Present besides the Chairman were Commissioners Davis, Neiswender , Jarvie and Ward. Absent, Commissioners H@hes and Kistler. Approval of Minutes of February 27, 1962, A motion was made by Commissioner jarvie and seconded by Commissioner Ndswender that the minutes of February 27, 1962 be approved as corrected. All ayes, motion carried, Written Communications: " There were no written communications. Oral Communications: There were no oral communications. CONTINUATION - HEARING - Request of Eugene L. Geil for zone reclassification from R-1 to C-1. The Secretary refiorted that he had spoken to Mr. Geii that morning and Mr. Geil asked this application be withdrawn. ISAAC DON LEVINE, 1250 Chinquapin Ave. , stated he bought 3 3/4 acres of land at 1250 Chinquapin with a view of permanent residency and has spent much money improving this property. He did not know until he read the evening paper that property below his is property for commercial purposes. He came from southern Maryland where he owns considerable tobacco property, and that he had bought in Carlsbad with a view of picking a quiet residential are8 and not a place which in time will become industrial. He was led to believe Carlsbad would be another La Jolla. Mr. Levine stated he wished to go on record as being very much opposed to commercial zoning on Pi0 Pic0 and Tamarack when there seems to be no need for it. Chairman Grant explained the previous hearings that were held on this matter by the Ptanning Commission and of the final decision made by the City Council. HEARING - VARIANCE - Request of Allan K. and Donna €3. MacDougaU for a reduction in required side yard setback from 9' to 7' on property located on the south side of Chinquapin Avenue between flighland Drive and Adams Street, being portion ofct 243, Thum Lands, Map 1681, anrprtion of parcel 2, Book 206, Page 062, Assessor's Map- ]Diego County. "-- - Notice of hearing was read. The Secretary certified as to publication of notice of hearing and the mailing of notices to property owners in the area. The Secretary then read the application setting forth the reasons for requesting the variance. There was no correspondence or oral communications on this matter. There were no objections to the request4 ALLAN MacDOUGALL, 402i Highland Drive stated that the wall or foundation for his home had been set at 7 feet, and after realiziztg it should have been 9 feet because of the 90 feist width he had applied for a variance. His house is planned to be 2200 square feet not including the garage, and he owns the property adjacent to this lot. There is a house of similar square footage planned to be built across the street. Building Inspector Dick Osburn stated that the land was graded and the wall was put in as a retaining wall which was reinforced. The wall is going to be utilized as a foundation for this home. Chairman Grant stated he had inspected the property and although he did not condone this procedure, he felt that 7 feet is enough setback for this property. The public hearing was closed at 7:49 P. M. It was agreed that this request should be granted for the following reasons: 1. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 2, That the granting of such variance will not adversely affect the comprehen- sive general plan. The following resolution was presented for conaideration: Resolution No. 239. A RESOLUTION OF THE CARLSBAD CITY PLANNING -ON GRAmING A VARIANCE ON PROPERTY LEGALLY DESCRIBED AS PORTION OF TRACT 243, THUM LANDS, MAP 1681, AND PORTION OF PARCEL 2, BOOK 206, PAGE 062, ASSESSOR'IS MAP OF SAN DIEGO COUNTY, was uanimously adopted on Commissioner Jarvie's motion, seconded by Commissioner Ward. Old Business. "PanHandles. 'I The Secretary reported that he had written to most of the cities in the county where they have this condition, The Secretary read a letter from the Assistant Planner, Lawrence M. Bagley, of the City of Oceanside stating the Planning Commission has established a policy governing such panhandles. Letter from the City of San Diego stated that "panhandle" lots are generally prohibited. After studying them, they usually try to discourage them, except under certain circumstances they do allow them. Chula Vista considers each case on its own merits and-whether there are circumstances which deem this necessary. El Cajon did not allow them until about a year ago, and they do now only when certain conditions exist. " 3 " The Secretary reported that he talked to Grant Burns, Planning Director of the City of La Mesa and they have an ordinance with provisions set out similar to El Cajon's. Each case is considered on individual merits. There was a discussion regarding the size and width of the "panhandle" and the remaining lot area. The Secretary was requested to prepare a statement of policy for the Planning Commission's consideration. Provisions are to be that each case is to be handled as individual request for variance; that the zoning requirements for minimum lot size is to exclude the panhandle portion; that the panhandle portion is not to exceed 150 feet in length; has to occupy a minimum 20 feet width street frontage, preferabl: 40 feet. The statement is also to read that in general, such lot splits are deemed undesirable. Commissioner Jarvie stated there should have been more discussion and study on the Tamarack extension before the hearing was held, with the people affected. The committeee of the Council talked about making this street a secondary street and are studying this matter. Commissioner Grant stated he did not think that talking with the people would have he1 ed. to bring out any illuminated information which would not be disclosed at the pubpic hearing. There was a discussion regarding the remodeling of the City Hall Annex. Commissioner Jarvie stated that about four years ago an architect worked on plans for the property at the Civic Center and he feels thzt a new hall should be built for public hearings. New Business. The Secretary caLled attention to Sections 65549 and 65550, Title 7, Chapter 3, Article 9, of the Conservation, Planning and Zoning Act of the State of California; under provision in the State Codes Statutes making mandatory the submission of a public works program for the corning fiscal year with improvements that are going to be made by the departments, to the Planning Commission, 90 days before the expiration of the current fiscal year. This is to establish priority of works and channelize work and efforts in a pre-planned manner. After discussion, upon motion by Commissioner Ward, seconded by Commissioner Davis, it was unanimously agreed that the Secretary write a memorandum to the City, Council regarding this matter. Terramar Drive (commonly known as Cannon Road). The Secretary stated that he does not feel that proper studies have been given to the precise planning of Terramar l%ve as a major street; that part of the road is in the county outside of the City. After discussion by the Commission, Toby Thornton, Assistant City Engineer stated that present state plans are for the new freeway to intersect the old approxi- mately 1500 feet south of Terramar Drive. Chairman Grant asked if precise plan off and on ramps have been requested of the State Highway. . * 1 L -4 - Mr. Thornton stated that the State is against it at the present time because of the new freeway interchanges to the south which would conflict with the northbound dowr. ramp. The dedicated portion of Terramar Drive stops at El Arbol Drive. It was reported that Mr. Paul Ecke and Mr. W. D. Cannon have expressed a desire to d0nat.e the necessary right of way from the easterly terminus of Terramar Drive through the Cannon overpass on U. S. Freeway 101, provided that on and off ramps are constructed at the Cannon overpass. Chairman Grant stated that although the land east of the railroad is currently under cultivation and entirely undeveloped is no reason not to precise plan it now, and the State should be advised of the City's intention in order that an interchange can be considered at this point. Future development to the south from Leucadia, north and to the east, with industry around Palomar airport would create an undoubted need for such a thoroughfare. Commissioner Neiswender stated that he doubted very much that there would ever be sufficient traffic in that area to warrant making a major thoroughfare of Terramar Drive,west of the freeway. After further discussion by the Commission, upon motion by Commissioner Ward, seconded by Chairman Grant that the Planning Commission request the City Council to direct the Engineering Department to prepare a precise pian for the extension of Terramar Drive easterly to EL Camino Real as shown on the Master Street Plan. Four ayes, one abstention, motion carried. Report from the Committee on the study of commercial zoning on Roosevelt. Commissioner Ward re,ported that Commissioner Kghes and he had discussed this matter and it is their opinion t&t thty should wait until the Senior Citizens Village is further developed before zoning this area from R-4? to Commercial. Mr. Osburn stated that the Senior Citizens Village is acheduled to be finished in September. It was agreed that this subject should be brought up again in six months. The Secretary reported that Chairman Grant and he had attended the San Diego County Planning Congress meeting in San Diego. There are four meetings planned for the year; the first one is scheduled for April 12, 1962 in the evening. The Irvine Plan will be in December.
