Absent were Comms, Smith The minutes of the June 27th meeting were read and approved. The Secretary read 'Notice of Public Hearing" on application of the Army and Navy Academy for the following requests: (1) Variance for reduction of front yard setback (2) Speciai, Use Permit to allow construction of a to five feet from the property line. chapel in an R-2 Zone, Cockrill moved that we recommend to the City Council the granting of a reduction in front yard setback to 5 feet from property line on the application of the Army and Navy Academy, Seconded by Engelmanni. The reason stated is that it does conform to the setback of the other buildings along Ocean Avenue in that area and there are no written or oral protests', A11 ayes. Motion oarrfed, kdgervrood moved that the special use permit to allow construction of the chapel at "Blocks 1 and 2, Oceanside Addition to Carlsbad" be recomnended to the City Council for acceptance and granting to the Army and Navy Academy, Motion seconded by Cockrill', All ayes. Motion carried, Secretary read "Notice of Public Hearing" on application of Pirate Cove Associates for variance to permit boat ramping, lunoh stznds, gasoline and oil sales, soft drinks, and other usual products sold at bo2.t landinggo Property involved is located in "Block I'D" klla Vista Tract' (RIM Zone) and "Parcel 7, Agua Hedionda Tract" (E-2 Zone). This variance is requested on a temporary basis until proper zoning can be established under the new zoning ordinance', The Secretary read a Staff Report from Gordon Whitnall Assooiates and signed by ky Glioka on application of Pirate Cove Associates for - - U variance to oharge a fee for the launching and dooking of boats in sell gasoline, oil and other products necessary in the maintenance and operation of boats. Mr. Glenn Feist, Attorney at Law, was introduced and stated that he was present to represent Mr. Arthur H, Glissman regarding his request for variance to permit boat ramping and all use8 normal to boat landings, Mr. Feist clarified th.e reauest by stating that, at present, the permit would not include the sale of food, The Ghairmatn suggested that the! two requests be handled together but it was pointed out by the Secretary that, due to the fact that ths erection of lunch stands and sale of soft drinks were requested by Pirate cove Associates, the applications must be oonsidered se tely 44 .+j, Secretary Swirsky read the proposed resolution and iw&%e& L^ comments ~;PP ,A”-,\ c <-T iTj from the audience regarding inforuation contained therein, Mr. Cockrill moved that the resolution pertaining to the Pirate Cove Associates and the Arthur H. Gli.ssman variance be recommended to the City Council for adoption. The motion was seconded by Engelmann. All ayes. IJiotion carried. Th.e hearing was held on the Emmett Roberts application for varianw on side yard requirement to five feet. Property involved is located at “Lot 5, Shangrila Tract”. The Secretary reviewed apylication and excerpts from the minutes of June 13th were read. -ts, Mr, brtin L. Baker, contractor for Mr. Roberts was present, He stated that he had contacted the Carlsbad Mutual Water Company md had been gmnted permission to build w1.thin 5 feet from the center.of the water easement. /d-. There were no protests, written or oral. The nap of Shangrila Tract wa.s examined to find out where an exten- sion of Yourell Avenue would be should Cedar IIills Addition be developed in the future, It was decided that, since the property is looated over the crest of the hill, the side yard variance would not detract from the appearance or the value of the tract, 1%. &ker assured the commission th0.t every effort would be made to construct a dwelling which would be suitable for the property in question. Englemann moved that the variance on the side yard requirement to five feet as requested by Nr, Emmett Roberts, due to existtng conditions, on "Lot 5, Shangrlla Tract", be recommended to the City Council for approval. The motion was seconded by kdgerwood. A11 ayes. Motion carried. Mr. Anthony reported to the Commission on the proposed Keith Tract exclusion. He stated that the maps which he had received were inadequate and that the City Attorney had advised him,that, since Mrs, Keith had initiated proceedings, that further study be handled by her attorney and the City of Oceanside. He also stated that he had tried to contact Mr. Ernest Taylor to obtain additional Information and was informed that he Is on vacation at this time'. The Commission decided to hold a work meeting on July 18th at 7:OO p.14. at which time Mr. by Kalicka of Gordon Whltnall & Associates will meet with the group. Announcement was made that no hearings would be held until August 8th. The meeting was adjourned at 8:4O P.M. CARLBAD PLANNING CONIMISSION
