A.zone change had been approved earlier this year for the entire pro1 erty and Mr. Williams advised the Commission that the environmental information was supplemental and present1 as information only. He informed the Commision that an agreement (copy attached to report) had been made betwl the Encinitas School District and the applicant regard schools. It was the recommendation of Staff the Specif Plan and the Tentative Map be approved subject to the conditions outlined in their report. There were questions from the"Commission concerned wit the size of the lots proposed in the subdivision and especially those under 7500 sq. ft. (6300 sq. ft.), an' just how many of these.'lots there would be in the sub- division. Furt-her questions were asked regarding circ lation. Mr. Flanagan, Engineering, advised that there was no circulation elemenf'as this property was origin included in the San Dieguito Master Plan. There were also questions regarding the amount of useable open space in the development. Mr. Lyle Gabrielson, Rick Engineering Co., 5620 Friars Road, San Diego, expressed his concern for some of the conditions contained in Staff's report, and, in fact, requested removal of five conditions (A-E"on Pg.5). He also questioned No. 16 - installation of traffic signa as all improvements for that intersection had not been comp#&ted. It was the request of the City Engineer tha the conditions be left as they were. Mr. Gabrielson answered the question regarding the number of 6300 sq. ft. size lots proposed for the sub- division as being about 20%. .. There.was-nMt anyone presenCdto speak for or against this application and the public hearing was closed at 8:30 P.M. In the .discussion that followed, concern was expressed for servicing a subdivision that had no direct relatio ship to the rest of the City, and for planning a stand subdivision with smaller size lots. Densities were 'also-discussed as they applied to the surrounding prop erties .which ha'd been previoualy .approved. Staff ad- vised that the density proposed for this development was less than that approved for the surroundi.ng area. Mr. Agatep then advised that no acti0.n was required on the environmental information. Comm. Wrench mbved for denial for the reasons - 1) the lot sizes proposed sub vert the intent of the P-C Zoning, and 2) Circulation element has not been adequately considered for the Specific Plan; and that the design of the subdivision was not consistent with the intent of P-C Zoning. The motion carried. COMMISSIONERS I ¶ W n d MOT ION AYES NOES 1. CITY OF CARLSBAD (e) CASE NOS. EIS-188, ZC-125 and MP-132 - Request fo Acceptance of Final EIR, Appyoval of Zone Change, and Adoption of Master Plan to allow a 400 unit residential development - PACESETTER HOMES -Porti of west half Section 21, T-12-S, R-4-W, SBM - Eas of Lowder Lane, midway between Palomar Airport Ro and Poinsettia Lane-From E-1-A (County) to P-C (Planned Community). ........................... The Staff report was made by Mr. Williams. He a.dvised the Commission that a revised EIR has been submitted t them for their consideration-and that Staff's recommen dation was that the Final EIR be accepted. Additional information would be submitted asfuture applications are made. The report contained information regarding densities - applicant was requesting 7 du/ac - and thi was not in conformance with the General Plan - Staff was recommending 7 du/ net acre. He also advised that City Council policy stated no General Plan amendments until the revision is completed. Also, that this reque does.not warrant an amendment- to the General Plan. Con ditions of approval of this Master Plan were set out by Staff including limiting the density to 7 du/net ac and requireing an archaeological field check of the si as advised by the Museum.of Man in San Diego. There was no further discussion and the public hearing was declared open. Mr. John Klug, Pacesetter Homes, San Juan Capistrano, the applicant, informed the Com- mission he would answer any questions they might have. There was no one else present to speak'in favor of the application.. Speaking in opposition to the proposed develo'pment was Mr. Dan Cari.sio-Prop. Owner in Alta Mira and Vice- President of Mgmt. Assn. No. 1. He asked why no one i the Alta Mira development was advised 0.f th.is appli- cation and questioned the availability of schools. He also expressed concern that enough information is give during the public hearings. At this time, the City Attorney advised that sufficient information is furnis to the Commission for their consideration. -He also in formed that citizen input is r'equested by notification made in the local paper and the posting of notices. He felt that every opportunity is given to allow the pub to supply this input. Mr. Agatep also advised that th City uses two methods of notification - 1) newspaper and 2). mailing of notices to property owners within 300 feet radius. There was no one else to speak in opposition to the proposed development and the public hearing was closed at 9:30 P.M. Mr. Klug then furnish further information re: school requested by Commission After a short discussion, it was-moved that the EIS be accepted a57 the Final EIR and the motion carried. Comm. Forman then moved that the Change of Zone be approved as recommended by Staff and the motion Carrie There was a brief disucssion before the decision was made to'deny the request for approva1,of a Master Plan A motion was made to this effect and the motion Carrie denial based on stated City Council policy at this time. EIS-37 and CT 72-4 - Request for Acdepta of Final EIR and Consideration.of Tentative Map (Extension) (CT 72-4 Not Public Hearing) to allow a condominium project - WILLIAM L. ZONGKER -Portio Section 23, southerly Section 32, T-12-S, R-4-W, west of Old Highway 101, northerly of Batiquitos Lagoon - P-C """""""""""3--""""""""""""""""- Mr. Zander made the Staff report giving some historical background on this application and advisinq that since the original'application was filed the Dr0Dert.Y had changed ownership When the new owner, Mr. Zongker, applied for tentative map environmental impact infor- mation was required.. Staff's review of the information submitted by the applicant points out the many siqnifi- cant impacts this development could cause, and it is their recommendation that the Commission accept the EIS as the Final EIR for the proj-ect. Mr. Agatep gave that portion of. the staff report relatina to the tenta- tive map. It was the recommendatSon of Staff that the application be denied on the aDplication .as it now exists under the purvi.ew of the adopted General Plan, and as it was approved in 1971-72.. There was no one present to speak in favor of the pro- ject. Mrs. Barbara Stewart, Carlsbad, expressed her oppositto to the project and requested that the Commisston deny the application. There being no further public comment, the public heart was closed at 1O:lO P.M. A short discussion followed during which the Chairman recommended following the recommendatlons of Staff. It was moved that the EiR be accepted 'as the Final. and the motion carried. A motion was then made for denial of the application to be recommended to the Cit Council for the reasons outlined in Staff's report. The motion carried. (9) CASE NO. V-229 - Request for Consideration of Var .-'ante to allow a panhandle lot split - C.ONSTA?ITINO MEDINA, JR.- Portion of the northeast 1/4 of the northwest 1/4 of Section 6, City of Carlsbad, on the north side of KNowels Avenue westerly of Elm- wood Street - R-1-7500 ........................... The Staff repo'rt was made by Mr.. Williams outlining their reasons and conditions for approval of this appl cation for a variance to allow a panhandle lot split. He advised that all EIA requirements had been met and that there were no school requirements since this was not a subdivision. Mr. Constantino Medina, Jr., 1677 Buena Vista Way, was present and declared his willingness 'to meet the con-' ditions set out by the Commission. There was no one present to speak for or against the application and the public hearing wa's closed at 10:25 P.M.. - ce MOT AYF MOT AYE NOE . I I S I S S COMMISSIONERS 7 - CITY OF commissioner Little pointed out the possiWlity of the development of four large lots in the area and a numbe of panhandle lots that could be created, and suggested that the Commission should perhaps place the condition re; schools in addition to those recommended By Staff. Without further discussion, a motion was made granting the requested Variance with an amendment to include the standard school conditions as Condit6on No. 11. The motion carried. (h) CASE NO. V-230 - Request for Consideration of Variance to allow reduction of required rear yard setback - J. TUSHINSKY - Lot 107, La Costa Valley Unit No. 1, (2086 Playa Road ) - at the easterly most extension of Playa Road, easterly of the intersection of Playa Road and Estrella De Mar Rd .. I Mr. Williams made the Staff report setting forth their reasons and recommendations for approval of the reques variance. He explained that the existing structure wa built under the auspices of the County and advised’b,tha the.structure.had‘beennbuil4l with a substandand back yard. He also advised that the structure was built adjacent to a permanent open space (Golf course) and that these circumstances did not generally apply to other property in the same vicinity. It was the opinio of Staff that the granting of a.variance would not ad- versely effect the General Plan. Rr. P. Lester, Architect, 13190 Carousel Way, Del Mar, was present representing the applicant. There was no public Comment in favor of, or i.n oPPO- sition to the application and the Public Hearing was closed at 10:40. I (i) CASE NO. GPA-17 - Request for Amendment to Gener Plan to provide for the full possible range of residential densities from 0-67 du/ac - PLANNING COMMISSIQPJ-INITIATED ””””~”””_”””~”””~”””““~“”””“” Mr. Agatep advised that the General Plan Amendment had been initiated by^ Resolution ‘of Intentilon;,N&.b .94 at thei+ previous meeting. The staff report was made by Mr. Williams advising thi the recommendation for amendment was based on the lac of provision by the present text of the General Plan for the Full possible range of residential densities from 0-67 du/ac., and that this amendment would elimi nate this potential problem by coverinq all designati There was quite a lenghty discussion by the Commissio with Staff regarding the text changes to be recommend to the City Council. On Page 2, Para. 5, 43 units was changed to 47. On Page 2, Para. 7 was elirninatdd in its entirety. Mr. Perry Lamb, 5171 Shore Drive, addressed the Com- mission that another public hearing might be called. for in light of the changes that were being made. -He felt the Resolution of Intention did not include all these changes. There was no one else present to speak in favor of, 01 in opposition to the proposed amendment and the Public Hearing was closed at 10:55 P.M. Without further discussion, the motion made to approvc the amendmknt as modified in the Staff report carried., UNFINISHED BUSINESS: (a) CITY COUNCIL RECOMMENDATION ON APPEAL OF PLANNING COMMISSTON DECISION RE: DENIAL 0.F CANNON CONDOMINIUMS Mr. Agatep gave the report on the appeal to the City Council of the decision of denial by the Commission or request of W.D. Cannon for zone change, decision made at the regular meeting of the Commissi-on on June 26, 1973. He advised that the Commission initiate a Reso- lution of Intention to amend the General Plan as recommended by the Council. The Commission by minute motion concurred with the recommendation of the City Council that the appropriat zoning for the project be RD-M instead of R-3, as requested by the applicant. NEW BUSINESS: (a) CASE NO. CT 73-5 - Request for Consideration of Tentative Map to. allow a.39 lot single familv sub division - JERRY L. ROMBOTIS (Laguna Riviera-No.8 Secretary Agatep advised the Commission that a letter had been received from the applicant requesting con- tinuance of this item until September 11, 1973 due to circumstances beyond his control.. After the reading of the letter, a motion was made granting the request for.continuance and the motion carried. (b) CASE NO. CT 73-34 - Request for ConsiderationLof Tentative Map to allow a 44-unit, one-lot condo- minium development - N.H.A. The Commission discussed the number of parking spaces' covered and open, as set out in Staff's report (18 COI and 14 open). After a short discussion, .motion was mi for approval of the tentative map subject to the con- ditions outlined in the Staff repert and with the following change - 74.covered and 14 open parking spaces. The motion carried. (c) CASE NO. CT 73-12 (Revised) - Request for Con; sideration of Revised Tentative Map - Revision includes an additional 1.2 acres to be utilized for open space and recreation (per Specific Plan' only - D.R. GRAY CONSTRUCTION CORP, INC. - Lots 370,371, 372 and 373, La Costa South Unit No. 5, and portion east one-half Section 36 - at the northeast corner of the' intersection of-Gibraltal Street and Jerez Court """"""""""""""""""""""""""- Mr. Williams g.ave the STaff report on this item, ad- vising that prior action by the Commission approved a tentative map ( June, 1973). This request included additional land which was to be utilized as open spacc and recreation area only. Staff's recommendation was . for approval. Mr. B. Ladwig, Rick Engineering 509 Elm Avenue, appli- cants representative, requested approval by the Com- mission. The Commission discussed Staff's recommendation with reggrd to the Parks Ordinance and a motion was then made for approval of the revised tentative map with the modification of Condition No. 4 to inalude a re- quirement for park-in-lieu fees for the project. The motion carried. (d) CASE NO. CT 71-7 - Request for Consideration of Tentative Map to a-low a 21 unit condominium development - DIFCON; INC. - Lots 65.66.67. and 68 of Shelter Cove Map No. 1562 - Park' Drive and Marina Drive: """"""""""""""""""""""""""- Mr. Williams reported on this requestt>for approval of tentative map, explaining that this.project had al- ready been bujlt and was ready for sale. Map had bee previously approved by the City' Coonell on January 18 1972 and the expiration date of one year later had passed before the Final Map was ready to be filed. Staff recommended approval. STAFF ........................... Staff's repotrt on this item included background infor- mation on previous actions by the Commission and Counc with regard to Carrillo Rancho. In reviewing these actions, it was found that the Master Plam had been approved without any of the normal conditi0n.s being placed on the applicant. Staff suggested the initiati of a Resolution of Intention by the Commission to consider an Amendment to the Master Plan for Carrillo Rancho. A motion WSS made to this effect and the motion carried. LATE ITEMS: (a) CRITICAL PLANNING ISSUES POLICY - City Manager's Report " Mr. Agatep made the report on Developmental Policy as established by the City Council and infobmed the Commission of the City Manager's report advising them of his availability to discuss this matter with the Commission if they so des'ired. It was recommended that perhaps this could be discussed at an adjourned meetir (b) C.P.O. PRESENTATION OF REGIONAL DEVELOPMENT .. ALTERNATIVES Mr. Agatep advised the Commission of the receipt of a letter from C.P.O. to Mr. F. Lilley regarding a specie meeting with the City Councils of the cit'l'es in the North County on Wednesday, Sept. 19, 1973. The purpo: of this meeting would be to discuss the impacts of twc regional development alternatives. Carlsbad would be the host City, and as many as possible were requested to attend. The meeting was adjourned at 11:30 P.M. with the suggested date of Seppehher 21, 1973 for the next workshop meeting.
