LLCYD A, DINDINGER explained that the Lavells I :who own the pqoperty on the northeast corner of Harding : Street and Magnolia were not opposed to this zone change :but are retired people and were not concerned with this : i matter. 0 I The Chairman announced the Commission would now hear i :from those present wishing to speak in opposition. I O I I O I O I I I O I !The Commission discusered the fact that the DMJM report jreferred to the property along the freeway as having a :higher use than single-family residential zoning, and that jthe multiple-family residences would be compatible with :the freeway and property in the area; also discussed the !possibility of putting an alley in; and the off-street parking I I I I I O t I I I I 0 I O I I O I O I I I I I I O I I e I I O I I I 1 I O I I I I O I ! .- i The Building Inspector explained that before they issue i i any building permits where the proposed structures may i : be in the path of the proposed widening of the freeway, ; i they refer the property owner or builder to the Division ofl, ; Bighways in case the State wishes to purchase property : I before it is built on. He reported that there had only bee4 : one instance where the property owner did not kome back i for a permit to build. He ekplained that the entry for ; : parking would have to be from the front. He stated that : the Highway would take some of this property, but felt i i there would still be an adequate amount of property left i ; to meet the off-street parking requirements. l I A motion was made to adc9,pt itesolution No. 390 as I I I requested for the following reasons: I I i 1. That the land is adjacent now to a busy freeway and : ; to other R-3 zoning in the area, and is merely an extensiob I of the nearby R-3 zone. I : 2. That placing It-3 zoning for apartment houses next i to a busy, noisy freeway is a compatible use with such i ! adjacent land. I I I 3. Applicants: Carlsbad i : Raceway Company. I I : Notice of hearing was read. The Secretary certified that : i property owners in the area were notified and then read i the application. I I : Letters were read from the following persons opposing i i this request: I I G. N. Frazar, Lake San Marcos, P. 0. Box 303, San I i Marcos, dated March 9, 1965. I I i Russell L. I i The Chairman announced tk t the Commission would now i ; hear from the applicant and those desiring to speak in : i favor of this request. I I i MR. J. S. BELCND stated that at the present time they i only plan to expand the present racing operations for spor? ; car racing. The Sport Car Club of America has granted ; i approval of these races at this track and there will be ver$ : little problem of expanding the present facilities. They : i have an arrangement with the Vista Irrigation District to i ; supply them with water which meets the requirements of ; i the Health Department. The citizens in town have felt the ; effects of the racing events in the City, plus the nationwidd i publicity that is given. In regards to the letter received i :from Mr. Frazar from La.ke San Marcos, Mr. Belond ; I I I I t I I I I I I I I I I I I I I I I I I I I I I I I I * I i reported that he has made it a ,point tb drive over there an4 ; sit and listen to what could be heard. It was possible to : i hear a hum but not the public address system. The Raceway Company is asking for an: ; expansion for all kinds of racing in order to avoid having :to ask for special permission each time they wished to : hold different types of races. At the present time they I just wanted to have sport car racing. The Sports Car ; Club has definite standards and requires driver's training i :and practice before they can enter into competitive racing.! ; There can be no competitive races held during the first ; :two races. Mr. Belond reported that this drag strip is i the fastest dragstrip in the world and the fastest racer is ; a resident of the City. When asked about the trash and i :litter.: Belond stated that they not only try to police their ; !own property and keep it clean but they also have removed i :litter and trash from neighboring property. t I I I I I I I :Improvement of the parking facilities was discussed, !Mr. Thornton explained that when they were granted the : !conditional use permit, plans were submitted to the Engi- :neering Department and the City Engineer waived the im- : :provements as long as there were no dust problems. In i !reply to the question raised about barricades for parking, ; :Mr. Thornton stated the Engineering Department will in- i Ispect this and order out some barricades if necessary. : :They have checked with the Police Department and there i !have been no problems with the i-iaceway and no dust com- I :plaints. 1 I :Mr. Belond stated that they would still like to concede the i :jet drag races. The sport cars would be the "Enduro" typ? :and they would like to have go-cart racing. He did not feel; :the present facilities were suitable for stock cars. The I jraces would be held on the weekends, I !When the Commission discussed continuing this hearing, i :Mr. Belond stated that if this hearing is continued and de- i jlayed the Sports Car Club of America will go elsewhere as ; :National races have to be scheduled in advance. !MR. JAMES L. KINTZ., Attorney at Law, 221 Broadway, i vista, stated that he represented Mr, Frazar, from Lake ; San Marcos, Mr. Thibado, Mr. Meisinger and others, and! $e voiced the same objections that were expressed in the ; Setters from his clients. He stated this was not in the besti interests of the public if it is opposed by the property own- : brs in the vicinity. The property owners in the area would! bot have objected developments going in there similar to : pake San Marcos or Las Costa Downs. He stated that he i felt that it was a detriment to the neighborhood and asked : that this request be denied. I I IMH. BELOW, in rebuttal, explained that this was unim- i @roved land and there were no developments there with i jthe exception of Lake San Marcos some distance away and I bho are doing a fabulous job and he would be conerned if ; be thought they were hurting them, He explained that the i Property was selling for $2,000. per acre now is selling ; $or $7,000. per acre and some of the Carrillo property, i Fe believed the only access to the &isi%~ and Thibado : properties was from Highway 76 and the only way they I I Fould improve their land would be to buy additi.ona1 proper -i $y for ingress and egress. I I !The Commission discusad the-&& tbt-Dtrcm were only !a few individuals opposing this; that manufacturing would i :be compatible with the racetrack and this property would ; !not be suitable for single-family residential purposes :since it is in the flight pattern of the Airport; also discus- : !sed was the problem of trespassers. !Mr. Belond explained that they police their property to the: :fence line for trespassers and litter, and that the owners i iof the Carrillo estate have given them permission to keep ; ithe trespassers off their property, but they have no right I ;to trespass on the other properties, I !Mr. Thornton explained that the properties to the east are jin the County. I 1 I I I 1 I I I I I I I I I I I I I I iPointe discussed by the Commission were that sport cars i :were not as noisy as dragsters but would continue for a ; :longer period of time; being opposed to the open request i :for all types of racing, and the type of racing should be ; !specified; that this hearing should be continued and the ap- i :plica& should furnish the Cornmission with more specific : information like they did from the National 3ot Rod Asso- i :ciation and that they should have more answers. I I :Mr. Belond stated that he would be willing to accept one i :type of racing at a time if they so desired. !After further discussion, a motion was made by Commis- i jsioner Grant that this hearing be continued and the appli- : ;cant and the staff obtain more information, and they would i :like answer8 to the following: b I !Do 24 sport cars make as much noise as one of the drag- i : sters? 8 I :Would the sport car racing be held in addition to the drag ! races, or would they be held in place of drag racing on the: :days scheduled for racing events? I I :Are they high-powered vehicles? Do they use any unusual : :fuel giving off smoke and odors? I I I h hat is the duration of the races and the frequency and ! :timing of the races? I i When would these races take place and what is the average! :speed of the vehicles during the races? I I i'vVhat are go-carts and the noise factors involved? The Chair- ; !man asked that the committees just put down any changes i : that they recommended. I I I I I I : The Chairman stated that he is not happy with the DMJM i report as he felt they should have a summary and working i : report. He would like positive recommendations and I B i statements used, and descriptive terms. i The Chairman questioned the fact that Lake Calaveras was! :not mentioned in the Parks, Beautification and Schools ; report, and Mr. Thornton explained that Mrs. Betty Pi 011.: :rich was misinformed about the lake regarding the fence : !lines and came in for correct information that day regard-: i ing the size and location and will study this report on it. : ;A few of the reports were referred back to the Committees! :for more descriptive terms and references, rather than I :page numbers of the DMJM report since the page numbers : :will be changed. I D b B I I I I * I 1 B :The Commission discussed hiring a planner and felt they :should interview one before he is hired, since they would i :be working with him. I * :The Chairman stated that he had talked to Paul Neal the : !week before and told him the preliminary report was too i :bulky and that they would like a synopsis of the report. ME. !Neal had stated that they could not afford to make any 2 jchanges. I I I !The City Attorney informed the Commission that they could ;get some action on this matter as DMJM would be required :to give an acceptable report even if they felt they were : !underpaid. I - """"""""""""""""""""""""" 6- I I I I I I I I I 1 I I Discussion was given to the fact that the report was made i by Kenneth Norwood and there had been changes in the ; DMJM personnal. The Chairman stated that he felt there should be a sum- i i mary of the report on the first page and another chapter : ; on industrials development, etc. He felt the report should! : be more clear and condensed if used as a "Bible" for the : next ten years, and that the Citiznes Committees reports i : and any addendums should be added to the report. He i would like to see it re-written in a usable form. ! Commissioner Freistadt asked to make a motion that Pauli :Neal be notified that the Commission does not intend to : : proceed with this until they have a better report. I i Mr. Thornton stated that the general public wants to see I I a map of the General Master Plan. I I I I I I I I I I I I I I I I I I I I 1 I I I i There was discussion on bringing Paul Neal down for a 1 :working session.
