M. by Chuirman Pro Tern Engelmaul. Present besides the Chairman were Commissioners Fennel, Jarvie, Swirsky, Youre11 and Stringer; Planning Secretary Ewald, Planning Consultant Gordon Whitnall and City Engineer Kubota. Absent, C.ommissioner Baumgartner. 2- Comm. Stringer moved that the Minutes of August 13, 1957 be approved as sub- mitted. Seconded by Comm. Yourell. All ayes, motion carried. 3- HEARING - VARIANCE .. QUEBEDE-AUX -- 3ESOLUTION NO. 26. Notice of Fubltc Hearing was read to considez an application for a variance to allow reduc- tion in side yard and frost'yard on propeity legally described as Lots 11, 12 and 13, Block "B" , Hayes Land Addition, Map #Z. There were no oral or written protests. During the discussion it was brought out that the request for varianoe *as the usual request for property along the ocean front. It was moved by Comm. Swirsky and seconded by Comm. Stringer that this variance be granted for the following reasons: front property where it has been common practice to allow the owner to develop more than the normal area in a building lot. 1. That the property upon which the variance has been requested is beach 2. Peculiar topographic conditions exist on the ocean front property. 3. That the property will maintain the same front yard setback as the residence$ on each side of the property. All ayes, variance granted. 4- BUENA VISTA TERRACE SUBDIVISION - - 2ESOLUTION NO. 27. A revised tentative map of Buena Vista T Commission for their review. A letter from Mr. Curtis of Boyle Engineering errace Subdivision was presented to the firm was read, wherein they requested that the street improvements on Lot #1 fronting on Jefterson be not required, as the developer felt that he should not be penalized because of this one lot, and that the developer was willing to dedicate 3 feet on Jefferson for street improvements. Mr. Whitaall stated that it is now the prevalent practice that the subdivider be required to improve the street where a lot faces on a thoroughtare, but that the area should be taken intc consideration. That lots facing on thoroughfares where you are confronted with +.he possibility of having to go under the 1911 Act or some asseasad twice if the subdivider was required to improve tbe street when he puts other improvement act to have the remainder of the street paved, would be in the subdivision, and that he felt that the C.ommission should carefully consider these streets when makfng such requirement of the subdivider. Mr. Whitnall also suggestad that instead of dedicating a one foot buffer strip that it be deeded 'direct to the City, and instead of using a metes and bounds description of this strip to refer to it aa "Lot A". That all buildings in thin .sabdivision shall cormact to the Carlsbad Mutual Water Company system, or its successor. 9. That .acwer and water Unea shall not be laid in the same trench in any part of the subdivision. IO. That proper draiaage shall be maintained throughout the subdivision so as to prevent ponding and/or storage of water. 11. That the three (3) feet on the westerly edge of Lot 1, as shown on the revised map, be dedicated to the City for street purposes. 12. That a concrete cross gutter shall be provided at the intersection of Jefferson Street and Bucna Place in accordance with improvcment plans approved by the City Engineor. -2 " 13. That all lots shall be graded to avoid pooling or ponding of drainage water. 14. That along the most westerly 382.50 feet of proposed Buena Place that the City accept a right-of-way for street purposes of a width of 49 feet. 15. That the Sobdivider shall deed to the City of Carlsbad a strip of land one (1) foot in width along the northerly boundary of the proposed Buena Place, extending from the intersection'of Jefferson Street and Buena Place in an easterly direction for a distance of 382.50 feet. Seconded by Comm. Jarvie. All ayes, motion carried. The meeting was adjourned for a short recess and reconvened at 9:06 P.M. COMMITTEE REPORT - CROSS STREET FROM STATE STREET TO MADISON. the commission giving their recommendations in reference to a cross street from A report wad submitted by the Committbe appointed by Chairman Baamgartncr Po State Street through to Madison Street., The Committee made the 'following recom- mendationm 1 a That a normal apecifiaation street, from State to Madison Street., through Lots 28 and 38 of Seaside Lands, at right angles with State Street, and along the Northerly boundary of Lot 28, thenct curving, or angling if reqoired, southerly through Lot 30 to Madison Street. The reasons for this recommendation are as follows: 1. Street clrculatirm is currently needed between Grand and Laguna Avenues th6 greatly increased traffic from Roosevelt to Madison Streets, and North of for current business interest, and ,safety to the public, along State Street: and for Grand Avenue, because of recently added C-2 Zoning in that area. 1684 feet on Roosevelt Street; the proposed atreet wodd be re'latively 612 feet 2. From Grand Aoe. North to Laguna fa 1856 feet on State Street; and there would remain about 1300 feet on State Street, which could then be served north of Grand. Should later development in the area require another cross street, with a cross street, particularly from State to Roosevelt Street. The Committee further recommended that C-2 zoning should be extended north one hundred feet north of the north line of the above proposed new street. from State to Roosevelt Street;, and that the City acquire title to 20 foot alley midway between State and Roosevelt Streets from existing alley north of Grand Avenue to the above newly proposed street. After considerable discussion it was moved by Comm. %ringer and seconded by Comm. Fennel that the recommendation from the Committee fop a cross street from State Street through to Madison Street be accepted by the Planning Commie- sion. All ayes, motion carried. Comm, Fennel moved that the Secretary be instructed to submit this recommendation jointly to the City Traffic Committee and to the City Council as a Capital Outlay project, Seconded by Comm. Yourell. All ayes, motion carried. -3 - DEDICATION OF STREET - RICHARDSON PROPERTY. An offer of dedication for street purposes of 30 f was presented to the Commission. Swirsky moved that a report be sub- mitted to the City Council stating that the Commission has considered the location of the proposed dedicated street and wishes to report to the Council that the pro- dedication is over one-half of the right-of-way necessary for street purposes posed dedication is a natural extention of Adams Street, and that the proposed that the Commission also wishes to call to the attention o€ the City Council the and does not conflict with any street plans approved by the Planning Commission; policy established by the City Council in reference to improvements on streets offered for public dedication. Seconded by Cornm. Fennel. All ayes, motion carried. Mr I Whitnall sagga8bd that appropriate steps be taken directing the Engiaeering Department to ascertain where such uneertaiaty exists in streets, and that formal action be taken to have these streets dedicated. Mr. Whitnau stated that he wished to work more with tbe Commission and 'give them .suggestions as to how the ordfnmcos are applicable, and that he would submit more forms for the administrative use and for the Commission's use.
