Seconded by Cornm, Jarwie, All ayes, no nays, motion carried WRITTEK CORRESPONDENCE, A letter was react from the earlsbad Union k;lerr,c!.ntary xhool District re: sale of District-owned. property at rear of the' deffemoc. School campus, Xro Kalicka reported on the meeting between School. District and City officials at which possible purchase of this pareel by the City was discussed, statinq that sale proceedirqs had prosressed tothe point where the board could not negotiate with the Sity ianless some unforeseen ciscurnstance should again throw the rnatter openn Another factor xas that the anticipated funds had already been budgeted for use in development of another school site- The Board expressed approval of the idea of developing a small park in connec- tion with each school site and agreed that in the future the City will be COR- sulted on similar matters, ELLSWORTH-DRACE VARIANCE, Hearing was resumed on this matter, and Chairman Swirsky reviewed the Notice of Public Hearing on the application for reducti-on of street frontage on portions of Lots 4 and !j9 Block E, BeJla Vista, Mrc Kalicka stated that he had inspected the property and studied the maps, and found the parcel topographically, factually and logically two building sites, fronting two different streets; that the building sites are adequate and it would not be equitable to force the owner to hold t+e parcel as one site, thu:; penalizing him for past errors caused years ago whe:n the lot was created by taking portions of two large lots to create a third one of irregular shape, He stated the portion of the lot where the house wi2-1 be siLuated is consid- erably higher than the street and will look down in%o neighbors' yards, but this is a common circumstanceo He stated that the only sub-standard feature will be the access, and reminded the Commission that they are in a position to exercise control by applying restrictions in recommending ,to the City Council the granting of the variance, if they so decide; also that the tiw limit on the variance could be waived, as conditions and reasons for gran:ing same would not change, and any restrictions or provisions attached to tF.2 variance would run with the land, inmaterial of ownership, Mr, Ken Ebripht, adjoining owner on the north, and Nr, A, AAgre, .lekg;kbor on the south, were present and asked questions of the applicant 14rv Dracep as to his plans for the property, Kre Drace assured them that he t;ould not build a sub-standard structure, that there woula be no structure eref,&ed east of the 93' width of the property and the narrow portion of the property would be at- tractively improved as a long driveway to the residence; also bhat precautions would be taken to guard against cesspool seepage onto the lot-er-level adjoin- Ins properties; and that he was willing to comply with any raasonable build- ing restrictions the Commission may place on the granting of the variance, After considerable discussion, Comm, Stringer moved that the Commission recom- %end to the City Council that the application of Roy Ellsworth and Pauline Drace for reduction in street frontage be granted, subject to the fQllOlJing provisions: 1, That the dwelling be set back at. least. 35 fezt west of the narrow portion of the lot; 2, That the Planning Commission review the plans prior to the issuance of a building permit; 30 That the tims limit for the variance be waived; reason; for this recommendation being 1, Topography of the lot, which is such that the house would have to set back a reasonable distance from the narrow portion, in order to construct a house adequate and appropriate for the neichborhood, and to protect tile safety ana welfare of the neighbors; and of property rights, where there is more than suffi- :ient ground to build an attractive home, 2, To deny the application would be to deprive an owner Seconded by C<)mrn. Corn, Baumgartner requested permissicm to abstain from- voting ar.4 permission was granted, Kr, Kalicka reminding hi-n that an abstention, emept for reasons of a personal interest in the matter, would be recorded as a '.yes" vote, Vote on the motion: six ayes, no nays, Corn. Baumgartner abstaining, motion carried, LOT-SPLITTING: ?RCNTACIE REQUIREI4ENT0 After further discussion on this mat- ter, continued !R;m the previc6us meeting, Comm, Yourell moved the adoption of a resolution recomnendine to f;he City Council the establishment of a policy to the effect that no lot; splits be permitted along Highland Drive which would result in lots having a .frontage of less than 75 feet, which policy would be in accord with !;he recom3endation of the Flanning Commission on the proposed zoning map and 5:oning ordinance; and further, that such a policy is necessary to preserve and assure a desirable development along Highland Drive, Seconded by Comm, Fennel, All ages, no nays, motion carried, C'&nto Youroll !qoved that the 10,000-square-foot building site, 75-foot minimum frontage, extending 140 feet back from property. line on f?ighland Drive, be extended from the intersection of Highland and Elm Avenue, northeast to the end of Highland Drive, Seconded by Comm, Stringer, A13 ayes, no nays, motfc+l carried, e Chairtnan Swirsky appointed' Corns, Baumgartner (-&a&~& , ourell, anmrvie as a Subdivision Committee to study subdivision mags a.IQ make recomrcmdations to the Commission; and a S lit Lot Committee cornposf.d of Cams, Stringer (chairman), Engelmann and Fz" to study any applicacior~3 for lot-splitting to be submitted to the Planning Commission, and make rc?comG. "9 mendations, During a leng:\;hy discussion re: preparation of the proposed zoning n;ap for submission to :he City Council, Comm, Stringer urgently reconwended that fAe proposed zoninz ordinance be modified to allow chickens, under adequate c3n- trols, in R- zones, or at least in W-?,,but rnernhps felt that due to the rapidly changin,? conditions and trend toward urban development and away from rural and semi-yui-al patterns, it would be unwise to permit po\rltry-ke:+ping in any R-zoneo - - CIIP .
