Present besides the Chairman were Commissioners Stringer, Baumgartner,
Cockrill, Sutton, Groaseth, Building Inspector Ewald, and Public Works
Director Barter. Absent, none.
Comm. Gronseth moved that reading of the minutes of the
meeting of August 24th be waived. Seconded by comma Cockrill. All
ayes, motion carried.
Secretary Stringer read the petition of T. L. Crom, et
al, for reclassification from R-2 to R-3 of property described as a
portion of Tract 202, Thum Lands, Ikp 16 81, and Lot 11, Block A,
Palisades, hap 1747. I”I. Crom was present and explained his reasons
for req,uestJng rezoning. After discussion and consulting the map,
it was decid-ed to consider a larger 8rea than that described. Comm,
Sutton moved that a hearing be set on SeFternber 28, 1953, at 7:30
described 8,s all those portions of Tracts 201 and 202, Thum Lands,
presently zoned R-2, an3 zll/of Block A, Palisades, presently zoned portions
E-2, as requested by T. L. Crom et al, and. the Carlsbad Planning
Commission. Seconded by Comm. Stringer. Fu1 ayes, motion carried.
Secretary Stringer read the application of Dan and
Elizabeth Perkins et al, for reclassification from E-2 to R-1 of
property described as a portion of Tract 244, Thurn Lands. Since
this property is in the vicinity of the area covered by the petition
for reclassification filed by Mr. and Nrs. Melvin Lull, on which ac-
tion was deferred from the meeting of August 24th, Mr. Lull was asked
to report on the general feelbg concerning rezoning which he had
encountered in interviewing his neighbors. He reported tht he had
called on a number of people in the district between Chestnut and
were all in favor of reducing the lot size, but that all of them were
concerned as to the location of proposed streets. He asked permis-
sion to borrow the proposed master street plan to show in making con-
tacts, and was advised that Mr. Barter would prepare a copy on a
smaller map, to be ready Wednesday, to which would be attached a memo

from the Planning Commission to the effect that the map constituted only
a proposed plan and was wholly unofficial at this time. Comm, Stringer
stated that he had been approached by C. C. Walters, who had asked that
his property be excluded from any zone change. The Lull application was
further deferred until Mr. Lull can go back to his neighbors with the
street map'.
Corn. Gronseth moved that a hearing be set for Seytember 28th,
at 8:OO p. m*., to consider reclassification from E-2 to R-1 of the proper-
ty described in the application of Dan and Elizabeth Perkins et al, and
in addition, at the initiation of the Planning Commission, to include the
remaining portions of the block bounded by Basswood and Chestnut on the
north and south, Valley on the east, a,nd the present R-1 zone on the west;
Seconded by Corm. Helton. All ayes, motion carried.
Come Stringer suggested that when the class from the State
College makes its study of the City, perhaps they could work out a master
street plan as one part of their study.
Secretary Stringer read the applisation of Alonzo V. Ronero
for special use permit to allow expansion of his operations at 534 Elm
Avenue to include a, diaper laundry service. After discussion, Corm,
Helton moved that a recommendation be made to the City Council that the
application of Alonzo V. Homero for special use permit to allow expaYleion
of his omrations at Al's Self-Service Laundry to include a diaper service,
be granted, Seconded by Corn. Cockrill, All ayes, motion carried,
A letter from Gallinger Corporation, San Diego, was read,
requesting variances in side line setback on ten lots in Carlsbad Estates,
and explaining reasons therefor. Bill Baldxin was present, representing
the applicant, and stated that every effort had been made to conform to
zoning regulations, but in order to preserve the attractive appearance of
the tract, and to avoid the delay of going back through the Veteranst
Administration with a revised plan, it was necessary to apply for the
variances in these ten instances'. He was advised that the application
should have been made on the regular printed form, accompanied by a fee of
#10,00 per lot, and stated that the application would be submitted in
proper form, with check attached, immediately', Coma. Sutton moved that
a hearing be set on September 28th, at 8:30, to consider the request of

the Galli_rlger Corporation for ten varimces in side yard setback on lots
in "Carlsbad Estates" as described in their letter, subject to receist of
a deposit of $lO,OO per lot prior to date of advertisbg. Seconded by
Comm, Helton. All ayes, motion carried,
The application for zone change from E-2 to R-LA of property
dcscriiea as all of Lots 1, 2, ma 3, and a portion of Lot 11, Cedar Hills
Addition, Ihp 532, requested by John A, Hier and the Carlsbad Planning
Comission, was reviewed. The Secretary read e letter from J. T. Boyd of
1338 Forest, protestlng the rezofiing on the growlas that development of
the area under R-LA zoning would involve high costs to neighboring owners
for sewers, etc. Mr. Hier IVES questioned as to his plsns for developnent
of his property, p3,rticularly whether he proposes to construct a street
running north from Forest Avenue tlwough his property, md stated that
his plans were indefinite exce;ot that he had considered making three or
possiS13; four lots fronting 03 Forest Avenue, on which he has 240 feet of
frontage, He was advised that under no circumstances would he be per-
laitted to build in front of his present dwelling, to which had been dedi-
cated 75 feet frontage on Forest. The Commission felt, after considerable
discussion, that it would be advisable to have a sketch showing Nr. Hier's
plan of development of the parcel before making any recommendation of re-
clcssificF,tion, md he was asked to submit such a sketch, Comm. Sutton
moved tkTt the application be tabled to Nand-ay, October 12th, at 7:30 p. m.
Seconded by Comm. Helton, All ayes, motion carried. Mr. Hier assured the
Conmission that the ddlay would. cause him no inconvenience. It was further
agreed thst letters be sent to Mr. L. D. Reeder, Mr. Culver Nichols,
Mr. C. Brodie, Mrs. Lena Sutton, I4r. . Lemon, IYlr. Leo Schlosser, Mr.
A. €3. Demison, Mr. J. '17. Boyd, of the action taken. The Secretary was
also requested to have the minutes of the April 13th meeting available for
reading at th5 meeting on October 12th.
Secretnry Stringer read Notice of Public Hearing on an appli-

policy of the Planning Comission is in regard to rezoning to R-2 areas

east of the Freeway, where no sewers are a.val_labk, He st:3,ted he was
stronTly opposed to extending R-2 zoninq beyozd the freeway in the
absence of sewers, but that where it nust be considered it shou1.d be
done by entire sections and. all. ovmers be give:? 2. chance to emress
their views. It wa,s ermhasized that in the zrsa in question, two-
family dwellings already exist, so that 5-2 zoning would r,ot in fact
?errnit any uses which do not exist 2,t this time, in violation of R-1
zoni3F;. After considerable discussion, COi.rd. Stringer moved that a
pecomvend2,tion be made to the City Council tb,t the aplication for
reclassificatioi? from R-1 to R-2 of the progerty described in the ad-
vertisement be granted. Seconded by Comm. Baumgart-ner, Comm.
Sutton stated he wished to go on record as personally being very
much opposed to any 9-2 zoning across Pi0 Pic0 Drive, as he felt it is
a vsry major ste?, inf1uencin.g the entire fu-ttme of the east side of
the freeway, m-d th2,t he wished to take this stmd before the Commis-
sion makes any recommendations for multiple dwelling zoning east of
the freeway. Vote on the motion: ayes, Helton, Baumgartner, Cockrill,
Bond, Strin7er; nays, Sutton an6 Gronaeth. Motion carried.
Secretary Stringer read a letter from Mrs. Elizabeth
Taylor asking whether zoning on the Howard. Butler property (R-1)
would be suitable for a nursSng home for elderly persons; =and also a
letter from Howard Butler askwg that the reply to this inq,uiry be
confined- to areas without mentioning sTecific properties or names.
COJWI. Helton stated that Mr. Butler had talked to him on this subjdct,
and seemed to fed thsrt any publicity of this nature involving his
property would hurt his chances of selling it. It was agreed that
such use of the property would be id conformity with the zoning, and
that Mrs. Taylor should be so advised.
Mr. Emit brought up the matter of asking refunds of re-
cIzssificatfon fees to the applicants, where requests for rezoning are
denied, ,and stated he felt that no refunds should be made, either on
varimcss or recl-assifications, but that they shoul.l! be retained to
defray costs of printing and badling. After discussion, Corn.
Sutton moved tbt the Commission recomend to the City Council thst
in the case of both variaulces and reclassificztions, no refunds be
made if the request is not ,qrcmted. Seconded by Corm, Stringer.,
nays, Corn. Gronseth, Motion carried,
Comm, Sutton reported that he had talked to Dr. WilCOX
of State Collese, who stated tht school registration woul& be held
Thursday and Friday of this week, and.. if at least ten 03: twelve
students registered for th9 course in Political Science which would
be assigned 'to the proynosed Dlmn3.ny stuct;V of Carlsbad., Dr. Wilcox
would contact him tbe latter part of this week or early next week as
to when a meetlng could be arrmged.
City Councilmas3 Chese was present and stated that he would like to
request that during the course of the proposed phnning study, a
master drainaEe pkw for the whole Bits of Carlsbad be studied, and.
also a plan for the streets and roads'. Cm. Sutton stated that
Professor Taylor had intima.ted_ that although set up as a semester
course, it could possibly hold over into the second semester.
Chairman Bond renorted that I-5 copies of the Population
of Sa Diego Couszty report had been received and were avai3aSle for
members. Mrs. Vermilysa was asked to notify the School Board,
Sanitary Board., Chamber of Commerce, that copies were available for
them .
There being no further business to ccme before the Com-
rnlssion, the meeting was declared adjourned at 9:40 p. a,
