PLACE : CITY COUNCIL CHAMBERS I ROLL CALL: I City Staff Members Present: D.A. AGATEP, V. BTONDO, H. CLARK, T.C. FLANAGAN, J.B. ARNOLD, P. WILLIAMS AND M. ZANDER. APPROVAL OF MINUTES: The minutes of the regular meeting of April 24, were approved as corrected. WRITTEN COMMUNICATION§: A letter was read by the Secretary from Rick Engineerin Co. re: the La Costa Northeast Pre-Annexational Zone Change which is to be heard at a later date. IORAL COMMUNICATIONS: Commissioner Jose advised the Commission of a letter from the-Parks & REcreation Commission re: the movie, "Multip3y.A Subdue the Earth" which was to be shown for the Planning Commission, City Council and'Parks & Rec. Commission on Monday Evening, May 14th in the Library Conference Room. It was also mentioned at this time that this would be brought up later in the meeting,. IPUBLIC HEARINGS: l(a) Continued - CONDITIONAL USE PERMIT NO. CUP-76B - Reouest filed bv Andrew McReynolds for approval of Corhitional Uselpermit to aliow a 186.-space mobile home park development on property generally locate south of Paiomar Airport Road and east of Lowder IL L a n e """"""_""""""""""""""""""""" Chairman Dominguez explained that this application had been considered at the ptevious Commission meeting and that it had been continued to this meeting to allow for the presence of a full Commission as the voting had re- sulted in a tie at the meeting of April 24, 1973. Re edvised that there had been nofTone present,--to speak,for 8r.against this applicatien at the prevfsusthearing arsd that with the concurrence of Dr. McReynolds, the Staff would proceed with a summarization of the hearings on this matter to date. The applicant concurred, and Mr. Zander presented a summary of all actions taken by the Jommission regarding this development,including accept- ~ance of EIR, approval of Zone Change and Master Plan '(with modifications). He conluded his report with the /Staff recommendation for denial of the C.U.P. Several questions were asked of Staff re: allowed uses for the area; sewage treatment plant complaints, possi- bility of flood-plain presenting problem at a later time; other developments already under construction in the area. Dr.McReynolds spoke briefly re: the requested C.U.P. an asked for Commission ak.igroval. There was no one present to speak for or against this applicat+on and the public hearipg was closed at 8:OO. I COMMISSIONE :RS 'RESENT IOT€OWrl ,YES ,BSTAIN A motion was made to approve the C.U.P. and Mr. Biondo advfsed that Staff should be direckdd to prepare the Resolution with proper conditions and bring back to the Commission at the next regular meeting for formal adop- tion. Mr. Norman requested discussion prior to the vote The motion failed on a four to three vote. I A motion was then made for denial of the C.U.P. and the motion carried. (c) EIS NO. 127, SP NO. 116 and CT. NO. 73-2 - Reques filed by LA COSTA LAND COMPANY for approval of Specific Plan to allow development of a 335-lot residential development on 111 acres of.land gener ally located west of Rancho Santa Fe Road between Levante Street and Olivenhain Road. I """"""""""""""""""""""--""----- Chairman Dominguez advised the Commission of the re- commendation of Staff that this item be continued to th meetingof May 22, 1973. The Secretary then advised tha a letter had been received re: this item.. The letter was addressed to the Planning Commission "Gentlemen: On behalf of La Costa Land Company, we agree with the Staf recommendation of a two week continuance to the meeting of May ZEnd.''Sincerely, Rick Engineering Co.". There was no one present to speak for or against this contin- uance. Motion made to cgntinue carried. (d) EIS NO. 129, ZC NO. 109, MP NO. 108, SP NO. 115 and CT NO. 73-8 -. Request filed by DOUGLASS- PACIFIC CORPORATION, to allow a 323-unit condomini development on 63 acces of land generally located on the west side of El Camioo Real between ChestnL Avenue and Kelly Drive to be known as "Carlsbad Pal i sades" """""""""""""""""""""""""""- Mr. Zander presented the Staff's analysis of the Envi- ronmental Impact Report rreaerived fipo~lDoB~~as~a8aCibic He commented that the report was complete, one of the best received by Staff to date and recommended that the Commission accept the EIS as presented. It was suggested by Dr. Palmateer that perhaps this report should be used as a model for future environment impact statements. Mr. J.J. Johnstol ouglass-Pacific, and advised of another letter having een received by STaff regarding schools. The letter ocMr. Johnston set out information regarding an agree. snt between Douglass-Pacific and the Carlsbad Unified chool District. Chairman Dominguez suggested that an OD.~ of thisLagreement should be made a part of the,Ci. ecordd. Without further discussion, the public hearin! n EIS No'. 129 was closed at 8:30. Motion made to accel he EIS carried. r. Zander then presented the Staff's report on the equest for approval of Zone Change (109) and Master lan (108). The report set out the reasons and condi- ions for approval and Staff recommended the addition f Condition No. 3 re: Master Plan No.108 - 3. Prior tc earing a Specific Plan on this project, the applicant hall enter into a mutual agreement with the Carlsbad chool District in order to help mitigate the impact hat this development will have on the Carlsbad School! pproval of this additional condition was made by minui otion. r. J.J. Johnston, Project Manager for Douglass-Pacific orporation, addressed the Commission re: the proposed evelopment. He presented historical date, including esults of a survey,ma€le by:his;fiirm, of the residents f the surrounding area and agreements between his fir1 nd these residents re: slope and grading. Mr. Johnston was commended by the Commission for his fforts to contact as many of the local residents sur- ounding his development as possible. her ati e was no one present to speak in favor of the appl on and the opposition included: Mr. Max Amoss - limit the number of large develop- ments in Carlsbad and do not approve commercial zoning in the development; also, concerned with area immediately south of the proposed developmen and north of Kelly Drive 4ith regard to fire. . Mr. Little, Planning Commission, reported that he had received two calls prior to the meeting - A. Unidentified caller opposing the development. B. Mrs. Betty Wollrich, in favor of develppment. t this time, there was a request from the audience fo he applicant to return to answer some questitbns. The hairman advised that questions would be answered when 11 of the testimony had been given. . Allen Stelmach had a question regarding the size of the pro- ject, whether it consisted of 350 or 323 units, and if the developer was aware that the residents of Carlsbad had turned down a tax overrdde for the 4th consecutive time. Mr. Johnsjzon advised that $171,000 had been paid to the City in fees and that an -agreement was made wi the schools. There was no further testi-mony in favor of, or in oppo sition to the application and the public hearing was closed at 9:30 . After a short discussion, a motion was made that Zone Change No. 109 and Master planNo. 108 be approved ac- cording to the recommendations of Staff and the con- ditions provided therein, and that the Commercial Zone be deleted as advised (Parcel in the Master Plan) and that those four acres should become PIC. The motion unanimously carried. (f) ZC- NO. 113 and SP NO. 113 - Request filed by M.S. HUMPHREYS for approval of Change of Zone from R-1 to RD-M and adoption of a Bpecific Plan to allow construction of 188apartment units , plus existin residence, on 1.3 acres of land generally locate on the southeast corner of Monroe Street and Ches nut Avenue. """"""""""""""""""""""""""- The Secretary read a letter from Mr. Cart F. Reinholz, Architect for -Mr. Humphreys, requesting"a continuance of this matter to the meeting of June 12, 1973 and motion made to this effect carried. (9) ZC NO. 112 and SP NO. 111 - Request filed by CARLSBAD JOURNAL (BRIEN M. MANNING) to allow Chan of Zone from R-P to C-2 and adoption of a Specifi Plan for constauction of new Carlsbad Journal offices/two professional offices on property gen- erally located on the west side of Jefferson St. between Arbuckle Place and Laguna Drive. ........................... Staff, upon request by applicant, recommends continuan of this item to the meeting of May 22, 1973, to allow applicant to be present at the hearing. Motion made for continuance carried.' At,this time, the Commission was advised that no actio had been taken regarding the Specific Plan and Tentati Map for "Carlsbad Palisades" Item No. 5(d) on the Agenda. A motion was made to table the item, but at th request of the applicant, the motion was changed to continue the item to the meeting of May 22nd and the motion carried, The meeting was adjourned at 9:45 and all those ppesen at the time of adjournment were again present when the meeting reconvened. It set out their reasons for recommendigg denial of this application - questions regarding the property line, other design options that would not require a variance and that a fire hazard would result by construction of the garages as planned. There was a lengthy discussion by the Commission and Staff regarding the application and some of the infor- mation which had been presented. Mr. C.F. Nooncaster, 2065 Linda Lane, was present and offered to clear up some of the questions being asked by the Commission. There was no one present to speak in favor of the appl cation and speaking bn opposition was Mr. Hatchman, 571 Kingley, Arcadia, CA. Further discussion concluded with a recommendation by the Chair that this item be continued to the meeting of May 22nd and motion made to this effect carried. UNFINISHED BUSINESS: (a) Continued - CONDITIONAL USE PERMIT NO. CUP-82 - Planning Commission Resolution No. 782 (Mrs. H. Vickeryj - REquest by DEWHURST & ASSOCIATES to be heard concerning CUP-82 - Plannin$ Dept. -. ." """"""""""""""""""""""""""" Mr. Agatep presented the report from Staff regarding this item and Mr. Dewhurst's request for an amendment to the original CUP (Reso. No. 782). The City Attorne advised that there was no provision forthse8ode for extending the CUP, as was requested by Mr. Dewhurst, w appeared briefly before the Commission . It was recom nanded that a new application be filed and the hearing be set according to procedure on CUP applications. VEW BUSINESS: (a) REPORT" Review Plans & Specifications for Tennis Courts at Park & Kelly Drive - Engineering Dept. Ir. Flanagan peesen.ted the report on the plans for the lew tennis courts. He advised that they were to be lighted and that funds were available,throught the par in lieu fees. A short discussion follwed after which the motion made to approve the Tentative Map according to conditions 1-7 outlined in the Staff report with the modification to Cond. No. 7 regarding school. CT 73-15 - Requeet;filed by GOLF VIEW INVESTMENTS LTD. to allow developmen- of a 5-unit condominium project on land located 01 the north end (cul-de-sac) side of Jerez Court between Gibraltar Street and Jerez Court, to be known as GOLF VIEW VILLA. ........................... The staff report was presented by Mr. Agatep setting forth their reasons and conditons for approval. There was a question again re: Condition No. 7 . Motic was then made to approve the Tentative Map according tc Conditions 1-7 (7 modified) and the motion carried. (d) TENTATIVE TRACT CASE NO. CT 73-22 - Request filed by B.F. CHASE (TRES VERDES, a Limited Partnership' to allow a 36-unit condominium development on property generally located on the north side of La Costa Avenue between El Camino Real and Viejo Castilla Way to be known as TRES VERDES. I( ........................... The Staff report was presented by Mr. Flanagan. He advised the Commission that this Tentative Map had the prior approval of the' County Planning Commission and they were applying for appooval for Final Map. Staff recommended approval based on their finding that the map conformed with the State Subdivision Map Act and the applicable local ordinances. Commissioner Little recommended that the Planning Commission endorse the annexation of Palomar Airport and this endorsement was made by minute motion. Commissioner Palmateer asked for the consideration of the total alighment of Tamarack and the Planning Dire( tor advised that this was one of the Critical Areas be- considered by the City Council. A motion was made to bring this to the attention of the City Council and should become a part of the Master Plan of the City.
