Present besides the chairman were Comms. hungartner, Swirsky, Smith, Stringer, Ledgerwood, Public Works Uirector Anthony. Absent, none. Comm, Smith moved that reading of the minutes of October 25th be saived, and that the Secretary brief said minutes as to any important mat- ters. Seconded by Comm, Stringer. All ayes, motion oarried. Secretary Baumgartner summarized briefly the minutes of October 25th. Mr. Paul Wisdom of 1133 South Pacific, Oceanslde, appeared before the Commission to request information as to whether he would be permitted to build five houses on property owned by him at the corner of Chinquapin and Adams, of whioh only one lot would face a dedicated street. He asked that he be notified if any action Is taken to change the definition of a street so that inside lots may be served. He was advised that a great deal of thought is being given this situation as other requests have been made,. bearing on the same situa,tlon; and that he will be notified if' and when action is taken. The secretary read the application of G. D, McLean, 2740 Arland Road, for reolassification from E-2 to R-1 of property described as kt 3, Wilsonia Tract. Mr. C, R. Helton was present in behalf of the applicant, and Mr. and Mrs. A. 0. Reynolds, 2778 Arland Road, also were present and expressed themselves as being favorable to the reclassification. Mr. Helton stated that the property in question has 147 feet frontage and Ivlr. Nokan wishes to build a second house on it. Comm. Swirsky submitted a sketch of the block showing that the property is fully developed except for the lot In question, and that rezoning to B-1 would permit development of this lot somewhat in conformity with the other houses on the block. After some discussion, during which it was brought out that some members were reluotant to recommend rezoning of this lot, even though it is con- tiguous to E-1 zoning aoross the street, Comm. Smith moved that no action be taken at this time on the application of 0. D. Mckan for rezoning; that the matter be deferred to the next meeting to determine whether there is sufficient sentiment in the neighborhood to rezone the entire Arland Road -1- area. Seconded by Comm. Stringer, Mr. Helton was asked whether the delay would be detrimental to I%?. IqcLean, and stated that the owner is very an- xious to begin construction. He stated he had intended to include his own property in the application but apparently had not worded the application properly. He stated that William Hines, owning property at the corner of Buena Vista and Arlmd Road, was favorable to the reclassJ.fication, and it was generally felt that granting of the request could not possibly jeopard- ize the rights of any neighbors as practically all had violated the E-2 zoning. It was pointed out that there were no protests, written or oral. Comm. Ledgerwood asked for a aeview of the minutes of the meeting of October 25th pertaining to this matter, which were read. Vote on the motion: ayes, Stringer, Smith; nays, Baumgartner, Swirsky and Lsdgerwood; Comm, Cockrill abstaining. Hotion failed. After further discussion, Corn, Swirsky moved that a reoommendatlon be made to the City Council for approval of the request of Mr. Mckm for reolassification from E-2 to R-lA on Lot 5, Wilsonia Tract, to be applicable to the westerly 175 feet only. Seconded by Coram, Baumgartner. Comm, Smith stated he felt it would be regrettable to pass this motion, for it is open- ing the way for an individual to demand, on a precedent basis, spot zoning, Comm. Helton stated he felt that if the Commission deemed it desirable to defer this matter for two weeks, such a delay would not hurt I%?, McLean too much. Vote on the motion: ayes, Cockrill, Swirsky, Baumgartner, Ledgemood, Nays, Stringer and Smith, Motion carried, 4-20 Mrs. Kichard K, Smith, 995 Knowles, was present in support of her husband's letter inquiring of the Com.ission whether chinchillas could legally be raised in an R-Y3 zone. There was considerable discussion as to interpretation of the zoning ordinance on this point, Coma. Swirsky quoting from the new San Diego County zoning ordinance providing that the raising of chinchillas is a permitted use in an H-1 zone, After consider- able discussion, Comm. Swirsky moved that the City Attorney be asked for an opinion as to whether the raising of chinohillas on a commercial basis is permissible in an R-1 zone, and that i?* he rules it is a permissible i.. use under H-1, that some action be taken, Seconded by Comm. Baumgartuer. All ayes, motion carried. Cmn. Sutton was present and suggested that if the City Attorney rules that such use is illegal, it be recommended to the Council that it be made legal. There was further discussion, but it was decided to let the motion stand. Mr. W. D. Cannon applied to the Commission for an extension of time for approval of final map on Terramar Unit #4, for the reason that he will be occupied for some time with construction on 23 houses in Terramar #2 and #3, and also that his offer to the County of San Diego of a parcel of land for construction of a County regional center, a portion of which lies within Terramar #4, will not expire until Apri) Ijth, 1955. He re- quested an extension to June 30, 1935, on the map. It was suggested that he write a letter to the City Council making this request, and he agreed to do SO. corn. Stringer moved that a recomeadation be made to the City Counoil that the date for approval of final map of Terramar Unit #4 be extended to June 30, 1955, in view of his generous offer to the County of San Diego for a portion of that tract:. Seconded by Comm. Baumgartner. All ayes motion oarried. Dan Huff’man of was present and stated he had planned to come in with Mr. Wisdom regarding opening of a street in that area to serve interim- lots. He was advised that the Commission is begin- ning a study of relaxation of some of the restrictions, but that until the ordinance is amended there is nothing the Commission could do to allow him to uonslder undertaking a planning study of the City of Carlsbad for the next semester. Chairman Cockrill proposed that the Commission look Into the possibility of employing 8 professional planning group, possibly on a five-year basis at ~1000.00 per year, if that amount could be budgeted for this purpose, and have them make a thorough planning study of Carlsbad. He mentioned the firm of Gordon Witnall k Associates as being a prominent firm, used extensively in this area. Other members of the Commission agreed wholeheartedly with the proposal and Chairman Cockrill was asked to make inquiries as to what could be worked out along these lines. -3 - The application of the Planning Commission for reclassification from B-2 to R4 of property described as Lots 43 to 46, inclusive, Blook A, Hayes Addition to the Town of Carlsbad, was discussed, Corn. Stringer moved that a recommendation be made to the City Council that the request of the Planning Commission for reclassification of Lots 43 to 46, inclu- sive, Block A, Hayes Addition to the Town of Carlsbad, be approved, Seconded by Comm, Baumgartner. All ayes, motion mrried. Coma. kdgerwood was excused at 9 30 P. M. Secretary Baumgartner read th application of A. L, Nevares for reclassification from R-3 to C-1 of property described as Lots 22, 23 and 24, Block 32, Carlesbad Townsite, to allow construction of a barber shop. The application carried the names of ten affected property owners consent- ing to the rezoning, There was some discussion as to whether the entire block should be included ln the reclassif ication, some members expressing doubt as to the wisdom of doing so. However, the majority felt that it was the conviction of the applicant and his eo-signers that in signing the application they had consented to reclassification of their own property. Corn, Smith moved that a hearing be held at 7:15 P, PI, on November 22nd on the application of A, L. Nevares for reclassification From R-3 to C-1 of Lots 22, 23 and 24, Block 32, Carlsbad Carlsbad; and at the Initiation of the PlannSng Commission, to include all other lots in Blook 32 In said reolassification to C-1. Seconded by Secretary Baumgartner. Four ayes, one nay (Swirsky)'. There was further discussion on the matter of the raising of chin- chillas in am R-LB zone. The ea~lie~ motion made by Mr. Swirsky was with- drawn, who moved that the City A ttorney be asked to render an opinion as to whether or not the raising of chinchillas is a permitted use in an B-1 zone. Seconded by Secretary Baumgartner. All ayes, motion oarried. The matter of maklng certain that applioations for variance, special permit or reolassification are in corredt fora and accurately ex- press the Intent of the applicant, was discussed. It was felt that appli- cants should be present in person at time the a3plication comes before the Commission to be set for hearing, so that same may be modified if neoessary.
