R. Thornton, Assistant Engineer, reminded the :Commission that the City Attorney had cautioned them :against discussing a variance before a public hearing is :held. 1 I :MR. EBRIGHT stated that he would apply for a variance i :in the regular manner. : (b) The Planning Technician reported the Council had i !approved the Bird Island Development in regards to re- : ;classification with no stipulations, restrictions or coadi- i :tions. The Council had the first reading of Ordit nce No, : i9142 and 9143 on this reclassification. I I I a I I . :The reclassification to I'M" zone on a portion of East jGarlsbad Annexation 2.2 was readily accepted and they :had a first reading of the Ordinance. :The tentative map of Linda Estates Subdivision Unit No, 2 i !was approved by Re solution by the Council. !Mr. Melton commended the Engineering Department for ;preparing a Large map of the City, and explained the ;various color designations and what streets have been :adopted. !The Assistant Engineer gave a progress report of the !Engineering Deartment on different streets. He reported! :that they expect to have the precise plan by vertical and !horizontal control finished up in about a week on TamaracG :from Highland Drive to Park Drive and will then contact : ithe property owners for dedication and agreements. They i :have made no field work on Elm Avenue andhavc made no :field work on Chestnut easterly of Westhaven. They have : :a precised plan by a horizontal control on Terramar Drive: :to a point 600' easterly of the moat easterly portion of the ; ieasterlv riqht of way of the U, S. 101 Freewav. I !The Planning Technician presented written reports of a i !!'.draft It for proposed high rise ordinance to the Commis- : sion and explained several methods used in other cities. i !He stated that he is trying to encourage the "Dimensional" : :regulation €or Carlsbad. The reduction from 35' to 28' in I IR-A I R-1 and R-2 zones is similar to the Los Angelea : :Ordinance a but he felt that some designs might to ko 35' jin better homes. He stated there was a question in regard! :to the "M" zone. Some of the industries that are per - I imitted in the County are prohibited in the City Ordinance. I 1 I i FRANK DeVORE, Governmental Right of Way Agent, San i : Ditgo Gas & Electric Go. , questioned the 75' height I L !limitation in the "MI' zone. The Encinas power plant is : :approximately 120' high. He asked the Commission to :give this thought as they expect to build in the near future : ;and hoped they would not have to come to the City for a i !Conditional Use Permit as the unit is generally more than t :asked the City to give them some consideration. 4 !The Secretary pointed out that Article 14 I Section 1300 : :(25): Public Utilities, dealt with land use but not height :limitations, and required Conditional Use Permits for : :generating plants. * :Some of the Commission, felt a different zone should be 1 :explored for Public Utilities. !By common consent it was agreed the matter of height i !limitations be continued to the next meeting and Mr 4 I :Melton should bring a map of the areas to the next meeting! 75'. I I :The Planning Techniciau stated that we arc past the wait- iing period for putting things on the priority list for the : :Engineering Cepartment and hopes to bring forth an amend! : Iment to R-T zone. He hopes to bring in property that was : :dedicated for streets for the extension of Jefferson and i connecting Harbor Drive :The Chairman atated that he felt all of the property along : :the Lagoon should be zoned R -T and the Commission shout4 !initiate action to reclassify all of the land for R-T from :Hoover Street to the east end of the lagoon and they should :have actual figures on the depth of the zoning and should : :also take into consideration the terrain on the northeaster$ i side of the Lagoon. The Chairman asked for a larger map . . :of a blown up section between Adams and the water, as i :they might have a narrow street there, or one way streets: I ! He stated the City is not going to get many big hotel) ;or motels unless they can have cocktail lounges. ! The Chairman questionkd whether this amendment would i I be protective enough, and if they sliould insert "resort i !motel and resort hotel'' with no outside advertising. + iCommissioner Grant suggested a R-T-C zone. a a .. . . I I e I I I 1 I I I I I I f I The Secretary stated that he is working on an ordinance i : which would be an R -1 -4,000 sq, ft. , zone for areas along I the beach;and for marina type development in the lagoon : ;areas. The R-1-4000 sq. ft. , would prevent subdivisions i from having to have deed restrictions. The persons :placing the deed restrictions sometimes leave and the {restrictions are difficult to en&rce. :Commis)ioaer Davis stated that he felt the descriptions i iof a hotel (having 5 bedrooms} was inadequate. !ALLEN KELLY, Carisbad, stated he thought the R-T zonei !was a good one and there is always one residence that is ; :next to a public building. Bars should be required to be !placed centrally in hotels to abate noiee. Property will ; !get so high there will not be much residential areas Left. i !Commissioner Grant stated the ABC law provides that jcocktail lounges be located 200' apart. :By common consent it was agreed this matter be held over: :to the next meeting . 1 i (d) Park Drive extension to El Camino Real. i Mr . Thornton stated the alignment of Furk Drive extended i I easterly from the easterly boundary of Shelter Cove Sub- ' : : division appears to approach the shoreline through Mr. i Phipps' property. Mr. Phipps' has stated his objections $ !to this projected right of way, and the Engineering Depart? iment is endeavoring to design a curve that will be more : ; desirable for the extension of Park Drive easterly through i !the Phipps' and Kay Kalicka's and Allen Kelly's properties! :MR. KELLY stated they have a 25' easement across a i : down grade. Mr. Phipps is getting ready to fight the pro - ; ! jected right of way. If the easement follows Fark Drive, :there is only the Saestion of grading. One easement has ; ;been abandoned. Mr. Kalicka, Mr. Phipps and Mr. KeLly I i set aside this 60' for it road. I i Mr. Melton stated that El Camino REal will have to be i ;relocated when they extend the airport runway for jets or i ithey will have to tunnel under the runway. The extension : :of Terramar Road is important as it will eventually tie in i i with the new Vista Freeway. I i FRANK DeVORE pointed out on the map that the Company 3 :has an alignment and easement with Mr. Kelly. I MR. KELLY stated that he has a floating easement past i i Jay Hoffmanls property and they had each given a 30' ease+ fment where they thought it would be a good road.
