Harry Patrick of 3341 Garfield were present in support of the petition, 1% Was recalled tha.t this property was included in an earlier request for Eclassifi- cation made by T, L. Crom, but was excluded by the City council when it was found there was not sufficient expression from the aJners in the area as to their wishes. Comm, Stringer moved that inasmuch 8s this property adjoins R-3 zoning on the west and north, a recommenda- tion be made to the City Council that Mr, Heidegger’s petition for reclassification be granted, Seconded by Comm, Swirsky’, A11 ayes, motion oarried, There was disdussion as to whether the Commission could legally hear two applications for variance whioh had been advertised for hear ing upon the initiative of the Planning Director and City Clerk, with out formal action of the Commission, Cmn, Sutton of the City Council was present and stated he believed that during his term on the Com%is sion authority had been granted the Public Works Director to set hear ings with the consent of one member of the Planning Commission’, While the matter was being looked up in the minutes, the matter of the proposed contract with Gordon Whitnall & Associates was discussed Copies of the revised contract were passed to members for their study md the changes in Part After discussion , ~runm. Stringer, Playor kclellan was present and reminded the Commission that the terms will necessarily have to be governed by availability of the money for disbursing, $u1 ayes, motion carried, Referrug back to the matte?? of authority for publishing Notice of Hearing on variances, an excedpt from the minutes of the meeting of April 27, 1953 was read, indidating that the matter was considered and discussed but no action taked., After further discussion, Smith moved that since the Direc$or of Planning took action on these two proposed hearings in good fadth, and since there is no directive that expressly forbids handling in this matter, that the Commission proceed with the two hearings as 'advertised'.. Seconded by Comrn, Baum- garther, Four ayes, two nags (Cbckrill and Stringer) motion carried. Secretary Baumgartner read Notice of Publlc Hearing on the applla cation of K. I;, Becker, 906 First Street, Oceanside, for variance to permit reduction of front yard setback to 5 feet from property line, and side yard setback on each side to 2% feet from property line, due to the topography of the land, &d to confom to existing setbacks on adjacent property, on Lots 14 an8 15 in Block B, Hayes Compmy Addi- tion to Carlsbad. $here were no protests, and Eir, Becker was present in support of his petition, Aftkr discussion, Corn. Stringer moved that the City council grant the Variances as requested by Nr, Becker. Seconded by Comm, Engelmann. Swirsky moved that it be recommended to the City Councl that the variances requested by the Gallinger Corporation be granted. Seconded by Conm. Smith. Five ayes, one nay (Cockrill) motion carriee Arnold Brilhart of the Brilhart Musical Instrument Corporation was preserit in connection with his application for M-1 zoning of 16 acres on which he has an option. After some discussion as to what procedure should be folluwed in considering zoning of unzoned propert5 within the City of Carlsbad, Corn. Swirsky suggested that 14r. Paul Ecke or his representative and Wr. W, D, Cannon be asied to come in to the meeting on February 28th, at 8:OO P, N,/submit and discuss their proposals for zoning of their property; and that on March 14th at 8:OO P, M, Horace and Allan Kelly and Jay Hoffman come in with their proposals; so that at the next meeting the Commission could pre- pare specific recornendations to the Council, The Commission felt that since the Sari Diego Gas t3 Electric Company had written a letter, accompanied by a map completely outlining their desires as to zoning of their land , as had Mr. Brilhart, it would not be necessary to ask them to attend E meeting, The map outlin2ng their proposal, submitted + to Mr. Brilhart invited the Commission members to visit his plmt and observe their activities', Secretary Baungartner read the recommendation of the Parks, Becreation, Beach and Tree Commission outlining proposed master plan of parks beaches to be included in the County master plan', Comm. Swirsky moved thzt the Planning Commission recommend to the City Council that the report of the Parks, Recreation, Beach and Tree Commission, dated February 1, 1955, be accepted by the City of Carls- bad as a tentative master plan for beach acquisition, and that said plan be forwarded to the County Flaming Commission for insertion in the County Master Plan for beaoh acquisition immediately. Seconded by Comm. Baumgartner, All ayes, rnotian carried. Comm. Stringer re9orted on the meeting held February 1st a6 the U, S , Grant Hotel on harbor development , He stated there were talks on the development of Mission Bay, Los Alamitos Bay (harboring 40,000 boats) and Newport Beach, whose assessed valuation had sky- rocketed from 15,000.00 in 1916 to ~~,OOO,OOO,OO in 1954.. He passed literature and maps to the members for their study, Secretary Baumgartmer read copy of letter from Col, I, H, Gron- Seth suggesting that a change be made in the ordinance which would assess an additional fee on a building permit on lots located within the service area of an existing fire hydrant, if the owner had not previously participated in cost of the hydrant , No action was taken, as the letter was merely for the Commission's information'. Discussion on the rmtter of authorizing the Planning Director to set hearings on applications for variances was resumed, Corn, Smith moved that the Commission authorize the Director of Planning to adver- tise fqotice of Public Hearing on applications received in the City off ices for varian ces. Seconded by Comm, Baumgartner, All ayes, mot ion carried'. Mayor McClellan suggested that if there is any way that more adequate notice can be given on applications for variance and reclass- ification, the Cornmission should consider means of doing so.
