EIS-185, SP-114 and CT 73-11-CARRILLO RANCHO - Request for Acceptance of Final EIR, Ador tion of Specific Plan and Consideration of Tentati Map (CT 73-11 Not Public Hearing) to allow a 255- lot subdivision on pnoperty generally located on the north side of Unicornio Street between Ave.De1 Paraido an$'€horlito Str'eet - """"""""""""""""""""""""""" Secretary Agatep read a letter from Ponderosa Homes re- questing continuance to a leter meeting. The Case Nos. referred to in the letter did not correspond with thosc on the agenda and it was reported to the Comm'ission the there was a typographical error on the agenda and the Nos. contained in the letter were correct. Secretary Agatep advised the Commission conversations with the applicants representatives earlier this date found then in agreement with tabling this item. Mr. C. Solozzo, Vice.-Pres. of Ponderosa Homes made a -brief appearance before the Commission advising them of their concurrenc with the rec.ommendation of Staff. Commissioner Jose moved that the item be tabled and 'thz the hearing be re-noticed at a later date. The motion carried. 5(b) CASE NOS. SP-140 and CT 73-45 - LOMA LAGUNA N0.2 - Reauest for AdoDtion of SDecific Plan and Consi- deiation of Tentative Map'to allow a 61-lot sub- division on approximately 21.72+ acres, generally located east of Carlsbad Tract 7155 and Park Drivc extension. """""""_"""""""""""""""""""" Secretary Agatep read a Tetter address to the Comissior advising them of the withdrawal of the Specific Plan application. They were further advised that the appli- cant would submit a requ.est for Change of Zone at a later date and. the applicant suggested the next regular meeting of the Commission. The Commission questioned whether two weeks was suffieient time in which to com- plete the plans. They were then advised that the chanc in plans had already been discussed with the Plan ning Department and application already on' file. Mr. Robert Ladwig, Rick Engineering, 509 Elm Avnue, thc applicant's representative, was present to request thal the continuance be granted. Graphics were used to demonstrate the time element in the processing of applications from the time they were received until final approval by the City Council (on those items required to be heard by th Council), - 5(c) CASE NO CUP-91 ALFONSO L. FILIPPONI - Request TOR Consideration of Conditonal Use Permit to allo the use of a resident care facility for developmen disabled adults on approximately 16.5 acres of lan generally located on the west side of El Cmaino Rea 1 ""-""""""""""""""""""""""""" The Staff report made by Mr. Zander outlined the histor surrounding requested CUP'S for this property. The Commission was advised there was an existing CUP on fil at this time, and that the CUP requested by Mr. Filippo was to e.stab1ish a care facility for training of -the developmentally disabled. 'The site is the Thunderbird Ranch located off El Camino Real where the original CUP al1owi;ng a non-resident "gpecial"schoo1 program is stil in effect. It was Staff's recommendation tha.t the new application be approved and that the existing CUP(No.27 be revoked, and the file closed. Staff based their recommendation for approval on thirteen conditions con- tained in their report to the Commission. Mr. A.L. Filipponi, 1414 Monument Hill Road, El Cajon, the applicant, appeared before the Commission to answer any questions they might have and to describerfin more detail the program planned for the facility. There were questions by the Commission concerned with whether or not this type of facility required State and County licensing. It was explained by Mr..Filipponi that li- censes were required, either from the San Diego County Welfare Dept. or the State Department of Mental Hygiene Mr. Filipponi also explained that there would only be about 15 residents on the property besides his family and. staff, and that a. total of about 24 pe6ple would actually be in residency on the property. He also ex- plained further that these people were screened quite thoroughly before being placed in a care facility of this type, and if they were not considered trainable, they would .hot .enjoy this privilege. There was no one- present to speak on behalf of the application. Mr. All an Kel ley, 4675 El Camino Real , Carlsbad, a-pear before the Commission with several questions, including whether or not the capacity of the buildings was suffi- cient to house the number of people that would be in- volved in this program; if five years, was too long a period of time before review of the CUP by the Commissi suggesting two or three years instead; and if some type of fencing shouldn't be required to prevent trespassing onto his property as this had recently become a serious problem. The Commission had several questions of Mr. Kelley regarding the problem with trespassing. It was then the suggestions of Mr. Kelly that a fence be in- stalled around the property for the purpose of stopping the trespassing onto his property. lith no further public response, the public .hearing was :losed at 7:55. a1 ly i d n, CITY OF CARLSBAD Quite a lengthy discussion followed during which the fencing of the property was discussed, the prior CUP on the property, and the fact that when the prior CUP was granted, building had not taken place on the sur- rounding properties. There were further questions of the applicant including whether or-. not fencing was a requirement by the County or State. Mr. Filipponi ex- plained that it was not. .He also advised that the samc disabled residents would not be at the facility al.1 thc time and that the decision re: those who would be livil there would be left entirely up to him. POWERS - Request for Consideration of a Variance to reduce the minimum required lot width from 60 ft. to 15 ' on property generally located southerly of and ad- jacent to Chestnut Avenue approximately20 ft. easterly of the intersection of Eureka Place and Chestnut Avenue, said street address is 1049 Ches, nut A enue. ........................... Mr.,Williams made the Staff report on the request for a variance, for the reason that the configuration of the lot had resulted in a hardship to the owner. He further advised that: the C4ty Panhandle lot policy wou apply and that Staff recommended approval., Commissioner Jose recomme.nded the addition of the stan, dard school condition. Mr. Harry Truax, E. Brian Smith Engineering, Carlsbad, applicant's representati've, questioned if the school agreement was 'legal on a lot split, and advised that hl could not agree to its addition, but would have to con tact the owner. The City Attorney then advised that tl was a discretionary action by the Commission and that they could add any condition they saw fit to add. There was no public response and the public hearing was closed at 8:40. After a short discussion by the Commission, the motion made for granting the Variance, with the addition of Condition No. 13 (standard school condition), carr,ied. PRICHARD'L - Request for Consideration of a Variance to increase the permitted sign aread from 2 sq. ft. to 145 sq. ft on property generally located south of and adjace to Palomar Airport Road between Macario Road(futu and Kelly Drive (extended). """"""""""""""""""""""""""" Staff report was made by Mr. Williams outlining their recommendations for approval of the requested variance a larger sign.than would be allowed under the require- ments of the sign ordinance. Justification of a large sign was based on exceptional circumstances applicable to the property, a recreation trailer park, and the fa that they felt the property had a unique use which-wou apply to only one to two properties in the area. Staf however, recommended that the variance be granted for a 92 sq. ft. sign, subject to the nine conditions con- tained in their report. Mr. B. Prichard, 3790 Valley, Carlsbad, applicant, ap- peared before the Commission regardingithe limitation to 92 sq. ft. Staff explained it was felt this size sign would permit sufficient advertising of the camp- ground. There was no public response for, or against, this application and the public hearing was closed at 8:50. It was moved -. the variance be granted limiting the sign to a total area of 92 sq. ft., and subject to the conditions recommended by Staff. The motion carried. 5(f) CASE NOS. ZC-136, CT 73-39 - SPINNAKER HILLS FORMERLY SEA RANCH-AYRES) - Request for Approval if Chan qe of Zone from P-C (Planned Community) to R-1-75 (Single-Family Residential) and Conside ation of Tentative Map (CT 73-39 Not Public Heari on property generally located easterly of and ad- jacent to Lagoon Cane approxt,mately 350 feet southerly of the intersection of Poinsettia Lane and Lagoon Lane, to allow a 333-lot (approximate) single-family subdivision. Mr. Williams gave the Staff report on the .request for Change of Zone from P-C to R-1-75 on approximately 6.5 acres parcel, and for consideration of Tentative Map CT 73-39 to allow a single family subdivision (333 lot on approximately 80.0 acres. He outlined Staff's reas for recommending approval of the applicants requests and for Staff's recommendation that Lots Nos. 1,288 an 289 be deleted (to be combined with adjacent lots). Applicant has requested that Conditions Nos. 4, 6 & 7 be deleted. These conditions contaZned recommendation re: deletion of lots, open space easement and standard school condition. Mr. Bob Allen,7670 Clairmont Mesa Blvd, San Diego, ap- pl icantl s representative, appeared briefly before the' Commission further requesting that Conditions 4 and 6 and especially 7, be deleted. There were questions directed to Mr. Allen re: slopes, how many of the lots would be substandard and the deletion of Lots 1, 288 a 289. After a short discussion, it was moved that the requesl for Change.of Zone be approved and the motion carried. A motion was then made to approve Tentative Map CT 73-: according to recommendations of Staff ., with modificat, of Conditions 4 and 6. Condition 7 was not changed. The motion carried. Commissioner Dominguez called for recess at 9:35. All those present at the time of recess were again present when the meeting reconvened at 9:45. UNFINISHED BUSINESS: 6(a) CASE NO. MP-132 - PACESETTER HOMES - MOT ION RYES n MOT I ON AYE I' IOTION \YES ). 10T ION \YES ion Mr. Agatep reported on the action of the City Council with regard to the Appeal of Planning Commission Actior Denying applicants' request-for Adoption of a Master Pli for the Pacesetter development. Mr. John Klug advised of his presence for any questions from the Commission. After discussion it was moved that the Secretary reporl to the Ci$y Council that Developer agrees that the re- vised Master Plan conform to the General Plan, and also that the Revised Master Plan be submitted to the Planni Commission for their review prior to re-submittal to th City Council. The motion carried. 6(b) PRESENTATION OF BUILDING DESIGN -SHARP VOLKSWAGEN The presentation was made by Mr. T. Richardson, 2266 Cameo Road, Carlsbad, applicants representative, for th third major addition to the auto center. Part of the discussion by the Commission centered on the lack of, or minimal use of, landscaping displayed by Dixon Ford and expressed their concern for future building proposa Mr. Agatep advised that -a report on this area of con- cern should be made to the City Manager and the City Attorney, with a copy to the auto dealers Association. The motion made to accept the proposal on Sharp Volks- wagen carried. NEW BUSINESS: 7(a) CASE NO. CT 73-47 - CONDO' COSTA - Request for Considera of Tentative Map to allow a 32-unit condominium development on property generally located on the west side of Jerez Court, north of Gibraltar St. in La Costa. """"""""""""""""""""""""""" Mr. Williams made the Staff report setting forth their recommendations for approval of the requested Tentativc Map, including ten conditions of approval. Mr. Don Davi 1551 W. Redondo Beach Blvd., Gardena, applicant's rep- resentative, in response to a questionregarding sewer access, advised the Commission that he had met with Mr. Hansen of Leucadia County Water District and that a letter would be forthcoming regarding the developmenl He also advised that no one under eighteen would be in occupancy in the development for more than thirty 'days at a time. ,- CITY OF CARLSBAD After a short discussion, a motion was made that the Tentative Map be approved subject to the conditions set out by Staff. The motion carried. 7(b) CASE NO. CT 73-48 - ORLEANS EAST - Request for Consideration of Tentative Map to allow a 60-unit condominium development on property generally lo- cated on the north side of Pirineos Way, east of Viejo Castilla Way, in La Costa. """"""""""""""""""""""""""" Mr. Zander gave the report ofi applicant's request for approval of Tentative Map for condominium development in La Costa. He also advised that there were 62 units instead of 60 as shown in the report. Staff's recom- mendation was for approval based on the conditions con- tained in the report. Mr. John Kitchngham, 3330 Yonge Street, San Diego, the applicant advised the Commission that sewer connection fees had already been paid to Leucadia County Water District, and verified that there were 62 units. With no further discussion, it was moved that the Tenti tive Map be approved based on the conditions contained in Staff's report and the motion carried. 7(c) CASE NO. CT 73-43 - ROBERT PARKER - Request for Consideration of Tentative Map to allow a 12-unit condominium development on property generally lo- cated between Unicornio St. and Alga Road, east of Corintia Street in La Costa. ........................... Mr. Zander gave the staff report for the requested condominium development. He emphasized Conditions 11 and 12 which referred to fencing on the westerly side of the development to screen the high density developmc from adjacent R-1 properties and frontage improvements along Alga Road. Staff's- recommendation was for approvi Mr. R. Ladwig, Rick Engineering Co., 509 Elm Avenue, Carlsbad, applicant's representative, advi'sed that a school agreement was not necessary (Richmar District Chairman Dominguez requested a letter be placed in the file for each applicant where this district is concern There was a short discussion concerning the needs of the high school district,, after which a motion was mad to approve the requested Tentative Map. The motion carried. At this time, Mr. Williams requested that Late Item 8(b) be taken 'out of order on the agenda. The request was granted. LATE ITEMS: 8(b) REQUEST FOR CLARIFICATION OF DETERMINATION OF FINDING SIGN ENTITLEMENT OF PROPOSED DRIVE-IN BAN FACILITY - R.A. LUMSDEN FOR SOUTHWEST BANK Mr. Williams made the Staff report explaining that the applicant felt that some ambiguity exists with the way Section 21.40.070 is written so khat either his or. the Staff's position could be followed. Applicant has re- quested that the seven drive-up stations and undergrou facilities be included as part of the total frontage. MOTION AYES MOTION AYES t . I. MOTION AYES COMMI SSIONERS COMMISSIONERS CITY OF CARLSBAD ~~ ~~ ~ ~ This would allow the Bank a total sign area of 171 sq.f Staff’s recommendation, based on the actual building under construction which has a street frontage of 28 ft and allowirvga total sign area of 42 sq. ft, was to deny the applicants request:’ In Staff’s opinion, sign en- titlement is based upon the elevation of a building, th portion that , visibly and physically has frontage on the public street, and that the used’ of underground con riections such as utility lines, water lines, etc. goes beyond the definitions dealing with the determination a sign entitlement. Mr. R.A. Lumsden, 2191 El Camino Real, Carlsbad, the . applicant representative of Southwest. Bank, was present to explain why the Bank took the position regarding th use of underground connections and to request the Plann Commission-to recommend to the City Council the use of underground facilities in determining total sign en- titlement. A lengthy discussion took place rega’rding the method used to determine sign space and ‘it was suggested at 01; point that perhaps.a variance would be the best route to go . However; it was the decision of the Commissic to deny the applicants request based on the staff’s recommendations. A motion made to this effec.t carried. $(a> STREET NAMING POLICY -PLANNING COMMISSION POLICY NO09 Mr. Agatep gave the report on the proposed street naming policy. He advised that the City has never had a procedure to follow with regardto the naming of streets nor the changing of street names. Staff’s report set out several excerpts from the Government Code which could be followed when changes become necessary but also recommended that the Commission f ollow through with the proposed policy and forward on to the City Council for their action. After a short discussion the motion made approving Policy No. 9 carried. Chief Anear, City Fire Dept. commented on the duplications of names of streets within the City and the difficulty for safety services in the locating of some of the addresses. He also ad- vised of the need for compatibility in numbering since mistakes in street numbering made some time ago had never beew,gorrected. Chairman Dominguez moved that a report be made to the Commission regarding the necessary changes for their further action. The motion carried. $(c) KEPORT BACK n> PLANNING COMMISSION ON CITY COUNCIL ACTION KE: PONDERDSA HOMES Mr. Agatep made an oral report on the action re: Ponderosa Homes by the City Council. Based on the Commission’s report to the City Council, the Council felt the need for redesign of the plans After discussion, motion was made that the Planning Commission report back to the Council their agreement to redesign of Rancho Del Ponderosa and their request for submittal of this redesign of the Specific Plan to the Planning Commission for their review and comment prior to submitting to the City Council for a final decision. The motion carried. 7k) PRDRISED SIGN ORDINANCE FEVISION - CASE NO. ZCA-3 5 A lengthy discussion regarding the sign ordinance revision took place at this time. Mr. Williams of Staff advised that two alter natives had been prepared for consideration for possible adoption He also advised that these draft copies had been presented to persons and organizations regarded as having an interest in the revision. ¶ t “g YOTION AYES MOTION AYES c MITION AYES MITION AYES . xx xx x XI X x2 CITY OF CARLSBAD Mr. Rick Porter, Beautiful Saviour Church, Valley Street, Carlsbac had a question regarding the limited sizes allowed for Church sigr Chairman Dominguee requested a report from Staff on the average footage allowed for church signs. Mr. Harry Truax, Carlsbad, offered several comments on the proposc revisions Sth expressed concern for the section concerning bill- boards and that the sign ordinance might become part of the zonin4 ordinance instead of being in its own section of the code. Commissioner Wench suggested that, with' regard to obsolete signs, and in case of bankrmptcy, that these signs be removed at City expense. Chairman Dominguez also requested information on the de- letion of billboards, Prior to adjournment, the Commission discussed the agenda for the next meeting insofar as those applications requiring a full four vote were concerned. Three members of the Commission planned to attend the League meeting the week of the meeting on Oct. 23, 197: Those requiring a four vote would b.e so advised at the beginning of the meeting. Chairman Dominguez also suggested that the planning Commission should consider the possibility of evening workshops instead of tl usual morning meetings.
