A letter was presented and read from Reach Colony requesting extension on Tentative Map CT 72-4. 2. A letter from American Title Co. naming William Zongker as the new owner was presented and read. Staff was asked to prepare and submit request to the Planning Commfssion so that extension might be granted prior to final MOTION X date of the tentative map. NOES PUBLIC HEARINGS: (a) Continued - PRE-ANNEXATIONAL ZONE CHANGE & /3 MOTION X ABSTA I-N X X IFIC PLAN - Request frtled by Systems Capital Corporation (Hughes) for a Pre-Annexational Zone Change from County A-1-8 to City of Carlsbad P-M (Planned Industrial) and Adoption of Speclfic Plan on property located south of Palomar Airport Road and west of El Camino Real. ........................... Mr. Agatep presented the staff report and with the USE of graphics and a special site plan illustrated the development planned by Hughes. He explained that the development is currently in the County and building will be in San Diego County area, that this project has the prior approval, 'application and.E.I.S., of the County Planning Commission,and that Staff endorses their findings and condihdons. After a short discussion between Staff and Commission, Mr. Bruce Highstreet, General Manager in charge of production at the Oceanside Hughes Plant made a pre- sentation which set out the history of the organizaticn since first coming to this area 13 years ago. up to the present plans for developing the erea referred to in their application. He advised that while the appli- cant agreed with most of the conditions contained in the staff re ort, he was very much opposed to the con- dition (No.9 Y referring to sewer connection charge. Several questions were directed to Mr. Highstreet by the Commission. ."- I- 'I CITY OF CARLSBAD There was no one present to speak in favor of, or in opposition to the proposed project and the public hearing was closed at 8:45 P.M. At this point, the City Attorney advised the Commissi regarding Condition No. 9 (Sewer Charge). He explain that there was no ordinance now in force to cover thi charge and that staff had been advised to start makin provisions for this kind of sewer charge (where taxes are not paid locally) by proposCng an ordinance to the City Cou-ncil. He further offered four alternative ways to pass on the application - 1. Reject; 2. Ac- cept the recommendations as they are; 3. Modify the recommendations; or 4. Recommend approval on the firs eight conditions and forward to City Council leaving Condition No. 9 to their discretion. It was moved that the Commission approve this application as set out in the fourth alternative suggested by the City Attorney. The motion carried. There was a short discussion whether or not the Com- mission was required to act on the E.I;R. submitted to the County in November of 1972. The City Attorney advised it was not necessary and earlier minute motion was withdrawn. (b) Continued - TENTATIVE TRACT CASE NO. 72-20 - Request filed by La Costa Land Company for appro Val of a 269-lot residential development located at the northwesterly intersection of the propose La Costa Avenue Extension and Rancho Sarnta Fe Road to be known as La Costa Vale Units 2-4. """"""""""""""""""""""""""- Mr. Agatep advised that a letter had been received from Rick Engineering Co. requesting continuance to the regular meeting of March 27, 1973. Motion was made to this effect and carried. (c) Continued - ZONE CHANGE & MASTER PLAN - Request filed by Andrew McReynolds for approval of Chang of Zone from R-1-10 to P-C (Planned Community) Zone and Adoption of a Master Plan, on 36 acres located on the east side of 1-5, south of Palo- mar Airport Road. ' """"""""""""""""""""""""""~ Staff recommended continuance of this item to the regular meet4Bgcj,dif April 10, 1973 to allow sufficient time for staff to assess the draft E.I.S. and Master PLan submitted on Gebruary 22, 1973. Motion was mad approving the request and the motion carried. SP-101 - Request filed b.y Arthur Dotv - ECO West for approval of a Specific Plan to illow development of an apart ment complex consisting of twenty (20) two- bedroom units. -,-,-- -. """"-"""""""""""""""""""""" Mr. Agatep advised the Commission that a telephone call had been received late that afternoon requesting continuance of this item for one month due to illness of applicant's represeatative. Motion was.made to grant the request and the motion carried. UNFTNISHED BUSINESS: (a) 'Contlnued - TENTATIVE .TRACT .CASE NO. CT 72-37 - Request filed by Carlbbad Beach and Tennis Club Partnership for approval of a subdivision to facilitate the development of a maximum of 84 condominium units on 2.91 acres of land area on the east side of Carlsbad Blvd., south of Sequoia Avenue. (b) Continued - TENTATIVE TRACT CASE NO. CT 72-38 - Request filed by Seaview Partnership for approva of a one-lot subdivision to facilitate the'de- velopment of a maximum of 41 condominium units of 0.92 ac#!ee of land area on the east side of Carlsbad Blvd., south of Tamarack Avenue. """"""""""""""""""""""-"""" Mr. Agatep advised that a letter had been received from Rick Engineering Company coqcuPring with the recommendation of staff that the two items referred to as 6 (a;) and (b) be returned to applicant until a1 the necessary information is assembled and ready for presentation to the Commission. Motion was made to this effect and the motion carried. (c) REPORT - CITY COUNCIL ACTION ON PROPOSED REVISIC OF THE ZONING ORDINANCE RELATING TO SIDE-YARD SETBACKS. Planning Department .......................... The staff report was presented by Mr. Agatep, based on action taken by the City Council. The report contained the recommendation of the Council that CITY OF CARLSBAD /". (4) Paragraphs 3. B & C be eliminated from sugqested re- visions to Title 21, Sections 21.08.040 (a) (2), 21.10.040 (a) (2) and 21.12.040. It was recommended that the revision proposed by the Council be approvec and the Council so advised. Motion made to this effect carried. NEW BUSINESS: (a) TEBTATI-VE TRACT CASEYNO.CT 73-3 - Request filec by R.D. Miller for approval of a one-lot sub- . division to allow development of a 21-unit con- dominium project on 0.72 acres of land on the west side of Ocean Street, between Grand and Elr Avenues. .......................... Mr. Agatep presented the staff report recommending approval to the Commission upon execution/fulfillmeni of the conditions contained therein. He also advised that all E.I.A. requirements had been met. There wa! again some concern regarding the sewer'capacity in that area. Mr. Robert Miller, Architect, representative of the applicant was present. He had a question regarding the parks in lieu fee and was advised tha% this ap- plied to all subdivisions. He also explained that the application included plans for a holding tank fol sewage and that the tank would be activated during the off-peak hours.: , There was no one present to speak in favor of, or in opposition to the proposed project and the public hearing was closed at 9:30 P.M. There was a short discussion by the Commission after which a motion was made to approve CT 73-3 subject to Conditions 1-9 adding No. 10 re: underground utilities. The motion carried. (c) TENTATIVE TRACT CASE NO. 73-6 - Request filed by Costa Verde Associates for approval of a one- lot (1) subdivision to allow development of a 24-unit condominium pnsject on 1.27 acres of lan generally located on the south side of Navarra Drive between Viejo Castilla Way and the wester1 terminus of Navarra Drive, to be known as Costa Verde. """""""""""""""""""""""""" report Mr. Agatep presented the stafflsetting out their reasons and conditions for approval. He advised that all E.I.A. requirements for this application had been met. There was no one present to speak in favor of, or in opposition to the application and the public hearing was closed at 9:50 P.M. After a short discussion, &'-motion was made to ap- prove CT 73-6 and the motion carried. (d) RESOLUTION OF INTENTION NO. 90 - Amendment to Title 21 of the Carlsbad Municipal Code re- garding Front Yard Setbacks. Initiated by the P1 anning Department. """""""""""""""""""""""""" Mr. Agatep gadc the staff report recommending that the Planning Commission consider adopting a Reso- lut.ion of Intention to Amend Sections 21.08.030, 21.10.030 and 21.12.030 of the Municipal Code regard- ing Front Yard Setbacks as the current zoning ap- plies only to the RD-Mazoning district and this re- vision would provide more flexability in planning. After a brief discussion, it was moved that the Commission adopt Resolution of Intention and the motion carried. (e) REPORT - PARKING PROVISIONS Engineering Department .......................... A report on Parking and Driveway provisions being considered for presentation and action by the Com- mission was presianted by Tim Flanagan. He advised that this report was diretted mainly at multiple dwellings and that there was a need to develop some standard with regard to driveways and approaches. He also advised that a more complete report would be submitted at the next meeting.
