Present besides Mr. Bond were Corns. Belton, Sutton, Stringer, Baum- gartner and Public Works Director Barter. Absent, Corns. Gronseth and Cockrill. Minutes of the meting of June 8, 1953, were read and approved. Charles Mansir was present and read to the Commission a notice of protest against the Planning Cornmissicn taking any action in regard to zoning on the Poindexter tract (Carlsbad Estates) on the contention that the Commission has no jurisdiction, which notice he served on Act- ing Chairman Bond. The application of Earl V. Callender for variance to permit reduc- tion of side yard setback to 7* feet to allow construction of a patio wall on his property at 2869 Knomles Street was read. Xr. Barter and Mr. Callender explained drawings of the project and stated that the dig. ficulty arose over the fact that Hnowles is a 40-foot-wide street, which would require a 15-foot setback from tm property line (on a corner 105) for the wall. After discussion and consulting the ordinance, Comm, Sutton moved that a time be established for a' field trip for all members to meet at the site and look over this project. Seconded by Comm. &Iton, All ayes, motion carried. It was decided to meet at Mr. Ca1- lender's horn6 at 2869 Knowles Street on Monday, June 29th, at 6:30 p. m. Ur. Harry Andrews of Freeland, P,tsrson and Evenson submgbtted for approval a tentative map of Carlsbad 43, stating it was sub- stantially the same map which had been approved by the County Planning Commission two years ago. &I stated tmt tk lots averaged 18,700 square feet, or .43 acre, with a minimum frontage of 110 feet except for four parcels of 94,feet each. Mr. Andrews read a letter in which the' subdivider requested the suspension of three sections of the Subdi- vision Ordinance (#90ZS) governing width of streets, length of blocks, and numbring of lots beginning with the numaral "1" . Various engineer- ing features were discussed, &. Barter proposing change in curb to a roll-type curb. The extreme length of the blocks was discussed from the standpoint of fire protection, etc. It was brought out that streets constructed to cut the blocks would create a ma-tintenmce problem on ac- count of the steep grade, and would be a liability to the City. -1- Corn, Sutton moved that the planning Commission recommend to the City Cowlcil approval of the block length of Carlsbad Highlands #3, due to the topographical conditions, considering the size, width and area of the lots, and considering the proposed future development south of Carlsbad Highlanflfs #3, Seconded by Corn, Stringer, All ayes, motion carried , Comm. Stringer moved that the Commission recomnrend to the City council that Paragraph 7 of Part "C-" of Ordinance BO25 be suspended In connection with this map, to permit the subdivider to continue the numbering of the lots from Carlabad Highlands #. Seconded by Corn, Heltcn. All ayes, motion carried, Corn, Sutton moved that the Planning Comrnlaaion recommend to the City Council that the width of streets In Carlsbad Highlands #3 be set at 36 feet, including a roll-type curb, a8 approved by the Director of Public Works. Seconded by Corn. Stringer. All ayes, motion carried, Corn. Sutton moved that the Planning Codsslon recommend to th,e City council the approval of the tentative map of Carlsbad Highlands #3, subject to the three considerations above, with the direct understanding that the subdivider, by agreement, wlll complete the connecting streets on or before January 1, 1956; and that those necessary to sign the ten- tative map be instructed to do so, Seconded by Cornm. Stringer, All ayeu, motion carried. After a ten-minute recess, Acting Chairman Bond reconvened the Commission, A letter from Dr, Robert Wilcox of san Diego State College was read, advising that a class under Professor James Taylor wfll partici- pate in the type of stuiiy desired by the Planning Commission; 'cht Pl*3- fessor Taylor will be away for the summer but will contact the City os" carlsbad before the start of the fall semester, Dr. wilcox estimated the cost at approximately $300.00, chiefly transportation expense, and suggested that duping the summer something specific as to the nature of the study be worked out and passed on to Professor Taylor. It was the feeling of the members that this proposal should be accepted and followed up, Corn, Stringer moved that the Planning Comission racon+ mend to tho City Council that the proposal of Dr. wilcox be accepted, -2- Seconded by corn, Sutton. All ayes, mtion carried, Memorandum frox the City Council was read, returning for further action of the cornmiss €on the matter of zoning to "1 the area between the Santa Fe Railroad tracks and California Freeway XI-SD-BB, bounded on the north by the south bank of kgua Hedionda and on the south by Cannon Road, with the information that the City Attorney would advise the Commission as to procedure, After discussion, Corn. Sutton moved that a hearing be set on Monday, July 13, at 7:15 p, me, for considera- tion of zoning to hl=l of the above-described property, All ayes, motion carried. It was suggested that the City Attorney be asked to verify the Iqotice of Public Bearing as to form, Corn. Stringer moved that a letter be written to the proper official of the San Diego Gas & Electric Corn- pany, advisinp .,> them of the initiation by the plannine; Commission of zon- ing to M-1 of the area described above. Second- ed by Corn, StringezS, All ayes, motion carried, Memorandum Trom the City council was read, referring back to the Commission tho plan of "Carlsbaci Estates", submitted by Gallinger Con- struction Company, for the reason that the subdivider wished to make an alteration in the plan, b, Barter explained that the desired altera- tion was the elimination of sidewalks and changing tb concrete curb to an oil mix roll curb, The matter of requiring the subdivider to provide access to property in Tract 236, which would necessitate relinquishing Lot 39 for that; puipose, was discussed, but it was tb feeling of the Corn- mission that this would be an unfair requiremen,t, The suggestion was made that owners who would benefit b:~ such access might get together and acquire the lot, Drabage and other engineering details were dis- cussed, and also the possibility of drainage water from the tract crest- ing difficulties on land lying below through washing and erosion. Corn. Sutton moved that the Commission recommend to the City Council the ap- proval of the tentative map of Carlsbad Estates, submitted by Gallinger Construction Company, subject to a 36-foot street width, plus curbs as approved by tb Director of Public Works, eliminating the sidewalks, Seconded by Corn, Helton, All ayes, motion carried. - 3- There being no further business to come before the hmfSsiCn, COY^^.
