COUNCIL CHAMBERS ROLL CALL: Vice-chairman Gullett conducted the meeting. City sta members present: W. C. Baldwin, J. E. Spano, H. T. Cook, E. J. Olinghouse, Stuart Wilson. APPROVAL OF MINUTES: The minutes of the regular meeting of 7-28-70 were ap- proved as corrected, by a motion receiving voice vote approval. WRITTEN COMMUNICATIONS: None. ORAL COMMUNICATIONS: None. PUBLIC HEARINGS: (a) VARIANCE - To consider Reduction in Lot Frontage from 60 to 20 feet, to allow llPanhandle" Lot Split, on East Side of Monroe Street, between Magnolia Ave and Park Drive; Applicants: City of Carlsbad and Kathryn D. McGinnis. Mr. Olinghouse read the technical Staff Report dated 8-05-70, covering the- history for this parcel of land which formerly was a reservoir in the City's water system, but is no longer used and is for sale. The developer wishing to purchase this land can utiliz it as three R-1 lots of a minimum 7,500 sq.ft. each. The staff recommendation was to approve this request for a "Panhandle" Lot Split, subject to certain condit as itemized in section IV of'this report. The secretary read one opposing letter*from Mr. & , Mrs. James R. Einum, Honolulu, Hawaii, and who's lot i is adjacenti to the subject parcel. Mr. Einum was also ~ concerned about the existing easements lCMWD and SDG&E which are also a part of their property and which they want removed. There were no others opposed present in the audience. REV. DEWAYNE WALKER, an adjacent pr0pert.y owner, stated he represented some 3 or 4 families in the area who look forward to the removal of the old reservoir in order to clean up the property. He did want clarifi tion of the disposition of existing City fence -- whet the City would decide the future of same, or this. woul pass to the new owner/developer. MR. JOSEPH PARISI., 305 Elm Avenue, represented Mr Miles Strand of 3859 Monroe Street, across and Souther of the subject property, who wished to speak in favor of this variance request. MR. JAMES MC GINNIS, husband of the applicant in this matter, was present and stated the fence would be left standing as at present, in answer to Dr. Walker's question. Also, he plans to build three nice homes, which would be a definite asset to the existing neighb hood. The public hearing was then closed at 7:42 P.M. COMMi SSIONERS 'resent .bsent lotion .yes bsent lr ,/ i L C ITY OF CARLSBAD -2- The Commission questioned the City Attorney regar ing the various easements now existing on this parcel and he stated the City should take affirmative action to vacate the easements to the new owner, following ac tion on this pending application. He also saw no prob in this action. Commissioner Palmateer referred to the City's general policy regarding "Panhandle" lot splits and stated it appeared this variance was a good means of approaching this property's use. There was additional clarification required on Condition (dl requiring a six months' time limit for removal of the old reservoi which Mr. Olinghouse stated was primarily for safety. Mr. Baldwin volunteered that the prospective owner has stated he will begin dismantling operations on the old reservoir immediately. The motion was duly made to approve this applicat for variance, Planning Commission Resolution No.671, for the reasons and subject to conditions given in the Staff Report of 8-05-70. PLANNING COMMISSION RESOLUTION N0.671 - A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING A VARIANCE ON PROPERTY LOCATED ON THE EASTERLY SIDE OF MONROE STEET, BETWEEN PARK DRIVE AND MAGNOLIA AVENUE, REDUCING THE REQUIRED FRONTAGE FROM 60 TO 20 FEET, as identified by title only and further reading waived; Reasons for approval are as follows, and conditions of approval are as itemized in Section IV (a thru g) of Staff Report dated August 5, 1970: Reasons: (1)The pr posed division of land meets all requirements of the City Council policy regarding "Panhandle" Lot Splits. (2) The unusual configuration of subject parcel warran the granting of a "Panhandle" variance. (3) The granti of such variance will not be materially detrimental to the public welfare nor injurious to the property or im provements in such vicinity and zone in which this property is located. (4) The granting of such variance will not adversely affect the Comprehensive General Plan of the City. NEW BUSINESS: (a) RESOLUTION OF INTENTION N0.73 - To consider setti public hearing date for 8/25/70 for Supplement No. 1 to Housing Element of General Plan - Mobile Home Growt Mr. Olinghouse briefed the Commission on the vari responses from the industry and an industry newspaper, stating he felt we could now set a.public hearing date for this item. The motion was duly made and approved to adopt ROI#73,setting public hearing date for 8-25-7 following the proper public notice. OLD BUSINESS: 70.2 Garfield Area Zone Change and General Plan Amen Ment: Mr. Olinghouse referred to the new map mailed to the Commission and also presented in color code on the wall, covering names, types o responses, location of property, as result of t complete mailings on these two matters. Discussion was given other aspects of the general plan amendment, prior to a motion to continue to the meeting of 8-25-70, to draft the required resolution of intention. 70.3 Buena Vista Lagoon Study: Planning Director to handle-Continued. 70.4 Mobile Homes Study: Public Hearing set for August 25, 1970. 70.5 Density Study: Continued with 70.2 above to 8-25,-70 meeting. 70.6 Public.. Utility Zone: Planning Director reportec that SDG&'E representative and work committee me' on August. 7th and additional information has bet received from the utility company. COMMITTEE REPORTS: Commissioner Little discussed the recently formt "Pollution Commission" which will meet during Septembel He felt liaison from the Council and the Commission wot certainly be desirable f.or this important group to keel current with their activities and advise on commission and council activities. Mr. Olinghouse brief on the activities of this commission and added he agreed strong liaison would be needed. Mr. Little hoped a very definite imput of in- formation would be forthcoming from this new commissiol in the form of reports, etc..
