APPROVAL OF MINUTES: Minutes of the Meeting of March 8, 1974 were aDproved as presented: WRITTEN COHMUNICATIOYS: !lone ORAL COMMUNICATIONS: None 1 PUBLIC HEARINGS: Chairwoman Casler, referring to a wall sraphic, explained the procedure for presentations to the Planning Commission, City Council, and the appeal procedure. """""""_""""""""""""""""""""" 5. (a) Commissioner Dominguez was in the Plannins Department listening to the tapes of the previous meeting relative to Land Use Amendment No. 13 (Loker), and the Commission decided to pass over this item for the time being and move onto the second public hearing. 5. (b) CASE NO: SP-22 - PACIFICA !dESTERN DEVELOPMENT CORPORATION: A request to amend an approved Specific Plan to reduce the number of dwelling units from 60 to 5r), and to re-orient the proposed structures around two pro- posed recreation areas, on property generally located at the northwest corner of Tamarack Avenue and Jefferson Street, zoned RD-M. Associate Planner Paul !Jilliams presented the staff report and recommendations for this matter to the Commission. He explained the request for reduction of units and re- location of structures, with staff's recommendation for approval. Commissioner Jose questioned if staff had given considerati to placing a net or roof over the proposed handball court. Planner Williams answered he felt this would be feasible. Commissioner Little questioned if the Cit.y did not require a 10 ft. wall as opposed to the 8 ft. mentioned in the staff report - Planning Director stated City does provide for a 10 ft. wall requirement. Commissioner Little also said he felt there should be 2 exits provided on the Jefferson St. side, with a stop sign on the property as you are coming out. The Public Hearing was opened and no one in the audience wished to speak in favor of the project. Fr. Sam Gendusa of Lin Mar Lane, Carlsbad spoke in opposition. Mr. Brian Katuldi spoke representing the applicant stating they hoped for approval, had no objection to the suggested stop signs at both streets; the.y were looking for middle- class (blue collar workers) buyers for their homes. Chairwoman Casler questioned the facilities that would be available for children and asked if there would be any objection by the applicant to taking out one of the propose handball courts and putting in a play area for children. At this point in the meeting Commissioner Dominguez return( from listening to the tapes in the Planning Department. He stated they could think about moving the volleyball court 3-1/2 ft. towards the center of the proje and leave the court property vacant, this would create a 10 X 15 play area. Commissioner Dominguez pointed out that there would be a fully equiped play area for the children that is presently located at the Jefferson Street School. Commissioner Wrench stated he felt this development was just fine the way the applicant has developed it. Motion was made that the Planning Commission recommend approval to the City Council of SP-22 for the justificatiot contained in the staff report ,and with the amendments made by the Commission as to conditions. ............................. Now it was agreed to proceed with the 1st public hearing on the' agenda. """"""_"""""""""""""""""""""" 5. (a) continued: CASE NOS: EIR-234 & GPA-27 - 'LAND USE AMENDMENT NO. 13. - Consideration of an Environmental Impact Report and a Land Use Amendment to change the Land Use Designation from Parks and Semi public Open Space on property located southerly of and adjacent to Palomar Airport Road , easterly of El Camino Real . (Loker Property) The Planning Director Donald Agatep presented the report for this Amendment. He explained the noise levels, graphs in the report, crash hazard potential, vegetation, wildlife, uses for industrial purposes. He explained it was felt the major factor is the rationale for changing this property from park and open space to Planned Industrii Commissioner Barrett questioned .if at some point in the future the airport is expanded to comercial uses, if it would effect this property. Planning Director said it wou' substantially change the noise and crash hazard character- istics of the property and that the County and C.P.O. are making a commitment that this airport will never reach commercial or jet activities. Public Hearing was opened and Mr. A1 Kern of McK Land Company addressed the Commission with verbal background information on the complete development and slides to show boundaries and topography. He referred to page 6 of the E.I.R. regarding public property, said that portion refers to park dedication - not proposed to dedica that porti.on for open space but is intending to use same portion for private open space for the residents of the communi ty . There was no one wishing to speak in favor, from the audience, but Mr. Clarence H. Dawson spoke against the project. Mr. Dawson questioned the notification of the property owners, and felt USC and Thibido ranch owners should have been notified as they will be effected by this action. He also wondered if anyone had taken into consideration the impact this would have on the Fern Canyon and Los Monos Canyon. \ MOTION: Ayes : '\ \ x L P 9 73 - X CITY OF CARLSBL3 PLANNING COMMISSION MEETING April 23, 1974 -3- The Associate Planner explained to Mr. Dawson that the property owners were notified'in a 300 ft. radius, and tha, others interested could obtain this information by reading the newspaper. Although Mr. Dawson reiterated he had not obtained a notice, it was explained the property in the Assessor's book is in his wife's name - and she DID recievl a notice. There was considerable discussion by the Commission on the property lines shown on the map, and was later agreed the lines should be moved to show a more appropriate boundary of the 200 acres located north of Palomar Airport Road and El Camino Real that were being considered for Planned Industrial. The Commission was of the opdnion that the subject request was warranted because of imp'acts being generated by the existi-ng and proposed use of Palomar Airport. They also felt the change to Planned Industrial would further the City's efforts in establishing non-residential uses in the vicinity of Palomar Airport. Motion was made that the Planning Commission accept the E.I.R. #234 for the reasons as shown in the staff report, and recommend certification to.the City Council. Motion was made that the Planning Commission recommend to the City Council , approval of General Plan Amendment No. 27 for the justifications contained in the staff report. The Commission again put the matter back on the floor and Commissioner Wrench stated he was approaching this matter with some reservation, although he was persuaded this was legitimate property for Planned Industrial. He stated he hoped that when we (the Commission) get a chance to look at the Specific Plan and Tentative Map, the Commissio would stick to the thought that .this property really be developed as something special. He felt Mr. Dawson has a this will be kept in mind by all of the Commission during their later considerations for the property. Commissioner Barrett stated he would like to see the Open Space outlined in green remain as Open Space so as to guarantee the greenbelt area. veryspecial feeling for this property, and he hopes that AMENDMENT TO MOTION: Motion was made that the Planning Commission recommend to thecity Council, approval of the General Plan AmendRent No. 27, as presented, for the justifications contained in the staff report, and with a stipulation that areas C-1 and C-2 only be changed. ............................. (c) CASE NO: SP-157 - FINANCIAL SCENE, INC.: Request for approval of a Specific Plan for a 400 unit condominium complex on property located at the northwest corner of the intersection of Camino de 10s Ondas and Lowder Lane, zoned P-C. (Alta Mira Unit #4). Planning Director Agatep presented the report for this request stating it was the 4th unit of Alta Mira. He also stated that the Planning Department had just received the School Letter as compliance to Public Facilities Policy. He explained the graphics and added there would be 22.5 units per net acre. He stated the final determinat of 2 buildings on the north side of the project had not been solidified because of grading problems, so final project may have 2 buildings re-oriented; and explained the Open Space Corridor. Public Hearing was opened and Mr. Russ Richards, represen- tative of Pacific Scene, addressed the Commission. He stated he had nothing substantial to add to the report but felt a moral obligation to state that their intention had been to keep all of Alta Mira strictly an Adult Community, but, as of this date the School District had made them pay $142,000. for school facilities, and with this in mi.nd, Alta Mira may not now stay a Adult Community. The Planning Director read a draft of an agreement that was in the process of being worked out between A1 ta Mira and the Carlsbad Parks and Recreation Dept. regarding the joint use of Tennis Courts at Alta Mira. With no further discussion - Motion was made that the Planning Commission approve SP-157, and recommend approval to the City Council, subject to the 24 conditions contained in the staff report, and for the justification therein. 5. (d) CASE NO: CUP-95 - HOME FEDERAL SAVINGS: A request for a Conditional Use Permit to allow the establishment of a temporary bank facility on property generally located easterly of and adjacent to El Camino Real, northerly of the intersection of Marron Road and El Camino Real. Said property is within the right-of-way of the future Osuna Drive, Zoned C-2. Paul Williams gave the staff report for this request for temporary facilities. City Attorney Vince Biondo read from the Code Book the section dealing with time extensions for C.U.P.'s so the applicant would not be confused as:: to the Condition #16 contained in the report. After discussion it was agreed that Condition #16 be amended. Commissioner Wrench questioned why the Commission has to go through this procedure for banks. Why bother with a. temporary facility. Public Hearing opened and Mr. Don Snowbarger, speaking for Home Federal, stated they had to have temporary facilities as once they obtained a permit from the Federal Government, they had to open their doors as soon as possible thereafter They intend to do this with a temporary facility. Commissioner Wrench remarked that institutions such as the: tend to try to get in an area with as little cash as necessary and in the meantime, get in an application to stake other claims. He said he could appreciate that this is their business, but does not feel this may be good for the City of Carlsbad. .. In MOTION : Ayes : X X L I i I I i CITY OF CARLSBL PLANNING COMMISSION MEETING \ April 23, 1974 - 5- Mr. Snowbarger stated Home Federal Savings intends to open their doors immediately, and they do not have any other temporary structures at this time. Commissioner Wrench asked how many applications Home Federal has pending before the Federal Home Loan Board, and Mr. Snowbarger stated, about three (3). Public Hearing Closed and the following motion was made: Motion made the Planning Commission approve CUP-95 for the justifications contained in the staff report, and with the conditions of approval, as amended. Commissioner Wrench stated $e was opposed to CUP'S of this nature as he feels these' institutions play upon a technicality of the law that breeds prematurity. Commissioner Dominguez stated he was not prepared to agree to the extension of any more of these applications unless the applicant demonstrates a very stringent program of proof that they intend to construct permanent quarters. IFlFiPliSHErJ BUSINESS The Planning Director presented the Conmissioners with a report on the City Council approval of the condominium conversion request for CT 74-1 for DR. LOIS J. SMART, stating the City Council had approved same and returned to the Commission for Conditions of Approval. He also advised that the City Council has instructed that no more condominium conversions are to be approved until the City Council adopts a Conversion Policy. The nine Conditions of Approval were discussed and Commissioner Jose stated he felt' there should be very stringent requirements regarding landscaping and the need to adhere to same. Applicant's representative stated they were in complete agreement with the conditions as presented. Motion was made that the Planning Commission approve Conditions 1-9 and that they be added to Tentative Map 74-1 . ............................ Associate Planner Paul Williams gave a brief report on the Commission's request that staff check into the possibility of an Amendment to the Municipal Code which would allow the City Manager to approve C.U.P.'s for carnivals, etc, for a period of five days or longer. Commissioner 'dose stated he felt' some of the sites to be considered could be the Auto Center area, southwest portio of Cannon Road and 1-5, the S.D.G.&E. property on north side of 1-5. City Attorney Biondo stated he did not feel the City Manager should have to make the decision to place a carnival for days in a particular neighborhood. He stat it was his feeling that the neighbors should have the righ to say yes or no, and have it come to a public hearing; that is what the Commission is for. Commissioner Barrett said he would like a stipulation adde on C.U.P.'s that the organization sponsering the carnival must come before the Commission with at least three (3) r .,- * '1 MOTION: Ayes : Noes : MOTION: Ayes : Abstain: X X - -...."""" ..- ,_ . There was no formal action needed on this report, it was suggested and agreed that the Municipal Code would remain as is for the time being, with regards to City Manager approval of times for carnivals, etc. """""""""_"""""""""""""""""" Planning Commission was presented with Resolution No. 1054 commending Commissioner Roy H. Palmateer for his nine and one-half years service on the Planning Commission After a brief review of the Resolution, and amending some wording, the following motion was made. The Planning Commission does approve Resolution No. 1054 for Dr. Roy H. Palmateer, as amended. ............................ 7 (a) - New Business: This item taken out of order becaus of the anticipated extensive review of the two up-coming General Plan Elements: (a) CASE NO: CUP-81 - ROBERT MILLER for CHURCH OF THE NAZARENE: Request for an amendment to extend CUP-81, time for start of construction of a proposed church, on property generally located westerly of the intersection of Arland Road and Highland Drive, zoned R-1-75. Paul Williams presented the report for this request, and advised staff had not been successful in contacting the applicant. It was stated that it was the Attorney's opinion that a new C.U.P. should be applied for, and the matter be re-noticed. Motion was made to return this matter to staff for instructions to re-notice and bring back before the Commission at a later date. ............................. WORKSHOP ITEMS - NEW BUSINESS: Preliminary Review of Proposed Land Use Element and Preliminary Review of Proposed Circulation Element. Planning Director Donald Agatep stated these items could be very lengthy, so while he was giving a briefing, the Commission could consider a time to further discuss these matters before they come for a Public Hearing on May 14, 1974. He discussed the special treatment areas, prime open space areas, recognized floodplains, school sites, public facilities element for sewers, water, public safety and administrative services, as well as Capital Improvement Program and budget. He strongly recommended that the General Plan be actively reviewed every 3-4 years \ MOTION: Ayes : MOTION: Ayes : X Y X X I K X X X X - .. CITY OF CARLSBLS PLANNING COMMISSION MEETING April 23, 1974 -7- "- The Planning Director also dis'cussed Urban Lands - lands surrounding the airport and the Williamson Act. He said, if the property owners were willing to do this the City could categorically define some 6000 acres as urban land reserve - in order for property owners to qualify for the program they would have him file a Master Development Time Frame. Within five years the property owners would be able to tell us what areas in the City would be under the most pressure. He stated the property owners could be under contract to the City Qn a year to year basis, and there would be a tax relief program for the owners. Don also explained the circulation map, stating that we are exactly where we were in 1965 as far as circulation, and pointing out where we are deficient in our program. He stated there are some minor changes to be made and suggested specific road alignments be made by Public Works Department or the Engineering Department. Motion was made after further discussion - the Planning Commission adopt Resolution of Intention No. 105 to hold a Public Hearing on May 14, 1974 for the Land Use Element and Circulation Element of the General Plan. _"""""""""""""""""""""""""""" At 12:OO P.M., by proper motion, the meeting was adjourned to Tuesday, April 29, 1974 at 7:30 P.M. in the City Council Chambers. ............................
