J I s : The City Planner requested that the Public Hearing for i the reclassification of this property be held first, and the : : City Attorney stated that this could be done and then the Commission could consider the tentative map next. I I * { PUBLIC HEARING: n I i RECLASSIFICATION - To consider an application for i I change of zone from R-1 (One -family Residential) to R-3 ; : (Multiple-family Residential) on property lying between i : Buena Vista Circle and Jefferson Street, and northerly of ; 1 Laguna Drive, said parcel being a portion of Lot I, Sectiot i 1, T. 12 S. I R. 5 W., in the City of Carlsbad, more : particularly described as westerly 260' of Parcel 155-21- i 12; all of 155-21-13 81 16, and westerly 50' of Parcel : 155-21-15 of the San Diego County Assessor's Map. M. i The City Planner explained that the property is R-1-6 004 i eq.ft., and is landlocked so the owners have not been able; l;'4;; ; to develop it. He has been working with Mr. Means for 3 : i:::;: : months on this subdivision and the property owners on . !: 1;:;;; i Jefferson Street have not shown any interest in changing i : their zone classification. The lots in the proposed subdi- ; i vision will be in excess of the required 6,000 sq. ft. ; one I : lot will be in the center of the cul-de-sac and will be used; i as a recreation park with swimming pool fadlities which i ii;:;; I will be maintained by the owners in the subdivision. * I i MR. MEANS stated that he is in the process of purchasing ; the property and the papers have been signed and the mondy ;;::;; i is ready to go in escrow and this could be verified by check- : ing with the bank in the City of Orange. Sandy Koufax is i i one of the investors in the subdivision. Mr. Means also ; ; stated that he has 4 units going in on Hemlock. They will i ; have ingress and egress to the subdivision from Laguna ; Drive and they are not asking for City participation or i I help from anyone to develop the street. I I 1 After due consideration, a motion was made to recommend ; approval of this request for reclassification for the followk i ing reasons: I I I 1. J I The Secretary presented proposed Resolution No. 317 I incorporating the recommendations of the departments as i : conditions for approving the tentative map. i The City Attorney suggested that Item 19 be added to the 4 i resolution: "All property within the subdivision shall be : ; zoned R-3". 1 ROBERT L. MEANS owner and subdivider explained ,i i that they intend to put in a swimming pool which will be ; ; fenced in for safety and there will be a recreational area i this lot which will be owned and maintained by the property : owners of this subdivision and they will have equal responf i sibility for the maintenance and safety of the pool and ; : recreational area. They anticipate that abou4 50,000 cubic feet of ground will have to be moved to permit : this drag strip which is in the flight pattern of the Palomai I Airport. The applicants have volunteered to waive one of : l'l;a the uses in the C -2 zone regarding the sale of liquor. Thei I will serve soft drinks and later they will have restaurants: ::;::: 1::1,1 I The Commission discussed the sale of liquor. MR. BELOND stated that the drag strip normally takes I I I::I I i more than half of the land and and the Lower right hand ::I::: ; corner of the land will be of no use as far as the drag strip ::::;: : They may put in other recreational facilities and in the : @l:ll* unforeseeable future they may have liquor on part of the ::I:;: i annexation but not on the drag strip. I I i:;:;; i The City Attorney advised the Commission that they can ! :::I:: : not restrict the uses in a reclassification but they can put i i conditions under the Conditional Use Permit. 0 0 i The Commission discussed whether or not all of the-d : in the annexation should not be zoned at one time, and i asked Mr. Belond why he had not applied for M zoning. : I I f I f I I i MR. BELOND stated that from his experience in Orange : County he has found that they now have enough land zoned i : Industrial in that area to last for 40 years, and from the : : owners point of view he wauld withdraw the request if it : were zoned M as it would make the land valueless. He al& : stated that they own this piece of property now and are i buying the property up above the northeast corner of this ; : property and would like it included in the application. : It was pointed out that the Commission could just consider! i the part that was legally advertised, and since the parcel : I of property that Mr. Belond was describing was not in his! ; name and Kay Kalicka's estate had not signed for the re- : i quest, the classification on this other parcel could be heajd : at a later date. I I I would not be able to leave the land deemed R-1 and some :i' ; zone would have to be put on it. I I I I ! It was the general feeling of the Commission that because i the property is under the flight pattern that its uses were i ; restricted , otherwise they should consider the whole I I I I I $ I I I I I The City Attorney advised the Commission that the City I I I I 1 I I I I territory. I I i A motion was made by Commissioner Ward, seconded by : Commissioner Davis to approve this request for classifi- i cation for the following reasons: I I I b I I 1. That it would be the best usage of the land and i I : would be compatible with surrounding property, since it ; i is in a flight pattern. I r 2. That it will present a good location for sports to i i go in. l a I I I I b I I I I l I I 4 I 4 3. That no objections were voiced. * I l 4. That such classification will not be materially i i detrimental to the public weifare or injurious to the i property or improvements in such vicinity and zone in ; which the property is located. I **"""""""~""""""""""""""""~"*"""""""""""" I I Other members of the Commission questioned the legal i description of the property that was advertised since it : did not correspond with the application, and the City I I Attorney advised the Commission that the hearing would : have to be readvertised with the correct legal description: of the property to be classified. 1 Chairman Palmer apologized to Mr. Belond for this delay; I The motion and second were withdrawn.
