I Chairman Palmer expressed his sympathy in the passing i of Mr. Kay Kalicka. i APPROVAL OF MINUTES: : (a) Minutes of the regular meeting of July 23, 1963, i were approved as submitted. Haffner r4: : Use of private beach property signs. He asked that the : 1 signs should show the necessary data ok boundaries of the \ private beach and that the City ascertaib that such properq : lines comply with the laws re; public use of California ; beaches. Such laws are effectively enforced in Hawaii to : f include the provision that the public be provided free acceis I to beaches at regular intervals along the coastline. I 1 I I I I I I I' 8 The Commission discussed the fact that the property would : go down to the mean high tide-line . * I I 8 8 I I The City Attorney informed the Commission that this woulg have to be worked out between the property owner and per4 : sons involved as the City is not in this. They could have i a similar situation away from the beach between neighborl. : If the property on the beach is surveyed properly, they i may find that sa4is between the high tide. I I * I 8 By common consent the Commission agreed that thts letted : should be forwarded to the City Council. I I ! GENE LUEDERS, 4235.iikrison, stated that this was i brought up in Matib u Beach a few years ago, and was : "ironed out" in court. The mean high tide is the fixed i point and the property owners are not cognizant of their ; : rights. Secretary Grant certified i to the proper notification to property owners in the area, i i and then read the application. ! There was one item of correspondence dated August 7,1964, from €4. L. and Beverly Anderson, 7080 Sayre Dr. ,Oakla+d i asking if this variance would affect their property on : Tamarack Avenue. 'I I( I I I 6 I * I I I I The Planning Technician pointed out the location of their i property on the map and stated that their property was : : disassociated from the problem. I The Chairman asked for the applicant or his representativk i to speak. No one spoke. i Kay Robirds stated that he owns property adjoining this i : property and asked about the side yard setbacks and if it : would affect his property. i The Planning Technician explained the location of the : existing house which would require a reduction in side yar$ setbacks and the location of Mr. Robirds' property. 13. L. ANDERSON stated that he owns property on Tarnarakk . I I::;:* I 1 I The Planning Techhician explained that Dr. Palrnateer had; originally planned to divide the property so that the lots i i would face on Tamarack, and then it was felt it would be : 1:::;: : better to have the lots face on Highland Drive, as these i i;::;: i lcts can be sewered by the new sewer line. i The City Engineer explained that the dedication of prop=+ : for street right of way required Dr. Palmateer to ask for ; 1:;:;: i a variance in order to divide this property into four lots. i ; The lots would have been the required lot size before dedi: I cation of the property. I It was poiEted out that the small uncovered porch will be I I I I I 1 1 removed from the existing dwelling and that the side yard ; variance was necessary because of this existing dwelling. i A motion was made to grant the request for a variance fori I 1 I : Dr. Roy H. Palmateer for the following reasons: * I * I I I I 1. That the necessity for a reduction in the front widtg of the property because of Dr. Palmateer having to dedicate ; a portion of his land to the City created a situation where ; he was not able to get the same number of standard size i ; lots out of the parcel as he was before the dedication. i 2. That it would be in the best interests of public i necessity and convenience ; 3. That the granting of such variance will not adversely affect the comprehensive plan. : 4. "0 8 1:;: I::;:, : Secretary Grant read a memorandum from the Planning i Staff regarding the zoning on Falcon Hill. I The Planning Technician presented the revised maps of I i Falcon Hill and explained the zoning on the lots. Only loti ; 18 would vary. The streets have been laid out to permit +e : prescriptive easement to other property. I I , I I II I I I I I II,(lI I I I I I I 1 4 I I 0 * I The Secretary read a report from the City Engineer revised tentative map. I I RAYMOND R. RIBAL, Engineer on the Tract, stated that! I he did not object to the easement for sewer and drainage i I but did object to the pedestrian walkway over this ease4 i to police. The children have a tendency to throw rubbish : ! over fences. I I 1 JERRY ROMBOTIS, President of Kamar Construction Co it ; asked what the required width of the sidewalk on the corner would be. I I f The Planning Technician informed him it would be an in- i i side lot and would have an interior lot setback. I MR. ROMBOTIS and MR. RIBAL stated that they felt the I walkway would decrease the value of the 4 lots as people ; i would not want property where there would be noise from i i people walking by at night. 1 I i The Commission discussed the fact that it would decreas4 the value of property abutting thi s walkway but would be : i increasing the value of the other lots. They also discussCd : the walkway to the Buena Vista School. I i The City Engineer informed the Commission there would I : be underground utilities and there may be manholes but ; i they will be designed so they would not be a hsisi:ard or Ji " . i nuisance. The easement can not be used as a walkway unless . : so stipulated with the improvements put in. The walkway! : is necessary due to the length of Blenkarne Drive and woqld ! enable children to board school buses without having to i I walk so far. I I i After due consideration a motion was made recommending : approval of the revised tentative subdivision map in accoq- i dance with the City Engineer's report of August 13, 1963: ; amending his report of April 23, 1963, and that the walk: way be worked out between the City Engineer and the de- ! : veloper regarding the necessity of dedicating a pedestria4 i way and providing improvements thereon over sai.d publie ; sewerage and drainage easements connecting Blenkarne i Drive and Monroe Street approximately adjacent to the ; ; northerly line of proposed lots 61 and 86; and that items (A) and (b) of the Planning Technicians report be incorp- : : orated into the resolution in regards to zoning and lot : numbers. ; dated August 13, 1963, on his recommendations for this I I rnent as he felt it would be a nuisance and would be diffic4t I I I I I I I I I I I \ I I I I I * I I I 1 I I I I I I I 1 : Davis Resolution No. 314. The present storm I :;:::: I drain is open but they have worked out a plan where it wilC all be underground. He wished they had the adequate grac$s ::*"1 ; for storm drains in other subdivisions. The subdivider ; ::'::: : will be putting in sidewalks. ! A motion was made that the final map of Falcon Hill Unit ! H. Priqe : had resigned as Secretary that the Planning Technician ; should be a representative of the City at these meetings. : By common consent it was agreed that the Chairman meet: i with the City Manager in regards to changing the title of i : Ptanning Technician to City Planner or Planning Advisor. I i (c) The Planning Technician reported that he has been i I working on a new zoning map of the City under the 400 ft. ; : scale. He stated that Daniel, Mann, Johnson and Menden: i hall has not presented any data yet. The harbor is schedded : for consideration in September. The firm of DMJM is i i hired by the City with the approval of the San Diego Gas : : and Electric Company. : The Planning Technician stated that he had been working I with the City Attorney and Chairman Palmer on a pamph- : : let to be used as a guide to handle matters more efficientlf; I for example, procedures for conducting public hearings, ; : subdivisions, reclassifications etc. t The Commission discussed the extension of Jefferson i I Street and whether the property owners will still give : : property for right of way on Jefferson Street. It was * 1 pointed out that Mrs. Mike Lewis did not offer any land : : but some of her land was in the way of this extension. !
