Secretary Stringer read the request of Claud Fennel for release to abutting property owners, prior rights to that portion of Road Survey #I33 ad 'old Survey No. 43', lying between Vista Wag and tb Easterly boundary line of the new State Freeway - lying outside of Roadway No, 843 and the State Freeway. Also read was an outline of procedure for vacating abandoned mad, submitted by City Attorney Smith. The map was consulted but members of the Commission were not entirely clear as to the exact location of the portion of the road involved. After discussion, Cmn, Sutton moved tht the corresponding secretary of the Planning Commission notify Mr. Fennel that the Commission is very anxious to co-operate with him and request that he attend the meeting on December 28th with a more detailed explanation of his request, Secogded by Corn. Cockrill. All ayes, motion oarried, Chairman Bond reported that Mr. G, Millard Parks, Planning Engineer of Santa Ana, has indicated that he will be available to come down for one night a month to consult with the Cornmission. His rates as noted on his card are as follows: 1 day $50.00, plus ~10.00 for n3fht meettng 2 days $90.00, plus H H ~4.00, A 5.00 n a n a I n , 5.00 The Commission felt it would be very dtMirable to have the benefit of the services of an expert planner, but considered it doubtful that It would be possible, financially, to engage Mr. Parks for an evening. Chairman Bond volunteered to drop Hr, Parks a note that the matter will be kept on the agenda and, if a meeting can be arranged, he will be given at least two weeks' notice in advance. Secretary Stringer read Notice of Public Hearing to consider the petition of Thomas Lo Crom et a1 for reclassification from B-2 to R-3 of the northeasterly 88 feet of Tracts 201 and 202, Thum Lands, located on the west side of Garfield between Pine and Walnut Avenues, Mr. Crom was present In support of his petition, and signatures of twelve other proper- ty owners in the area who were favorable to the change were submitted on cards and letters of consent, There were four written protests: Mr. and Hrs, Harrie Gibson; Margaret Ma Bolles;, Mr. and Mrs. John Snyder; and Flora Kays Hanson. Mr. Gibson and Mr. Snyder were present and explained their objections to the rezoning were the small size of the lots for pur- poses of multiple dwellings, and lowering of the present standards of the neighborhood, Mr. Crom explained his plans for building a slngle-family dwelling and a double garage with dwelling units above, but Corn, SuttOn pointed out that under B-3 setba6k requirements it would be necessary to stay in 25 feet from the rear yard line, which would not be possible on an 88-foot depth; and that, although the garage could be placed on the rear line, the addition of dwelling units above the garage would require the 25-foot rear yard, After discussion, Coma. Cockrill moved that a recommendation be made to the City Council for approval of the Crom ap- plication for reclassification from R-2 to R-3 of the property described in the advertisement of December 3, 1953. Seconded by Corn, Stringer, All ayes, motion oarried, Corn. Sutton further moved that violations on the property of He F. Heidegger at 3305 Garfield, be investigated by the building inspector. Seconded by Comm, Cookrill. All ayes, motion carried, Secretary Stringer read Notice of Public Hearing on the application of Roy D. and Gertrude Whitmore, omers, and %in Inns, Inc., lessee, of a portion of Tract 1 of Laguna Mesa Tracts, located on Jefferson Street at the Freeway, for reclassification from E-2 to C-1 of the Northwesterly 30 feet of the Northeasterly 75 feet of that property; purpose of the re- zoning to be/the erection of advertising signs. A similar application for reclassification from B1-A to C-1 was read, covering the southwest corner to permit of the Katherine Cappe' property, located on Harrison Street near Chin- quapa Avenue, being a portion of Tract 238, Thum Lands, said request be- ing made by Katherine Cappe', owner, aad Twin Inns, Inc., lessee. Letters of protest from Estelle Gibson, Mr. and Mrs. Elwood Trask, Mr. and Mrs, Verne Collins, and Hr. and Mrs. E, A, G, Ganoe were read; also an informal -1- 1 ,' 0 petition signed by Eric:. Mack, Eric W. Stephan, Robert 0. Jones, Thomas O'Farrell, Mrs. Lowell hichardson, John J. Monahan, Martha R. Ganoe Marion J. Jensen, Jane C. Oldham, and Frantz A. KSdson. The rezoning in both instances were sought for the same purpose, i. e., erection of billboards. Attorney Wm. Daubney, representing Twin Inns, Inc., stated that Mr. Kentner would erect signs that would be attractive and in no way detract from the appearanoe of the areas. A number of protestmts were present and several expressed themselves as not objectag especially to the Twin Inns' erecting a sign but felt that it would be setting a danger- ous precedent, and that it would be difficult or impossible to restrict out-of-town firms from erecting billboards if a zone change were granted. Protestants so expressjng themselves were Mr. Eric kck, Nr. Thomas 0' - Farrell, and Mr. John Jensen, It was suggested that those merchants dependent for their business upon the traveling public might co-operate in erecting one large comnrunb ity sign at both the north and the south city limits, possibly with the City owning the sign and leasing space on it to the merchants. It was decided that since the Chamber of Commerce has a committee working on the sign situation, which would no doubt have a report at the luncheon meeting on Tuesday, the matter should be deferred until their findings could be studied. Mr. Ewald stated that he has pushed the Chamber on this for some time and finally got the Committee formed, and stated that some sup- port from the Planning Board members would be of assistance. He asked that as many as could possiQ1y do so attend the noon meeting on Tuesday, Comm. Baumgartner moved that further discussion of the matter be deferred until the next meetlng of the Commission/at which time it would be known whether the Chamber of Commerce has come up with something substantial. Seconded by Comm. Cockrill. All ayes, motion carried, It was agreed to hold a special meeting on Monday evening, December 21st, at 7:3O P. PI. r-;L.l* 7; 30 /"?e, proposed Public Works Director Barter reported on the/extension of Elm Avenue to Highland Drlve, outlining on the map the proposed route and explaining that it would necessitate moving three small houses. It was suggested that by projecting the street along property lines, making a wide turn onto Highland Drive, considerable economy would result as it would involve less improved property. Mr. Barter also explallned the Tamarack Street proposed extension to -3 - - ~ . ~~ ~~~~ ~. ~ ~ " ___~ c Valley Street on the map, and stated that the route as delineated in the Planning Commission recommendation seemed very feasible, It was suggest- ed that Mr. Barter prepare an engineering report on both extensions, per- haps presenting plans on alternate routes. Secretary Stringer read a memorandum from the City Council referring back for further consideration the application of Melvin and Jeannette Lull for reclassification from E-2 to R-1 of the area described as all of Tract 245 except the westerly 150 feet, and all of Tract 250, T hum kinds, located between a line 150 feet east of the east line of Highland Drive on the west, Monroe Street on the east, Chestnut Avenue on the north, and Magnolia Avenue on the south. Secretary Stringer also read a letter signed by Melvin and Jeannette Lull withdrawlng their petition for reclassification and requesting refund of the application fee, less printing costs, There was some disdusslon as to whether the fee could properly be refunded, since the ordinance is silent on the matter of refunds. However, since it had been the policy to make refund of the fee where the reque& was not granted, at the time the Lull application was filed in July, and they had been advised that refund would be made if the request was not granted, it was decided to recommend refund of the fee. Comm. Baumgartner moved that the application fee accompanying the Lull request for rezoning be refund- ed, less expenses involved In handling the application, Chairman Bond vacated the chair2 namlng Secretary Stringer as Chairman pro tern, and seconded the motion. Ayes, Comms, CockrI&l, Baumgartner, Bond; nays, Comms. Sutton and Stringer, Proposed Ordinance 9031, amending Ordinance 9005, providing for the placement of billboards and other advertising structures, was studied. After discussion, Comm, Sutton moved that proposed Ordinance f9031 be recommended to the City Council for adoption, and that it also be called to the Council's attention that there is no means of restricting signs in an unzoned area, and that the matter should be given immediate attention. Seconded by Corn. Baumgartner, All ayes, motion carried. There belng no further business to come before the Cornmission, Comm. Cockrill moved, Comm. Sutton seconded, that the meeting be adjourned.
