TIME: 9:00 A.M. !, k... ir "- " I 1 ROLL CALL: Four Commissioners were present. Comrqi..s-. sioner Dominguez, Little and Jose were ah- sent. Meeting was called to order by the Secretary of the Planning Comm-ission, Don Agatep. Mr. Agatep reques ted the members present to appoint a Chairman-Pro-tern because of the Chairman's and Vice-chairman's absences. :ommissioner Forman was appointed Chairman Pro-tern by Ananimous vote. 'UBLIC HEARINGS: (a) General Plan Land Use Amendment No. 8: The Direc- tor presented .a discussion of -five (5) areas of incon- sistency for requirements of AB-1301 and offered alter- latives and Staff recommendations. The Dfrecto-r stated that'the recornmendatiqns were based upon input by the General Plan Land Use Citizen Committee and Planning lepartment Staff. After discussion of the alternatives ~y the Planning. Commission, 'the Public Hearing was Ipened, and persons interested in the proposed amend- . nents were invited to speak by area. Ponto: Clinton Jones, Attorney for McDougal mation stated basic opposition to the pro- posed action recommended for the Ponto Area (Area No. 2 ). The Staff and Land Use Com- mittee recommends a reclassif.ication.from C-M (Heavy Commercial - Light Industrial) and M to RD-M. He also asked for clarification of defi- nite time requirements for non-conforming uses and buildings. The Director stated his under- standing of the time required for conformity as being part of C.M.C. Sec. 21.48.020 et seq. Mr Jones stated.that he had a different understand ing and that, i.f there were only 5 years to con form, he would oppose such reclassification. However, if the time for conformity were to be based on a longer period of time per Sec. 21. 48.060 of C.M.C., that time presented a differ- ent picture. He requested further clarificatio' Eugene Chappee - opposed the reclassification based on existing land uses and investmehts in- curred to date. He also felt government should not rezone if a majority of the property owners oppose it. Dale Schreiber - requested clarification of al- ternatives.to rezoning. Bob Murray., 3328 Valley., Carlsbad - stated he wl ad'vised that the area was appropriately zoned fc his proposed use (equipment ren.tal).and that he was not given any indication of G'.P. requiremen, prior to purchase. Mitcti Pollard - oppo'sed' the proposed'reclassifi. cation in Ponto and asked Staff questions relat. ing to development proposed for the surrounding property. He also asked about property values now as compared to values which would occur wit1 the proposed rezoning. He felt that premature values were being given to the Ponto area. i jx i I 1 ! ! Staff advised the Commission that a formal pre- ,entation of the Elements would be given at a special 'lanning Commission meeting December 7, 1973.
