A. Moe, E. J. Olinghouse, J.E. Spano. (Cmr. Dominguez was present at 7:34 P.M.) APPROVAL OF MINUTES: The minutes of the regular meeting of February 23, 197, were approved as submitted, by voice vote approval. WRITTEN COMMU.NICATIONS: (a) The Chairman asked that a letter from' Carl H. Neiswender, Chairman of Environmental Pollution Commis, ion, dated 2/16/71 to the Commission, be read as it referred to the previous public hearing on SDG&E's two additional tanks at Encina Plant, specifically regardi. testimony presented by him re E.P.C.'s feelings in thi, matter. (b) The secretary read a memorandum/report from L.A. Moe dated 3/09/71 to the Commission re the Commission': power to continue a public hearing item, which questio. had originated at the SDG&E hearing also and at which time the statement was made from the audience that the Commission could not in fact request continuance withoi full approval of same by the applicant. Mr. Moe had since researched the matter carefully according to Sta. statutes and the City codes and offered the legal opin. that the Commission did indeed have this right on the question of a Conditional Use Permit or a Variance. He had further validated this rendering with other City Attorneys who had considerable experience with public hearing items and they agreed. He had .also bontacted Mrs. Carlyn Reid who is a staff attorney wit-h League o California Cities in Sacramento, who also affirmed the was no law prohibiting continuance by a Planning Com- mission on a Variance application, or on any applicati unless a specific restriction is imposed by a statute. ORAL COMMUNICATIONS: None. PUBLIC HEARINGS: (a) RECLASSIFICATION OF ZONE 6i ADOPTION OF MASTER PLA. To consider application for Change from R-1-10 to P-C Zone for 90 Units and Neighborhood-oriented Commercial Facility; Applicant: M. E. Humphreys, located on $W. Corner of E1 Camino Real and Chestnut Avenue. The secretary read correspondence from Mr. Humphrl dated 3/05/71 which stated the application should be withdrawn for subject change of zone, pending further activ.ities -in this regard by himself. Further, this wi. be resubmitted at a later date. .. Upon questioning from the audience if discussion from interested. property owners would be allowed, the Chairman advised there was no public hearing tb allow discussion on at this time inasmuch as the application was requested wi&hdrawn by the applicant. They were ac vised they would be recontacted by written notice when the hearing was called again. CITY OF CARLSBAD area for the next week. Prior discussion to the publi hearing date and by the staff with the property owners was discussed, as it applied to future applications of this type. The lack of communications in like situa- tions and the tendency of the public to not become involved at all until personally affected also came under general discussion. A proposed supplement to th Housing Element of the General Plan regarding patterns of growth, problems of growth, qualitative deficiencie etc., within the City was referred to by Mr. Olinghous as it pertain.ed to this and future problems and in lin with the property owners and developer's standpoints. It was generally agreed further discussion was .warrant at a later, adjourned meeting, and Mr. Olinghouse brie discussed what he had in mind for such a supplement to the Housing Element. Commissioner Jose agreed an adjourned meeting wou be beneficial but suggested waiting until'the latest submittal from CIC was available re their "Statement o Goals" and which would be forwarded to the Commission for review and comment as well. Mr. Olinghouse stated he would have copies of the Goal Statement from CIC mailed to the Commission soon. Commissioner Palmateer commented on various ways and various groups or committees.which helped in Reepi up with changes within the City, as well as contactilig the Planning Department for cl.arification on any item of interest. NEW BUSINESS: (a) Request to Amend Ord. #9060 to allow p'rivately owned and operated Campsites, per request frbm Mr. and Mrs. Vincent Ferrero to operate a KOA Campground in th City. Mr. Olinghouse briefed on the background of this request to the Council and it's referring same to the Department and Planning Commission for review to see i such was desirable via amending the Conditional Use Permit' section of the Ordinance. He added they will schedule a public hearing for the Campground applicati on the property Mr. Ferrero is proposing, but it must first be decided if the ordinance should be amended to include this type use. He added comments on why priva campsites were not included in the last updating .of th Article 14 .last year. He added Mr. Ferrero was prepar to show a film explaining the KOA Program and private campsites in general for the information of the Commis, Following this presentation, it was agreed the departm should initiate the necessary resolution of intention to set a public hearing date on this amendment. A for motion was entertained and received voice vote approva to this effect. .. Mrs. Bette Wollrich, Chairman of Parks 6i Recrea~, Commission asked that such amendment be forwarded to h8 group, as well as other documents regarding this camp- ground, inasmuch as they are vitally interested in suc. activity in the City. r r 1 lL? ! C ITY OF CARLSBAD 3- OLD BUSINESS : Mr. Olinghouse handed out copies of the just-rece "Inner City" Report from the Planning consultant firm in Berkeley for the '701' Planning Assistance Program. He added -this report was a "problem analysis" of t.he City. Further, discussion would be forthcoming on thi item at a previously 'discussed- adj0urne.d meeting. He stated copies are also being forwarded to the various City commissions, committees and involved groups, as well as loan copies to the general public. (a) 'Continued' Items Attachment - Planni.ng Director; Item 70.20.- Revised General Plan: Mr. Olinghouse stat this activity may also be discussed at the referenced adjourned "workshop" meeting. . Item 70.22 - Nuisance Ordinance: The CIC has not yet reported on this item and it is expected by the next meeting. Item 70.23 - Architectural Controls: A meeting is scheduled for Wednesday, a:OO P.M., March 17, to begin discussion on this new'item. COMMITTEE REPORTS: None.
