(b) VARIANCE - Request for a variance to reduce the required rear yard from 12.0 feet to 8.0 feet on pro- perty located at 231 Normandy c Lane; Appli'cant: Nagle """"""""""""""""""""""""""" The Associate Planner presented the staff report, illustrated the location of the property, and explaine the type of variance desired by the applicant. The applicant, B. T. Nagle, 19255 Rowland, Covina, California, made comments regarding his request and answered questions. Mr. Don Hoffer, who owns property across the street from the requested variance, said he had'no objections since he had been granted a similar variance.. No one spoke in opposition. The public hearing was closed at 7:52 P.M. The commission commented that the requested variance meets the necessary criteria. A motion was made to adopt Resolution No. 788 for reasons as outlined in the staff report. (c) PRE-ANNEXATIONAL ZONE C.HANGE & ADOPTION OF A MASTER PLAN - Request for a pre-annexational zone change from San Diego County A-1-(8) to Planned Community (P-C) and adoption of a master plan on property .located easterly of E1i:ICamino Real, and southerly of Marron Road extension; Applicants: Larwin Company """""""""""""""""""""".""""" Mr. Darrell Dalton', representing Larwin, Inc. in San Diego, requested the audience be polled to determine how many persons were present to speak in opposition or in favor of the proposal. Only one person raised his hand, so they decided to proceed. The staff's .report, dated May 23, 1972, was read by Mr. Agatep. The location and master plan was illus- trated. Reasons and conditions of approval were also given.. The commission had several questions regarding park dedication, approximate number of children added' to the school system, and d.edication fees for school site. Yr. Darrell Dalton, 6150 Mission Gorge Road, San Diego discussed the proposal at length. He showed slides of two different townhouse developments built by Larwin 3nd explained the homeawners' association and their responsibilities. The Tanglewood development of 1200 Jnits in Cypress, California which was begun in 1964 by Larwin was illustrated by slides. Also, the Tiburo project (500 units) in Fountain Valley, Ca1iforni.a Mhich is 3 years old was also illustrated. Mr. Dalton 3lso discussed the type of persons living in townhouse versus single family homeowners. The commission had several questions whi'ch. were answered by the appl icant. Mrs. Betty Wollrich, 4150 Skyline Road, was present to endorse the applicant's project on behalf of the Parks & Recreation Commission. No. one was pr-esent to speak in opposi'tion. The public hearing.was closed at 8:39 P.M. The commission, after a short discussion, felt that the project would be an asset to Carlsbad. Therefore, a motion was made to adopt Res. No. 789 subjectto reasons and conditions as given in the staff report. " (d) ZONE CHANGE-& ADOPTION OF A MASTER PLAN .- Request for a zone change from R-1-15,000 to Planned Community (P-C) Zone and Adoption of a Master Plan on 59 acres of property located at the end of Sunnyhill Drive, Clearview Drive and Skyline Drive; Applicants: Pannonia Investment Co. """"""""""""-c--"""-~"-n-n-""-",""",~ Discussion ensued regarding the possible continuance of this application. The applicant wanted to proceed and then continue if necessary. Mr. Agatep presented the staff report and illustrated the location and different phases of development on maps an.d graphics. An adendum to the staff report, signed by the City Manager, was read regarding dedication of school land or fees in lieu of dedication agreement. The commission had'several questions of the staff regarding the breakdown of bed,rooms in each unit, street patterns, etc. The secretary read the coprespondence, A petition with 52 signatures, a ltr. from Richard C. Campbell, a letter from.Vicki Campbell, a letter from Century Southwest (Mr. John Prewitt), a ltr. from Mrs. George Windrum, and a letter from Donald A. Briggs,-Jr. was read by the secretary. Mr. Agatep commented that Mr. Prewitt, per telephone conversation, wished to endorse the development. Park dedication was discussed by the Associate Planner and Chairman, the number of units were discussed, etc. Mr. John Klug, 26921 Canyon Crest, San Juan Capistrano was present to discuss the proposal, Mr. Bob Ladwig of Rick Engineering, 3289 Donna Drive, Carlsbad, discussed the Hillside Drive aljgnment. Mr. Klug requested a continuance to determine the extension of Hillside Drive. Commissioner Palmateer commented that the Citv should precise plan the circulation in this qr'ea. He asked for a map of this whole area to be prepared for the next meeting showing the circulation. He asked that tjne.:person_be assigned to speak,for a group in conservation of time. NO o.ne was'present to speak in favor of the proposal. The following persons Lspoke in opposition: Ben Taylor, 4240 Clearview Drive objecting on the basis of no access to the lagoon through the develop- ment. Don Pan'ska, 4265 Skyline, suggested that thl's whole area be planned by one developer in coordination with the City staff. -He also asked where the contribution to Carlsbad was, i.e. schools, roads, Agua Hedionda. Mr. Richard Campbell, 4134 Skyline made comments in opposition. Edna Glissman, 4400 Park Drive commented regardlng Hillside Drive. Mrs. George Windrum, 4230 Clearview Dptve had question regarding tbe P-C concept, The public hearing was closed at 1O:OO P.M. The chairman asked the Associate Planner how long it would take to resolve the following items: park site, school dedication, walkways, bicycle paths,real Tgnment of Hillside, drainage, sewer, Master Plan for circula- tion. The Associate Planner commented that the.,major concern was the alignment of Hillside Drive and the applicant feels he can resolve this matter before the next regular meeting. After discussion, it was declde that June 27th would be an agreeable date to continue the hearing to. Commissioner Palmateer commented that commitments from adjacent property owners re circulation should be submitted. Mr. Agatep answered questions regarding the P-C concep for Commissioner Norman, i.e. density, circulation, land use, open space. Comrnissione.r Palmateer made a motion to continue the public hearing until June 27, 1972. NEW BUSINESS: The Associate Planner commented on upcoming hearings and applications received. OLD BUSINESS: Mr. Agatep elaborated on the progress of the General Plan Amendment on Pi0 Pic0 Drive for Commissioner Norman, COMMITTEE REPORTS: None ADJOURNMENT: The meeting was adjourned by proper voic vote at 10:20 P.M.
