FEBRUARY 24, 1970 TIME OF MEETING: 7:30 P.M. . , PLACE: COUNCIL CHAMBERS iOLL CALL: Councilman C. H. Neiswender was present; City Staff representatives present: E. J. Olinghouse, Joe Spano, Richard Osburn, Fire Chief Anear, and Cl'ty Attorney Stuart klilson. Commissioner Dewhurst was present at 8:03 P.M. 4PPROVAL OF MINUTES: The minutes of the regular meeting of February 10,1970 Mere approved by voice vote, as corrected. ARITTEN COMMUNICATIONS: (a) The Chairman read the memo dated 2/11/7Q from Ftr Chief Anear to the Planning Commi,ssion and Department, re a change in the CM Zone. He recommended that a chqn be made regarding,Item 25 of the CM Zone for bulk plants, as it was felt this ftem was no longer needed and, this is a very hazardous operatton, l'nvolving the bulk storage of gases and the like. A piece of propert zoned CM on State Street once operated a bulk oil bus? ness, which is no longer in operatl'on and the Ftre CRI felt this-was not a good use on State Street and shoul be looked into and such operations restricted to HM" zoning only. After due consideration, it was decfded this matter will be reviewed by the Planni,ng Dtrector 3s it might affect other C-M zoned property, and tf agreeable to delete Item 25 wfthtn such zonimg, the proper yeso1uti.on will be prepared by the Cl'ty Attorne (b) The Chairman read a letter dated 2/10170 from the :arlsbad Garden Club and, Mr. Olinghouse's reply to that letter, regarding their unanl'mous urging that the 'lanning Commission prevent any change in the open spa Loncept of-the Buena Vista Lagoon. It was felt any f1.1 3f- the Lagoon would be detrimental to the City and to Iceanside, as a recreational factor and tourist attrac tion. The Chairman added his thanks to the Garden Club in behalf of the Lagoon and, it was decided to forward :opies of this letter to the City Council for their information, in view of recent proposals for the Lagoo (c) The Chairman read a letter from CBDAC dated 2/24/ re the adding of a Variance procedure to the City's si ordinance (No. 9224), which was considered necessary f clarifying the intent of this ordinance. The Chairman added he also felt this was indeed a need in this par- ticular ordinance. The City Attorney commented on his review of past sign ordinances, or portions of same, prior to No. 9224, .wh may or may not still be in effect. He had understood t the sign ordinance had purposely been included in the "Land Use" section of the zone ordinance in order that it could be applied to the specific uses spelled out therein. This was felt to add to nd clarify this particular section of the amendment. n that considerable detail had been covered at the revious meeting and all questions had apparently been et satisfactorily, it was agreed no further discussion as necessary. The motion was duly made, upon arrival f Commissioner Dewhurst and closing of the public hear ng at 8:30 P.M., to recommend this amendment to the ouncil, creating an RD-M zone in the ordinance. The easons given are shown below: ESOLUTION NO. 656 - A RESOLUTION RECOMMENDING TO THE ITY COUNCIL AN AMENDMENT TO ORDINANCE NO., 9060, CREAT- NG AN RD-M (RESIDENTIAL DENSITY-MULTIPLE) ZONE doDted b.y title only and further readincl waived; for he' reasons itemized" as: (1)That the pasiage of this ecommended amendment to Ordinance No.9060 i,s required y public necessity, convenience, and general welfare; 2) This zoning amendment will enhance the General Plan egarding Residential multiple densities, and (3) This mendment is in conformance with the General Plan for he City. No.9060 amending \rticle 14, Section 1400 re Conditional Use Permits, idding automobile service stations with standards and :onditions listed thereunder. The Planning Director entertafned questions on the fin proposed draft of this revised Section 1400, addl'ng se stations and auto-related uses. In that there could be future confusion as to what does entqil these inoidental consumer services and products, and, providing further definition of same could be difficul it was finally decided to delete the particular clause involved entirely. MR. HARRY TRUAX,.4125 Harbor Drive, wished to point ou that a complete Section 1400 was actually being consid at this public hearing and he personally felt several other uses could be enlarged upon, besides just the service stations and auto-related uses. Specifically, the just prior request from Chief Anear regarding bulk storage operations in a CM zone. Mr. Olinghouse stated the purpose of structuring this amendment in th.is manner was so that other specific us could be added at later dates, but that additional criteria for other uses at this time could prove a ver monumental task, wh.ile those set forth for service sta had long been considered critical. He suggested the Co mission could continue for the purpose of adding crite to other uses in Section 1400, or the Commission could act. on this amendment and prepare amendments for other uses from time to time. The motion was duly made to continue this hearing for a period. of 30 days (meeting of 3/24/70) to allow the Planning staff time for additional work on other uses withi.n Section 1400. OLD BUSINESS: (a) Memorandum dtd 2/18/70 from City Manager re Appea Hearing on Conditional Use Permit for Mobile'Homes Par for applicant Andrew McReynolds: This memo was read in full, establi.sh?ng that the Count had granted this appeal, following a split vote deci:si.l on the part of the Commission. While all Commfsstoners from this original hearing and split vote were not present at this time, it was found that of those presel there was no change in their vote. It was agreed and 4 notion made to that effect, to report back to the Count there was no change in the original decision in thts natter. G. H. ENGLAND 2727 Ocean Street (for Mrs. Nancy Johnson, property OW to the North of the proposed development), MR. MAX EWA 27.29 Carlsbad Boulevard, were present and presented their views of the proposed apartment building, as it affected their adjacent properties, privacy, potential noise and smog from the subterranian parking area, add drain on an already overburdened water and sewer facfl traffic congestion, etc. Mr. Ewald was present in favo ~f the proposed building and felt it to be a deffnite attribute to the City and general area. Commissioner Palmateer pointed out the Commi.ssion had 31ready held a public hearing and acted in favor of tw portions of said variance request, denying the side yard portion in view of fire hazards. In that these fi qazards were apparently now removed, the Commission could now approach the side yard setback with a differ 2nt view. The question of the open garage for some 59 :ars, opening onto a private dwelling, could be consid it this time if the Commission wished to consider this -allowing-additional discussion of the appositionEs )oints,.the motion was made to report back to the Coun vith a memorandum approving the sideyard setback to fi (5) feet, in line with requirements set forth in Fire :hief's memorandum of 2/13/70 (Items A thru E), and ndding a stipulation as to the enclosing of the North ind South ends -of the garage, which side on private lwell i ngs. (c) Continued Items: Mr. Olinghouse commented on the lew system of keeping track of these partl'cular ?terns 1s they come into Being and remain wtth the same nunbe for the ye'ar 1970, through to thetr complet-ton, 70.2 Garfield Area Reclassificatfon: Planntng Director recommends utilization of the RD-M Zone, as soon us this is a reality and pendl'ng the heartng by the Counc in March on same. 70.3 Buena Vista Lagoon Jt. Study Project: Mr.' Truax commented on the activities of the Oceanside Council in appointing a member to work with Carlsbad on this project. Councilman Neiswender stated an opportunity had not been afforded to appoint a member from' thl's Zity's Council. Commissioner Palmateer recalled a past Joint Committee which had not been active for some tim and Mr. Neiswender stated he assumed the Mayor intends to re-energize this past committee's representative in :ouncilman McComas, with the addition of Cit'y staff nembers. It was added that Eamm5$s%aner~Balmateer is the Commission's representative in this Jt. Study Proj 70.4 Mobile Homes Study: Mr. Olinghouse commented on the interim ordinance adopting a 90-day moratorium on such applications before the City. 70.5- Density Study: Mr. Olinghouse stated a pseliminar, report would be forthcoming on this proposed study, 3ossibly by the March 10th meeting. 70.6 Public Utility Zone: There has been no word from SDG&E to date on this 'proposed amendment* COMMISSIONERS !r '9 ed 1 Mot ton Ayes Abstatn Absent t. "- I ,- CI 1 Y OF -5- CAF?LSWD COMMISSIONERS 70.8 Scenic Corridor: Mr.' Olinghouse reported there wa nothing new from the County on this; he would however, have some information on a proposed inter-city scenic plan he has been advised of recently. 70.10 and, 70.14 - Same 70.12 Revised' General Plan Land Use Element: Mr. Oling house stated the.department staff was workina on some " preliminary studies and he plans to present a tentativ Land Use Element at the June 10th meeting. 70.13 South Carlsbad Community Plan (New 1tem):Mr. Olinghouse stated all the property owners in this area .# " - had not yet been contacted and he hoped to have.this c tact and discussion period complete by March 10th The following new items are added: 70.14 Open Space Element and 70.15 Education El-ement of General Plan. Mr. Olinghouse commented he had been workfag with an Education ad hoc group thru CIC and he would report on this very active, group's projects at a later date. The Chairman requested the older item re Illegal Sign Survey be returned to this list of items, pending a complete report from the Building Department, as reque previously. (70.7 Illegal Sign Survey Status). INEW BUSINESS: I (a) Fire Chief Anear commented on his recent memorandu to the Council and Planning Department re a change in fire district for that area near the ocean front. He clarified on definitions of types of dwellings, etc. contained in both the present and proposed districts. Further, on Classes 2 and 3 rates districts and their requirements. This is spelled out as a construction ch.a and fire zones are set by ordinance. While it is felt the Council can best act on a change of designated fir z'one, Chief Anear stated he would prepare a report of all details involved and forward same to the Commissl'on for their review and recommendation to the Council. COMMITTEE REPORTS: (a) Community Involvement~Committee~CIC): Mr. ()ling- CIouse reported some members of this group will travel to Imperial Beach this week with him, to view certafn -eased Housing Projects in that city which have been quite successful.
