there is at present no City Ordinance governing such disposal and arrangements must be made individually for refuse colleetlon. Mr. and Mrs, Clarence Reed reported the loss of a very valuable dog; and the very serious illness of another from arsenic poisoning, as diagnosed by a veterinarian, They were advised that this was primarily a police problem, and that the Police Departmmt and animal welfare groupa wem co-operating in an effort to trap the dog poisoners and work out other problems in connection with animal welfare. Ur, and Mrs. Reed also inquired about building requipements on a - 1- c ".. W J property contained sufficient area and frontage on two streets, they would be permitted to build two houses on the property, 90 long as each building site area contains at least 10,000 square feet; however, that it mq be necessary to request a variance for the dwelling facing Hillside. Mr. Barter brought up the matter of tbse properties which had been dividdd into two different zones by the new C-1 zoning on Elm Avenue. A specific case was cited in which the owner of a lot 220 feet deep had C-1 zoning on the front 100 feet of his property razd R-1 on the rear 120 feet, There is an existing dwelling on the rear of the proper- ty and tb owner desired to build another dwelling or busiineas build- ing on the front of the property. After some discussion, the Commis- sion agreed that this could legally be done. During the discussion, the point WRS brought out that several similar situations were creat- ed by the recent R-1A zoning which extended 150 feet east of the east line of Highland Avenue, causing divided zoning of some properties, The tentative subdivision map on "Carlsbad Estates", submitted by Gallinger Construction Company, was studied, Cmr. (IronSeth suggested that the subdivider be required to provide adequate water, fire pro- tection, and that the streets be named and be constructed to the sat- isfaction of the Director of Public Works. It was pointed out that these are requirements under Ordinance 9025, the subdivision ordinance. After discussion, Mr. Barter moved that the plans for 'Carlsbad Eg- tates" subdivision be recommnded for approval as a tentative map, Seconded by Cmr. Granssth, Five ayes, no nays, ~..~cClellan not vo ting, Zoning of the unzoned area east of the railroad tracks was dis- cussed, Mr. McClellan stating that the Light Inhatry Committea would like very mucb to see this done, after discussion, Cmr. Grmseth moved that the Planning Commission recommend to tb City Council the zoning of the territory located between the Santa Fg Railroad tracks and the freeway XI-SD-2B, bounded on the north by the south bank of Agua Hedionda and on the south by Cannon Road, to ZOM 116-1. Seconded by Cmr, Heltm. All aytw, motion carried. bkym Mcclellm sumuwized a letter of resisation from Col, Smith, in which he resigned from the Planning Commission, and asked -2- for suggestions from t?-@ Conrmission as to possible appointees for the unexpired term of Col, Smith and also to fill the vacancy which will be caused when Ordinance 1020 becomes effective. A number of' names were suggested, to be given consideration by the Map?. Cmr. Grmseth suggested that Mr. Bond act as Chairmm pro un- til the new appointments are made, to which all members were agreeable. He also asked. and was given permission to be absent from the next meet- ing, due to vacation plans. Cmr. Grmseth inquired whether any action had been taken in regard to the illegal trailer occupancy on a lot on the west side of Adam Street, south of Magnolia, Pr. Barter stated that the occupant, Mr. c, C. Bryan, had come in with a set of plans, preparatory to taking out a building permit, and that he was working with him on them, Mayor %Clellan stated that the State bad served notice of relin- quishment of the portion of the Hi'ghway through C,rlsbad which will be supersdded by the new freeway, and suggested that it would be in order to propose a nam for it for consideration of the Council. Af- ter consideration of several names, Cmr, Gronseth moved that the Planning Commission recommend to the City Council that the portion of Highway 101 through Carlsbad, if and when it is turned over to the City of Carlsbad, be named "Pas80 del Mar', same being the suggestion of the Honorable Mayor McClellan. Seconded by Mr, Barter, 811 ayes, mot ion carried. There being no further business to come before tb C~mmission, Cmr.
