HomeMy WebLinkAbout1958-02-11; Planning Commission; Minutes- t * MINUTES OF REGULAR MEETING OF CARLSBAD CITY PLANNING COMMISSION February 11. 1958 1- The meeting was called to order at 7:35 P.M. by Chairman Baumgartner, Present besider the Chairman were Comrnisaioners Fennel, Jarvie, Swirsky, Stringer, Ebright and Engelmann; City Manager Nelson, City Engineer Kubota and Secretary EwaIdb 2- Comm. Fennel moved that the minutes of January 28, 1958 and February 3, 1958 be approved as aubmittad. Seconded by Comm. Jarvie. All ayes, motion carried. 3- HEARING - Variance - Lot split with reduction in lot width - Culver Nichols. Rotice of Public maring was ruau, to consider an application for reduction in street frontage an one lot from 60° to 18' on property located on the north made by F. Culver Nichols. side of Foreat Ave. between Highland and Olive hive, said application being Letter dated February 11, 1558 from Russell Grosse stating that the Nicholr application bears hir signature as being in agreement with the proposed change. they were concernod over the possible future effect. Notice of pubric &earin$was read to consider an application for reclassification from Zona R-A to Zone "M" of property situated on the east side of the Sanh E% Railroad at the southerly boundary of Carlsbad and known as a portion of "South Carlsbad Annaxltion No. 1.1" and all of'South Carlsbad Annexation No. le2;' consisting of approximately 65 acres, said request being made by Carlsbad Industrial Development. Comm. Ebright asked to abstain from all discussion aud voting in this matter.. MR. DEWEY McCLELLAN, was present and presented a letter from the Couw of San Diego. Public Works Department, enclosing a rough sketch of the Traffic had made no application for prezoning because of making application for pattern of the proposed airport. Mr. McClellan informed the Commission they annuration under two steps; the purpose of acquiring this site was to give mote light industrial area to the City; there is accesa to the property by a road, said road being by prescriptive right and not by easement; that the change in the freeway would go through this property; and that a road from the airport through Encino Camyon to the treeway is being considered by the County. Mr. McC1ell.n wan asked if any of the surrounding property owners had been contacted in relation to this matter, and if they had made any engineering plans for this area. Mr. McClellan informed the Commission that he had contacted time; and Mrs.',.Skylar did not want any change. Ebright abstaining. Comm. Swirsky requested that Mr. Whitnall submit to the Commission the problemr that the Commission are confronted with in relation to this Industrial next study meeting. Mr. McClellan asked that the Commission study some Zoning, and that a copy be sent to all members of tu Commission for their of the requirements of the Industrial coordinating Committee. 5- HEARING - Master Civic Center Plan P Second baring: The Chairman asked &e City Manager to comment on the purposo ,of the hearing and what had transpired. Mre Nelson stated that th. Council at their last meeting had authorized the services of Mr. Hatch as architect to prepare preliminary plans for the Civic area bounded on the West by Pi0 Pic0 Drive, on the North by Laguna Drive, Center; the site thnt had been recommended by the Planning Consultant was the the East by Elmwood Avenue an8 the South by Elm Avenue. He further stated that the discussion should revolve around the site and the types of buildings that should be included in the Civic Center. Some cities have included other mental agencies that perhap8 a larger site should be considered. governmental agencies in their plans. The reason they stated that in their report they had specifically recommended this site, but had recornmended thie site was that it was the most strategic site in the City; it was available to all directions. Seven ayes. motion carried. 6- HEARING P Amendment to Ordinance No. 9060. ResoJsltion of Intention of he City Council was road. WhQretn they proposed a change in the required vote of the Council to overrule the Piannine Commission. Comm. Swirsky ordinance the Phming Commission had. been overruled by a 3 to 2 vote, and stated that he had given this matter considerable thought; that under the old that it should be a four man vote of the Council to overrule the Commission$ when the new ordinance was adopted it was the feeling of the Commissioners because o€ the absence of one of the Councilmen it had placed a burden on th -3- A that would place a burden upon the Council. After considerable discussion Council, and in his opinion there should be no restriction in the ordinance by the Commissionurs. and there being no written or oral comments, Comm. Swirsky moved that the Commission recommend to the City Council that the ordinance be amended in accordance with the Resolution of Intention. Seconded by Comm. Ebriglat. Seven apes, motion carried. 7- Street Vacation r st - Mrs. C. H. Wilson. Fennel, Ehgelmam and Jarvie and reqwsted that they report to the Commission at the next meeting. 8- Memo from City Council re: meet Improvement widtbs on Hillsidesd 1 emoran um rom ouncil had requested that the Commission take under consideration street improvement widths on hillside property. Mr. Whitnall was asked his opinion in relation to this matter., He informed the Commission of the procedure in various cities throughout the United States and the reasons that street widths on hillside properties were narrowed. By common consent it was agreed that this matter be taken up at one of their study meetings. Memo from City Council re: Ehtrance Gates, Memorandum from tbt City council was reviewed by the Commisston. and by common conamt it was agreed that this ma.ttter be taken up at OM- of their study meetings. 9- Street Vacation - W. D. Cannon. Letter dated February 8, 1958 from W. D. by him for the vacation of a certain parcel of land situated on Shore Drive in cannon was read stating that ne wished to revoke a request previously made Carlsbad, and trusted that immediate and appropriate action would be given this revocation. The Commission asked that the letter be filed with the request. IO- Pi0 Pic0 Rezone Report. The Chairman informed the Commission that the original applicant tor ahe rawne of Pi0 Pic0 Drive had asked that their requeat for tbe rezone of Pi0 Pic0 hive be withdrawn. and that he had requested the they wished the request withdrawn. The Secretary stated that he had contacted Secretary to contact the other parties who had signed the petition to see if seven of the partiee and they were not in favor of the rezone at this time because drawn. Comm. Swirsky moved that a memorandum be sent to the City Council of the restrictions imposed by the precise plan and desired the request with- stating that the original applicant had requested that the zone change be dropped, - -4- a the supporting applicants did not wish to go ahead with the zone change, and the matter be dropped. Seconded by Comm. Ebright. All ayws, motion carried. 11- Newman Request for Ambulance Service location continued. A report was Also attached was a suggested amendment to Ordinance No. 9060, wherein read from Gordon Whitnall regarding ambulance service Grelation to sodq. ambulance service would be included under conditional use permits. It was suggested that if ambulance service was to be included under conditional us8 permits that it be designated in certain zones. Comm. Swirsky stated that he did not feel that any zone should be designated as the City would have control of this when the application was made. It was also suggested that mortuaries come under the conditional use permits After considerable discussion Comm. Stringer moved that Resolution No. 54 be ado@cad recommending an amendment to Section 14 o€ Ordinance No, 9060 by adding a new item (1 5) Ambulance Service, and item (7.5) Mortuaries; and deleting Section 800 of Ordinance No. 9060. Seconded by Comm. Jatvie. Four ayes, 3 noes. The motion was lost for lack of a majority. By proper motion the meeting was adjourned at 11~00 P.Mo Respectfully submitted. ”- -5-
