The meeting was called to order at 7:30 porno by Chdrman Stringer, Present besides the Chairman were Conlrnissioners Zahler, Nard, Thomas and Jarvie, Absent Corn-ds-

Minutes of September 8, 1952, It was moved by Come Jarvie and seconded by Comrcl, Thomas that the minutes of Septeuber 8, 1959 be approved as subnitted, 5 ayes, motion carried,

a, The Secretary read a memorandum from the City Council requesting the Planning Commission to consider and make recanmendations regarding an attached letter from John H, Grant, dated September 11, 1959, which requested use of a
200 strip of city property located at 200 Oak Street, The Secretary then sub, mitted a plat of the property to the Col.unission for their review and stated that there was a slight deviation from the plans submitted by Mr, Grant, in that his plan showed the properiy in question to be a true rectangle, but that one corner
was cut off by Carlsbad Blvd.; that when the curbs were installed along Lincoln, the curb returns only were installed on Oak which had been set for a 40* pavement;
that off street parking requirements are set forth in Article 15 of Ordinance
9060, and in making raaomnlendations to the Council, the Comiission should consider
the possibility that, should they' recormend granting this request, they might be
setting a precedent whereby dedicated streets would be substituted for off street parking, thereby offsetting the purpose an3 intention of the Ordinance providing for off street parking,.
MR, GRANT stated that his architect was a Mr, Scheunemann who was connected with Kanptner and Holly; that the architect had stated that there was sufficient area
on his own property to comply with the off street parking requirement for the businekes he is buildjng; that he is planning a beautiful installation and one
that is needed on the west side of the railroad tracks; that to have a 20p strip of dirt between the curb and his improved property would be a disservice to his property and improven1er;ts; that he was not asking for a vacation of the land, but just its use; that he planned to kaprove the land and he would give it up if the City needed if, again; that Oak St, had never been improved so he thought his request should be considered in terms of an improvement

would like for everything possible be done to help Ih-o Grant, he was not in favor of turning city property over to an individual; that he saw no reason why the curb could not be brought back to the sidewalk which would give him
room for angle parking on the street and supply more parking space than what he planned,
Mt, GRANT asked the Secretary if he knew what the thinking of the City was when
the curb return was instdled leaving 20' between his property and the curb,
The Secratary stated that the idea had been for 40* of paving on Oak St, leaving
20° of parkway between the sidewalk and street,
The Chairman stated that the curb had been installed soon after the city was
incorporated because o.f a draina,ge problem, which was before any street widths were set up on the master plan; that if this 20' were given away on the south
si& of the street, the party on the north side would have the same right which
would cut i)ak St, down to 40°; that sinil.ar requests on other streets in that area had been disappro-red; that Carlsbad is fortunate in having these wide streets,
and because of its pro:&d.ty to the beach it should be developed to its full width which would allow for ;=&.e parking; and that 50,% more cars can be parked by angle parking than by ;mrallel parking which would be necessary if the street were narrow ,
Considerable discussion was given this matter by the Corundssion during which Coma, Lahler pointed oxt that 14ro Grant had asked permission to install a curb in line with that already established by the city; Commissioners Ward and Jarvie
stated they would like to study the matter further and look at the property
before coming to any decision,
I.%. GRANT stated that 5 large companies had signed leases for the buildings; that another disappoin'xnent he had met with was that a 10* set back was required at the rear; and that his plans called for an inprovement on city property that
he would pay for himself
Further discussion was given this matter by the Comnission, during which set
back requirements were explained as well as the fact that all improvements
were paid for by the property owners; and that if the curb was installed 20p
from the property line and the city wanted the use of this property at a later date, there would be the extra expense of tearing the curb out in order to set it back, It was then iloved 'by Coma. Zahlcr and seconded by Corn, Jarvie that

After further discussim, Coma, Zahlar withdrew his motion, with the approval of the second, and then made a motion that a recomaendation be forwarded to the

southerly side of Oak Street, between Carlsbad Blvd, and Lincoln St,, contiguous

b, The Secretary read a letter from the Division of Highways, District XI,
dated September lbO 1959, regarding a public meeting to discuss the development of State Sign Route 78 to full free-my standards from US, 101 in Oceanside to
Nelrose Ave. near Vista, the meeting to be in the Oceanside City Council Chambers
on Thursday, October If;, 1959, at 1O:OO acmo The Secretary then stated that the City Zngineer and City Attorney had been instructed to attend the lneeting.
During the discussion cm this matter, it was brought out that Carlsbades main concern with this freemq would be the interchange at; i31 Camino Real and the possible relocation oi" Buena Vista Creek. The Chairman appointed Somr~, Yard to follow throu& on tkis matter and attend the meting, and asked the Secretary

others could attend if possible,

a, Prouosed Industrial Tract. Some discussion was given to the rezoning
of the proposed industrial tract, bounded on the north by Chestnut Ave., on
the east by Roosevelt Sto, on the west by the railroad tracks, and extending in
a southerly direction 4;oward Tamarack Ave, The Chairman stated that he had
attended an industrial meuting of the Chamber of Commerce and that the Executive
Committee of the Chamber of Cormerce was requested to look into the matter, take recomaendations to the General 3oard, go on record as approving or disapproving the rezoning of this ama, and write a letter to the Planning Comnission stating their findings,

c, Tentative Subdivision I-iaps. After a discussion of the procedure for
considering tentative :;ubdivision maps, the Chairman appointed Corn, Jarvie to
act as Chairman of a Subdivision Investigation Cornnittee, The Secretary was
instructed to advise COIIV;I, Jarvie of the receipt of tentative subdivision nlaps,
and Corn, Jarvie was instructed to then &e an appointment with the City Engineer, the subdivider, and as nay other Comlissioners as mi&t be able to attend, to make a physical examination of the property involved,
