PLACE: CITY COUNCIL CHAMBERS ZOMMISSIONERS ROLL CALL : City Staff members present.: D. A. Agatep, W. C. Smith R. A. Osburn, J. E. Spano, G. W. Anear APPROVAL OF MINUTES: The minutes of the regular meeting of 10-26-71 were approved as submitted by proper voice vote approval. WRITTEN COMMUNICATION: None ORAL COMMUNICATION: Mrs. Cleona O'Bryant, 1155 Oak Avenue, informed the commission she felt that item 7(a) on the agenda (Proposed Amendment to'ordinance 9060 regarding animal! in residential zones) should not be discussed until the committee which was appointed at the suggestion of t-he Planning Commission had a chance to meet with the City staff and discuss the proposed amendment. Accord. ing to Mrs. O'Bryant, the four committee members [(l) Margi Wagner, (2) Tom McMahon, (3) Dr. Richard O'Neil, and (4) Mrs. Corinne Patterson] were never contacted by staff. PUBLIC HEARINGS: None NEW BUSINESS: Com.missioner Jose, acting as chairman in Chairman Little's absence,asked for a show of hands to determinc which agenda item the majority of persons were present to hear. Almost everyone was present to hear i.tem 7(a the .proposed amendment to Ordinance 9060 regarding animals in residential zones. It was agreeable with everyone to hear this item first. .; 7(a) Mr. Agatep read a memorandum dated November 5, 19: to the Planning Commission from the Director of Buildil and Housing, which was a draft for amending Ordinance 9170, Sub. Sec. (6)(b) of Section 500, and Sec. 500 of Ord. 9060. The draft outlined the maintenance condi- tions-of special pets, zoning and square footage re- quirements for horses and cloven hoofed animals, and seven (7) proposed conditions applying to horses or cloven hoofed animals maintained in any R-1-10,000 square foot or more zone. The purpose and intent of the proposed amendment was discussed in the memorandum The chairman asked for comments from staff and commis- sion. Mr. Richard Osburn, Director of Building and Housing, commen.ted that it was. his intention to obtain permission to prepare a resolution of intention settin! a date for public hearing. He suggested that those people wishing to speak in, rega-rds to this proposal wait until the public hearing. Commissioner Jose said he had consulted the City Attor- ney, Mr. Lewis A. Moe, in regards to the proposed am.endment. Mr. Moe said the substance of the draft was acceptable, but it needs to be rewritten in legal terminology. Present Absent Motion Ayes Absent CITY OF CMLSBAD COMMISSIONERS -2- After some discussion, it was agreed that the ordinance as written now is not enforceable. The City needs an ordinance which can be enforced. Mr. Ken Gilman, 3448 Camden Circle, commented that he felt the majority of the people were confused about the proposed amendment. He suggested everyone interes- ted obtain a copy of the proposed amendment to read and study. He volunteered to serve on a committee to study the proposal and work out an intelligent solution. Commissioner Jose said he was disappointed that the committee meetings had not been held as instructed. The commission agreed that the people should get toge- ther and come to an agreement before the public hearing After further discussion, a motion was made to move the Motion X discussion to the first meeting in December before the Ayes xxx x ordinance is drafted so that the committee can meet and Absent X add their comments. Also that copies of the memo presented by building department be made available to the publ-i c. Proposed amendment to Ordinamce 9060 regarding fence heights: Mr. Agatep read a memo from the Director of Building and Housing to the Planning Commission which was a draft for amending Ordinance 9180, Sec'tion 1612 of Ordinance 9060 re: Fence Hei'ghts. This memo out- lined the proposed amendment and gave the purpose and intent of the change. The chairman asked for comments.from the commission or audience. Commissioner Palmateer asked Mr. Osbitrn if he feels thi change will solve the fence height problems. Mr. Osbur said the change would provide a more sensible and fair ordinance which would be enforceable. After further discussion, a motion was made to approve Motion X the memo and give the building department approval to Ayes xxx x proceed with a Resolution of Intention setting a date Absent X for public hearing. Noes 6(a) Proposed amendment to General Plan and zoning ordinance an properties northerly of Tamarack Avenue, southerly of Elm Avenue, and fronting on Pi0 Pic0 Drive. Amendments to consider density, parking, landscaping and extent o'f eastward extension of multiple zoning. Mr. Agatep read a memo to the .Planning Commission dated November 5, 1971 which outlined the intent of the Planning Department. The proposed amendment to the Land Use Element of the General Plan of the City of Carlsbad would set the limits and density for. the residential mul$iple zones on Pi0 Pic0 Drive. For the property zoned R-1-7,500 that would be wi.thin the multiple area, it would be recommended that the RD-M ' zone be utilized for development. To remedy the presen' problem that exists with existing R-3 zon.ed properties, it would be the intention to solicit approval from the property owners to rezone present R-3 to RD-M, provided the amendment is adopted. To limit the adverse impact that existing R-3 density could have on this R-1 area 3 . -3- 1 )f the community, it is recommended that the densities >e limited to low-density (0-20 .units per acre). rlr. Agatep introduced several graphics which outlined the proposed area of rezoning, existing residences, nnd the present zoning in the area. rh.e chairman asked for comments. Mr. Osburn asked for i-P zoning to be incorporated into the study area. Mr. lgatep informed Mr. Osburn that the proposed amendment Mould only set densities for the area and that R-P coning would not be disregarded as a potential zoning For the area. liscussion ensued among the commissioners and staff re iensities according to the General Plan versus the iensities,allowed under R-3 zoning. i4rard W. He said that if the 1,arking is increased as under RD-M zoning, the density vould have to be decreased to provide for additional larking spaces. Ion Briggs,,Jr., 4115 Sunnyhill Drive urged&the commis- ;ion to amend-the parking ordinance (increasing off- itreet parking requirements) as he feels that is a najor problem. He believes the area is suitable for motels or professional buildings. .A The commission felt their decision should be delayed rntil after the meeting between staff and the concerned lroperty owners on November 10, 1971 in order to arrive it a more valid solution. \ motion was made to delay adoption of the Resolution )f Intention until after the meeting with the property )wners. :b) Proposed reclassification in zone from R-P to C-M ind adoption of a specific plan for Peachey Reese, et a Ir. Agatep read a memorandum from the Planning Depart- lent to the Planning Commission re the application by :ranees Peachey-Reese, et a1 - to reclassify properties located westerly of Roosevelt Street between Laguna )rive and Beech Avenue. This matter has been continued )y the City Council to allow the Planning Department ;o initiate action recommending a zone change and Idoption of a Specific Plan on the sub.ject properties. ‘he’specific plan would review all potential land uses knd designate developmental criteria for each land use illowed in the C-M zone. Mr. Agatep informed the :ommission that the staff is in the process of formu- lating a specific plan which will be resubmitted at a ‘uture date. Motion Ayes Noes Absent , COMMISSIONERS CITY OF CARLSBAD -4- ~~ ~ 7(b) 'Continued' Items Attachment 70.24 Off-street Parking in R-Zones: Mr. Agatep read 1 memo from the Planning Department to the Planning :ommi'ssion re proposed revision of off-street parking *equirements in R-Zones. The memo outlined the pro- gress of the revision of the parking requirements ;ince April, 1971. The staff feels that as residential lroperties develop, especially multiple zoned propertie the need for an effective off-street parking ordinance till be more and more evident. The department recom- nended a.Resolution of 1ntention.be adopted to set a Iublic hearing date to amend the off-street parking )rdinance. 'he commission made several comments re the proposed imendment. After discussion, a motion was made to pass ;he Resolution of Intention 81 setting a public hearing late of December 14, 1971 to consider revision of the Iff-street parki.ng requirements.
