HomeMy WebLinkAbout1957-11-26; Planning Commission; MinutesMINUTES OF REGULAR MEETING OF CARLSBAD PLANNING COMMISSION November 26. 1957 1- The meeting was called to order at 7:35 P.M. by Chairman Baum- gartner. Present besides the Chairman were Commissioners Fennel, Jarvie, Yourell. Swirsky and Stringer; City Manager Nelson, City Engineer Kubota and Planning Consultant Gordon Whitnall. Absent, Commissioner Engelmann. 2- 3- 4- It was noted that the name Van Buskirk had been mispelled, Comm. Stringer moved that the minutes of November 12, 1957 be approved as submitted. Seconded by Comm. Yourell. A11 ayes, motion carried. Continuation of hearing on Chase-Ebright Land Use Problem. The matter of the abatement of the buildlng was reviewed again. Mr, Whitnall stated that he had seen the building and that it was a storage building and should be abated according to the type or class of build- ing it is regardless of the building permit. MR. Stringer stated that at the time they had made their recommendation and it was sent to the Council. and they in turn had overruled their recommendation, and therefore. he moved that the Commission accept and recognize the City Attorney's recommendation as to the procedure of the abatement and that the matter be sent to the Council for their ruling. Mr. Whitnall stated that it was true that the Commission had received an opinion from the to the abatement of this building and thit they should take into consid- City Attoraey, but the Commission has a duty to perform in regards eration all of the factors. Comm. Stringer's motion was lost for lack of a second. The City Manager informed the Commission that he and Mr. Wtitnall had been unable to meet with the City Attorney in order to discuss this Matter. as the City Attorney was out of town. It was mutually agreed by the Commission that the matter be continued to the next me.e%ing in order that the City Manager, City Attorney and the Planniag Consultant could meet and discuss the matter. Comm. Swirsky asked that the building inspector report to %he Commission as to the type of building it really is. Location of Cross Street between State and Madison North of Grand Ave. fir. Mr. Whitnall stated that he did not hve a copy of the euggested 'rrailer Park Ordinance available at this time, but would try and have it available by the next meeting. Woman's Club Pro act. Mr. Whitnall informed the Commission that iTe had me &" WI some of the members of the Woman's Club that day and many factors had been discussed in regards to the design of a community building, and the women were very anxious to get this project started, Comm. Fennel asked Mr. Whitnali if he felt that it would be possible to come to any conclusion on this project before the deadline. Ms. Whitnall stated there were many factors to be considered, but that th:? only concern of the Commission would be the location of the building and whether it should be included in the Civic Center plan. It was agred that no action should be taken at this time. PROBLEM STUDIES: (a) Private streets and easements. Mr. Whitnall suggested that perqprivate street ordinance should be considered, and he would send down a sample copy of this type of ordinance. He stated that there were three ways in which access to these land locked properties could be accomplished, __ 1. Connect these parcels with a private easement in favor of the property that is going to enjoy the easement. 2. Accept a below standard outright dedication. 3. Design the new parcels so that each of the parcels in the rear havr? a sub-standard frontage on the street. MR. DEWlEY McCLELLAN was present and stated that he was in- terested ia. this matter; Mr. Kelly has approximately 10 acres which is located ,approximately 900' from a street. but this property had a private eanemeut. and they were trying to work out some solution so tht this parcel of land could be utilized. He felt that some study should Kelly's and others in the vicinity could be made use of, as it would be made of prim,te streets and easement so that parcels such as Mr, certainly be impossible fot an owner to have to dedicate and improve a street fo:: such a distance. Mr. Whitnall suggested that if there were several parcels of land in the area with this problem that the Commission should give the matter serious study and take immediate action. It was agreed that the matter be continued until the next meeting for further study. (b) Poultry and Animal Abatement. ' The Secretary was asked if he had run into any difficulty with this abatement since it had become effective. Mr. Ewald informed the Commission that he had received a few complaints and a form tetter had been sent to the property owners. (c) Pre-zoning of perimeter land around the City. Mr. Whitnall pres-a proposed amendment tor preaoning of perimeter land around the City, and suggested the Commission give some considera- tion to this proposed ordinance. (d) Lot S lits. Mr. Whitnall stated that lot splits have caused con- sidera -"%T e 1 aculty because of the State Subdivision Law not being made clear. A proposed amendment to the Subdivision Ordinance was read to the Commission. and it was suggested that the Commission give this matter some consideration. explainedtheiruse (e) New'Forms. Mr. Whitnall presented several new forms and (r) Check Lists. A form of a check list was presented to the Commission whic--prepared by the firm of Gordon Whitnalt and Associates and it was explained that a check list is very important in making out all applications. shorTEiG. Refrzrral by the Chairman on certain matters. 3. Roll Call Vote not necessary in all instances. 5. Complete staff reports. 6. Adhere to agenda items only. The Chairman asked the Planning Consultant how large shoulri a City be before a full time planner could be employed. Mr. Whitnall stated that the si.se of the City is not the determining factor, but the need. Mr. Whitnall stated that the architect had contacted. him and that they were no longer interested in the reclassification of the property, but only in the vacation of the streets. He suggested that Mr. Nielson be notified that the matter would come up at the next meeting. Precise Plan - Pi0 Pico. Mr. Nelson suggested that the property owners should be notified and perhaps another meeting held to explain more fully the requirements under a precise plan. Chairman Baumgartner announced that this was Mr. Yourell’s last meeting as a member of the Commission, ad on behalf of the Com- mission he wished to extend their thanks and pleasure in having him as a member of the Commission, Mr. Yourell stated that he had certainly enjoyed working with all of the members; he felt the Commission had accomplished a great deal in the past few months and in future plan- ning they should consider plans for at least 20 years ahead.
