HomeMy WebLinkAbout1962-05-29; Planning Commission; MinutesMINUTES OF THE ADJOURNED MEETING OF THE CARLSBAD CITY PLANNING COMMISSION May 29, 1962 The meeting was called to order at ?:30 P.M. , by Chairman Grant. Also present were Commissioners Ward, Ewald, Palmer, Jarvie and Sonneman. Commissioner Davis was absent. The Commission was having an adjourned meeting so the City Engineer could work something out with the property owners involved adjacent to the proposed Holiday Manor Subdivision who felt that they might be landlocked if Valley Street was not extended. The Secretary reported that he had had no further correspondence regarding this ' subdivision, but that the adjacent property owners had been in the office and discussc this on numerous occasions and on Monday night they had met in the City Engineer's office for three hours. The City Engineer, Lowell A. Rathbun, explained on a map how the subdivision ties in with the surrounding property, and reported that the following had met in his office the night before on May 28, 1962: Harry B. Vollmer, 3990 Highland Drive Mrs. R. L. Mathers, 4117 Park Drive K . Robirds, 3980 Highland Drive Mrs. Morris L. Sims , 4 157 Park Drive George W. Haylings, 4025 Park Drive L. M. Miller, 4055 Park Drive R. L. Mathers, 41 17 Park Drive H. E. Anderson, 4000 Highland Drive Mrs. Alma Haylings, 4025 Park Drive A. T. Howard-Jones, 3985 Park Drive Sydney Ballard, 4075 Park Drive Mr. Rathbun stated that they had discussed the problems of the subdivision and at the outcome of the meeting no resolution was presented by the group against this subdivision. MR. L. M. MILLER, 4055 Park Drive stated that it had been a very good informatie. meeting of what could be done in the future to lay this out in broader scale. There was not much opposition against the plans of the subdivision, but it was pretty hard to make a vote in such a short time. He did not know what the City would do in re- gard,s to easements, etc. As far as Holiday Manor is concerned, it should go as is and the subdivider should get together with the people in the future for future sub- divisions near there. He stated that the engineers and all have been very cooperative. and that he had only expected information the night before and had learned some things that he did not know before. MORRIS SIMS, 41 57 Park Drive stated that he thinks the City is missing a good bet in not having a through street instead of a cul-de-sac. He knows that Kamar Con-:. struction Company is going to subdivide below this property in the near future. He feels sure the City is not going to landlock anybody as the Planning Commission is too smart for that. -_ -2- along the property line Commissioner Sonneman inquired as to what the grade is going to be/where the cul-de-sac ends and if there will be a bank there. The City Engineer stated that they did not know at this time what it will be. ROY KLEMA stated that from the developers standpoint it involved getting a lot of people in a street plan pattern; the contours will govern the drain and sewers; this lot looks like it will be approximately the height of the street. They will give particular attention to the grading as the FHA is very particular and also the City of Carlsbad, but it is almost impossible to say at this tentative map stage. MR. MILLER thanked Mrs. Sonneman for bringing this subject up because if there is too much of a bank it would be a problem. The City Engineer stated that he has wanted for a long time to have the Commission consider this problem and get this solved. Under present ordinances the property owner can make his own fill and the engineering department has not control over it, except for flood control or property damage. The subdivider can proceed without submitting a grading plan provided the cut or fill is not in excess of 3'. Las Flores Subdivision, as an example, was done for lot sales. Any restrictions, if desired, should be well founded, and an ordinance prepared for control. The subdividers have been very cooperative. A grading plan may be required if this body wishes to consider it in conjunction with the tentative map. The grading plan is completed along with improvement plans prior to the time the final map is presented for approval. The Secretary was requested to study the grading levels and to inquire from other cities of comparative sizes what restrictions they have or ordinances on this matter. KAY KALICKA, P. 0. Box 71, registered objections to the statements made by these gentlemen. He stated that he has worked on this map for three months and Mr. Miller is getting about $5,000 benefit from the subdivision. These adjacent property owners would not have these improvements if it were not for this sub- division and he has not asked them for a dime. He stated that he is opposed to more restrictions on developers and the Commission should give thought to the subdivider intead of helping these individuals as the City is built up of odd shaped property. The Commission should foolow the recommendations of the City Engineer who knows what can be done. He does not know what the grading plan will be at this time. MR. MILLER stated that he personally has never said anythirg derogatory against Mr. Kalicka or his operations. All that they wanted was to work with him. The City Engineer stated that their recommendations on the cul-de-sac will involve a subnormal frontage at the setback line with normal width at the rear and the lots will be small. He anticipates that affected property owners will come back and want lot splits to tie in with the cul-de-sac. MR. KALICKA asked Mr. Miller if he is ready to tie in at the time when they develop and to call his office. MR. MILLER replied that he will be glad to, and thanked the Planning Commission for their ccnsideration. DR. PALMATEER 2497 Ocean stated he was not at the meeting last night but that any objections he had before to this plan have been removed by a private plan betumeri the subdivider and himself. " -3- MR. KALICKA stated that a study has been made with the map and the problem of drainage worked out between them. The cost of the drain will be approximately $25 to $30 per foot on the subdivision. Dr. Palmateer's cost will be approximately $1800. per lot alone plus street improvements and pumping station. If the arrange- ment with the Doctor goes through, the sewer pumping plant may have to be changed He asked if the Planning Commission could allow this change without coming back before them as he cannot delay the map as he has sales and deadlines to meet. Commisioner Ewald stated that if the drain is worked out, it will be good for the whole area. The secretary called attention to Item No. 10 in Resolution No. 246 regarding whether Tamarack Street is to be a major or secondary street. There was a discussion regarding 2 lanes and 4 lanes of traffic, and it was the general feling of the Commision that Tamarack should be a secondary street. The City Engineer recommended 48' curb to curb width with a 68' right of way. The secondary street would have 2 moving lanes of traffic and sidewalks with a parkway for fire hydrants and utility poles. Chestnut Street is 48' curb to curb with a 60' right of way and some of the poles are on the sidewalk and others overhang on private property. There would be City participation on the secondary street. Resolution No. 246. A RESOLUTION OF THE CARLSBAD CITY PLANNING COM -DING THE TENTATIVE SUBDIVISION MAP OF HOLIDAY MANOR IN THE CITY OF CARLSBAD, was unanimously adopted on Commissioner Sonneman's motion, seconded by Commissioner Jarvie, with the correction to item No. 10 that "major" be changed to "secondary", street with 48' curb to curb width on a 68' right of way. Commissioner Davis was absent. Commissioner Ewald stated that he was opposed to 78' on Tamarack after the hearing that was held a few months ago and asked the Engineering Department to bring back a precise plan for Tamarack for the next meeting so the Commission can study it and see when they will set a public hearing on it. He felt this would eliminate a hassle later on. The Secretary reported that the Briggs' Final Map has expired. Commissioner Ewald suggested a precise planning and grading policy for the expansion of the City. With the annexation of raw land, if a study is made in advancc it would help the staff and Commission. There was a discussion about having hearings on one night a month and a study period the other night. The Secretary reported that they had tried having public hearings on certain nights but it had not been very successful as they did not think it was fair to make the citizens wait that long for hearings. Since there are only two more meetings before July when the Commission will decide on a new Chairman, it was agreed that they wait until that time to decide on a Vice-chairman. Adjournment. By proper motion the meeting was adjourned at 8:45 P.M.
