MINUTES OF REGULAR MEETING OF CARLSBAD PLANNING COMMISSION September 24, 1957 1- The meeting was called to order at 7:35 P.M. by Chairman Baumgartner. Present besides the Chairman were Commissioners Fennel, Jarvie, Swirsky. Absent Secretary Ew;%ld, Planning Consultant Kalicka and Commissioner Stringer and Engelmann; City Engineer Kubota ading as Secretary Pro Tem. Yourell. \ 2- Comm, Fennel Moved that the Minater of September 10, 1957 be approved as submitted. Seconded by Comm. Engelmann. All ayes, motion carried. 37 Traffic Committee report on cross street from State to Madison. Report dated September 17, 1957 From - Traffic Safety Committee Subject .. Croes street - State Street to Madison Street north of Grand Avenue Thi.s committee has reviews the report of the Planning Commission and inspected the proposed route of the cross street. The following comments and recommendations are offered for consideration: 1. The proposed cross street will not create adverse traffic conditions along State Street, Roosevelt Street, or Madison Street. Because of the commercial area to be served, "No Parking" in the street would be necessary to maintain adequa::e capacity. 2. Considwing the need for this new street to provide for circulation between Roosevelt and State Streets, the locatioa is not compatibls with purpose of eliminating TJ-turn" at Cedar Street. Since the proposed street is that mtrtorists will continue their practice of making 700 feet north of Grand Avenue, the committee believes W-tur:1" on State Street. 3. In view of the appraisal of Item 2, we recommend that to Gra,nd Avenue to eliminate the current hazardous consileration be given to the location of a street closer practice of “Ueturn“ on State Street. (Signed) Traffic Safety Committee 4- Master Park Plan. Comm. Fennel stated that he would be required to abstain from discussion and voting because of personal interests. Comm. Swirsky Plan, and that Comm:. Stringer was absent at the second hearing, and Comm. stated that he was absent when the first hearing was held OR the Master Park unable to take any action at this time on the Master Park Plan. HUFFMAN, 35i Tamarack. stated that he had been in the rabhit business since 1936 and wondwed about his sihation, Comm, Swirsky pointed out that there were two types of nonconforming uses part from the ordinance. He further stated that it depends upon the type - nonconforming use of land and nonconforming structures. He read that of structure as to the time of abatement. MRS, SHAFFER, 39!55 Highland Drive, stated that they owned approximately 1 1/2 acres up on Highland Drive, and that they had ducks and chickens on the property and that there had never been any complaints from the neighbors. She asked that if the C.ommission did not act on nonconforming use of land who did. 5he felt thai the ordinance was not made clear at the time of the adoption of the ordinance; that pets were necessary foe children. Chairmain Baumgartner informed the audience that until such time as some- one complainted that it was not the intention of the Planning Commission to start any abatements, That it was not the intention of the Commission when the ordinance was passed that everybody was to get rid of their checkens and ducks a MR. Chairman Baumgartner suggested that the committee be composed of Mr. McClellan, City Engineer, Kay Kalicka, Comm. Swirsky and Stringer, and Secretary Ewald. Comm. Swirsky was appointed Chairman of this committee. which involved property of the Belladonna Estates tentative map. Mr. Metcalf The City Engineer presented a lot split that had been requested by Mr. Metcalf, willing to provide improvements for curbing, because of the fact that if he requested a Lot split 3n the coyper lot of the property, and stated that he was built a house on the property adjoining the subdivision and sold it that he would lose control of it and therefore would detract from the subdivision at such time as he was able to complete the subdivision, After considerable discussion Comm. A memorandum from the Cfty Manager was read where in he stated that a request had been macle to the Council for a change of name of Terramar Drive to Cannon Road as these streets were conflicting. and that the Council had recommended that the matter be turned over to the Planning Commission. Comm. Swirsky moved that the Commission recommend that no action be taken until such time as the City acquires a public right-of-way between All ayes, motion carried. Terramar Drive and Cannon Xoad. Seconded by Comm. Engelmann, RESOLUTION OF INTENTION #l. Xesolution of Intention #1 was presented to the Cornmission. directing the Secretary of the Planning Commission to advertise for a zone change from zone R-1 to Zone R-2 the area bounded on the North by Chestnut Ave., on the West by Roosevelt Street, on the Southwest and West by Magnolia Ave., and bounded on the east by the westerly right-of-way of U. S. Highway 101; and declaring findings of fact which require the Planning Commission to adopt this Resolution of Intention. the hearing be set for November 12. 1957 at 7:30 P.M. Seconded by Comm. Comm. Swirsky moved that Resolution of Intention tl be adopted, and that Stringer. All ayes, Resolution of Intention No. 1 adopted. Comm. Yourell absent. In reference to the ahatement of fowl and animals, Chairman Baumgartner stated that he did not feel that the administrative staff should be digging up matters that are of no concern to the Planning Commission, and that until such time as there io a complaint that no action should be taken. -4- a Comm. Swirsky requested that the matter of the abatement of nonconform- ing use of a building owned by L. L. Chase, which had been requested by Mr. Kurner, be put on the next agenda. Comm.
