ROtL CALL: City staff representatives present: J. E. Spano, Stuar' Wilsom, E. J. Olinghouse. Commissioner Gullett was present at 7:42 P.M. APPROVAL OF MINUTES: The minutes of the regular meeting of April 28, 1970 were approved'unanimously by voice vote approval. WRITTEN COMMUNICATIONS: None. ORAL COMMUNICATIONS: (a) Commissioner Jose mentioned that Dr. Palmateer anc himself were the only members planning to attend the League of California Cities conference at the Disney- land Hotel on June 3-5. He further advised they would endeavor to report as much as possible from this con- ference. PUBLIC HEARINGS: (a) CONDITIONAL USE PERMIT-RENEWAL - To permit the continued use of 100-ft Radio Transmltting Antenna and Transmitter Facility; Applicant: Offshore Raydist, rnc located at Oceanview and Palomar Airport Road, Westerl' of railroad right-of-way. Mr. Olinghouse presented the staff's report, date1 May 6, 1970, which advised this was the third applicat for a year's use of this equipment, and the second re- newal. Also, the recommendation was to allow tfie one- ye.ar renewal, until May 12, 1971, subject to two(2) conditions. MR. ALLEN LEFLER, West Coat Supervisor and repre- sentative for Offshore Raydist, Inc., was present and stated he had nothing to add to the staff report just read, but would be happy to answer any questions. The Chairman asked if the source of recent television intel ference (a "beep" tone) could possfbly be caused by this antenna, to which Mr. Lefler said it cou1.d not. Hc advised they operated at 1621 kilocycles and-this par- ticular interference could not be caused by their opepi tion, but the FCC could trace the problem if it were 'followed up to them. Upon questioning, he explained thc need for this station location, whtch is one of four such locations on the Pacific Coast, serving martne biology, oil research, and related activities at sea, i serves as a ship locater. Further, this is termed a position finding system whrch, while not used very mucf this past year, is still considered a vital part of-thc total operation in support of the geophysical studies conducted for various agencies, private businesses, etc There were none in the audience to speak either in favc or against this application and the public hearing was closed at ?:47 P.M. (Commissioner Gullett was present 1.t 7:42 P.M.) COMMISSIONERS resent bsent otion Yes bsent n d X X I -r c- CITY OF CARLSBAD -2- COMMISSIONERS Chairman Jose stated he had visited the antenna site and since there were no complaints about inter- Ference and the applicant was complying with all the requirements of this permit, he could see no reason for not renewing the one years’ use; he did ask the applicant’s representative to check the weed situation around the perimeter fence at the site, however. It was generally agreed that this permit could be renewed again and the motion was duly made to do so, incorporating.. the two conditions of approval as set Forth in staff report of May 6, 1970. PLANNING COMMISSION RESOLUTION N0.664 - A RESOLUTION 0 THE CARLSBAD CITY PLANNING COMMISSION GRANTING A SONDITIONAL USE PERMIT RENEWAL, LOCATED ON THE WESTERL SIDE OF RAILROAD RIGHT-OF-WAY, SOUTHERLY OF PALOMAR 91RPORT ROAD, subject to the two(2) conditions of ap- proval as stipulated in Staff Report dated May 6;- 1970 Reasons for such approval are: (1) This is apparently not detrimental to the surrounding area; (2) The appli cant has, in the past, met all the requirements of the 2ermi t. 3LD BUS I NESS: (a) Agenda Bill 129 - Council action re Appeal of Pre 4nnexational Condutional Use Permit, Ward/Lear Propert (Macco Corporation) J The Planning Director advised of the action by th :ouncil in this appear1 matter for the mobile homes lark and stated that the Commission could now forward their memorandum/report as requested, or cfioose not to answer at all. Commissioner Gullett stated Rad fie bee 2resent at this split-vote public hearing, he would ha doted against it, and others stated they did not wish to change their original decision at this ti‘me. [t was therefore agreed to forward a report to the Council, Pdvising there was no change in the decision of the >ommission in this matter. Chairman Jose asked Mr. 31 inghouse if the Counci 1 .appeared to be aware of .the noratorium period on mobile home parks in the City, to vhich Mr. Olinghouse affirmed they were. There was also some question as to the validity 0 this application, in that it was received in part prio to the moratorium period’s enactment, and the question 06, what comstituted a complete filing of an applicatio was. It was later established this applicant had filed his department form and fee prior to the enq.c-tmen:a.*f The City Attorney affirmed that the Council was appar- ently treating this applicant as an acceptable and pri to the moratorium application. MR. ROBURT SANBORN, mortgage and real estate I businessman in the city, was present and stated he had formerly written a letter to the City Council, contain ing much information from his recent feasibility study on mobile homes parks, and which he stated was appaben being totally disregarded. F CITY OF -3- CARLSBAD to the t.ax benefits to th.e city from such developments as compared with subdivisions and other requirements imposed on subdivision developers,by cities. He cited several discrepancies in requirements of mobile home developments as well as statistics indicating what pro portion of city, county, school and improvement taxes mobile home tenents paid, He personally felt that bot the city and the tenent suffered under many of the loa and contracts available in the mobile home market. He stated he was not aware that the Commission could not now influence.the decision of the Council on this present appeal action and asked the Commission to indi cate that a revote would have denied this in its prese discussion. He further hoped the Commission would be more aware in their future dealings with mobi.le home applications for this City. (b) Agenda Bill 130 - Council action re Planning Com- mission Resolution No. 657 amending. Ord.#9060, Article 14, Section 1400 re Conditional Use Permits Mr. Olinghouse briefed the Council's questions which was referring this item back to theCommission fo clarification or additional rewording, in particular a to Paragraph 1, page 1, "those uses in any zone", and additional detail desired as to Item E -- Carnivals and Circuses. Mr. Olinghouse stated he had already dis- cussed Item E with the City Attorney and they had made revisions which could be discussed at this meeting, fo incorporation in the recommended draft and returned to the next meeting on May 26. Considerable discussion followed as to the troubl some wording of non-profit organizations, thosehtring professional carnival or circus businesses to conduct an event for them, and strict businesses enterprises desiring a permit to operate in the City. It was then decided to handle thFs item wtth an exception clause within this ordinance, adding rodeos to tbts item, and incorporating hours of operation, zones to be allowed for such events, the distinctions between local school 0.r church events, and those which are not, etc. The Planning Department was instructed to revise according and return the draft at the May 26 meeti'ng. (c) 'Continued Items' Attachment - Planning Director reports : 70.2 Garfield Area Reclassification: Target Date June 70.3 Buena Vista Lagoon Study: Mr. Olinghouse stated he had discussed this item with City Engineer Cook, but had been unable to contact Mr. Bagley from Oceanside. He had also taken some notes from an Ocean side council meeting, which did not reference any form resolution in this behalf and future use of the Lagoon He stated he would report to Oceanside with a resolutt regarding this City's desires for the Lagoon, advising the Commission as to progress at a later date. 70.4 Mobile Homes Study: Mr. Olinghouse stated COMMlSSIOb JEF ?S 70 !4'. Richmond of SDG&E/San Diego office, wished to continu' this item to the next meeting on May 26, following a luncheon meeting on May 15, to which the work comrnittel from this body was invited and himself are invited. Th will discuss SDGGE's progress at that time. 70.8 Scenic Corridor: Target Date: July 70.11 Problem Area Zoning Study: Initial phase referr to CIC's Citizen Advtsory.Committee and later return t the Commission. 70.12 Revised Genel'al Plan - Land Use Element: Mr. 01E house referred to a department layout drawing just completed and handed out to the Commission, which he desired they study during the next two weeks and discu at the next meeting. This pertains to the departmentt recommendations for a land use element for the City. 70.13 South Carlsbad Community Plan: Target Date: Jun 70.14 Open Space Element: Target Date: June 70.15 Education Element: Target Date: June 70.19 Review of State Variance Procedure: Planntng Director's memorandum of 5/12/70. Mr. Olinghouse refe to his memo which stated that this City's variance cod does not differ materially with that now used by the State and recommending that no amendment be made to our code at this time. This completes the research an activity on this continued item. NEW BUSINESS: None. COMMITTEE REPORTS: (a) - ClC; Mr. Olinghouse stated they are now studyin the various federal assistance programs and he. will co tinue to report on this progress. (b) '701' Application: Mr. Olinghouse advised he ha just learned this date that the 701 funds would be re- ceived, retroactive to May 1, 1970, as a result of thi City's applieat4on to the State in April.
