Planning Director Don Agatep read telegram from Lagoon Shores, requesting Case No. SP-158, EIR 257 and CT 74-17 be tabled. """""""-""""""""""""""""""" ORAL COMMUNICATIONS 4. Robert M. Bryant requested Planning Commissidn take his case (V-233) first on the agenda. After discussion it was decided to adhere to the a.genda. Chairwoman Casler advised that Assistant City Manager, Bill Baldwin, requested that ite 6(a), Sale of City Owned Property, be taken first on the agenda. PUBLIC HEARINGS . 5(a) Case No. EIR 262 and ZC 145, Templin Heights - Request for Certification of an EIR and pre- annexational Zone Change from San Diego County E-1-A to City of Carl sbad R-1-7500 on property located on the east side of El Camino Real between Elm Avenue extended and Chestnut Ave.. Director Don Agatep gave staff presentation and explained the exhibits and recommended tha EIR 262 be certified and that Zone Change 145 be denied as it does not meet the intent of th Open Space Element. After discussion among the Commissioners, the * publS(; hearing! was opened. Rusty Grosse, President of Investor's Develop- ment and Mortgage Corp., applicant, introduced the engineer of the project Mr. Dave Chamber1 ain. COMMISSIONERS CITY OF CARLSBAD MEETING OF: CARLSBAD CITY PLANNING COMMISSION DATE: September 10, 1974 TIME: 7:30 P.M. PLACE: Counci 1 Chambers Dave Chamberlain, Project Engineer, spoke regarding the history of the project. He presented and explained a contour map of the proposed development. He pointed out that circulation was critical to the project and spoke on the ingress and egress to the project site. Cliff Burford, Director of Planning for Investor's Development and Mortgage Corp., gave presentation on topography of the pro- ject, explaining the slopes and grading as they would effect the design of the potential subdivision. He also spoke regarding low/ moderate cost housing concept. He passed out copies of a proposed tentative subdivision map that he felt should be displayed as it offered the most feasible use of the land. ____r$_ Tim Flana an, City Engineer, explained that the tra1 ing of the tentative map was to allow the zoning to be determined prior to sub- division. He felt that the zoning .and Land Use relationship should be established prior to subdivision design consideration. After . zoning has been determined a tentative sub- division map will be submitted to the Planning Commission. After further discussion among the Commission- ers, it was. determined that the case should be continued to allow the applicant time to study a number of options for potential des.igns that would best suit this project. It was moved and unanimously approved to certify EIR 262, per staff's recommendation. It was moved and unanimously approved to continue ZC 145 to the October 8, 1974 meeting to allow the staff and applicant time to consider new workable design for the project. s (b) Case No. EIR 257, SP-158, CT 74-10, Lagoon Shores - Per Director Agatep's reading of the telegram from Lagoon Shores requesting tabling of this item, it was moved and unanimously approved to table this item. Following this motion there was discussion ,: among the Commissioners as to whether a policy could be prepared in regard to tabled items that would eliminate extensive staff work, noticing, advertising expenses, incurred while processing an application. It was suggested that perhaps the applicant could be notified of staff's approval/denial as soon as first draft of staff report was done, thereby giving the applicant ample time to withdraw or table his application prior to notification. Director Agatep gave staff presentation, ex- plained graphics, and recommended approval of the Specific Plan and Tentative Map as outline' in the staff report. He also explained the California Vehicle Code as it pertains to City Po1ic.e patrol of private streets. Public hearing was opened. Bod Ladwig of Rick Engineering spoke in favor of the project and stated his complete agree- ment with the staff's report and conditions. Archie L. After discussion among the commission it was moved and.unanimously approved to accept staff recommendation as outlined in the Staff report with the added condition, No. 10, that the developer must indicate his concurrence, in writing, that the City's action to enforce the California Vehicle Code on private streets i s acceptabl e. Tentative Map, CT 74-17 was also unanimously approved, per staff's recommendation, with the same added condition (No. 17) as noted above. (e) Case No. V-233, Robert M. & Elizabeth S. Bryant - Request for variance to allow reduc- tion in the front yard setback, of property located at 2731 Ocean Street, Carlsbad. Director Agatep-.presented staff report and c-.~.:: explained Plot klah showing setbacks for other residences in the area. Robert M. PLACE: Counci 1 Chambers variance was to bring out the garage even with the property next door to increase the size of his substandard garage to permit him to park his car inside the garage and not in the stree He feels it will not be a deterant to access as it does not extend beyond any o&her proper- ty line. He also feels that it is not going to be materially detrimental as a fire hazard as good quality material and workmanship are to be used in the project. There was considerable discussion among the Commissioner's and Mr. Bryant as to his future plans for the use of the garage if extended, and if there was any other possible way to relocate appliances in the garage to create more room. Mr. Bryant stated that his plans at present were for garage extension only and there was no possible way to make room in the garage for an automobile. It was moved and unanimously approved to grant Variance No. V-233. The Planning Commission instructed staff to draw up a Resolution stating findings and conditions necessary for granting this variance. They also instructed that the resolution approving the variance stipulate that the parigace was for the garage only .and not for a potential 2nd story additio (f) Case No. V-244, Freiburger - Request for a variance to reduce the minimum street frontage from 60' to 20' on property located north side of Magnolia Avenue between Adam Street and Highland .Drive. Director Agatep gave staff presentation and stated staff's reasons for denial of this variance. The Director also presented an alternative subdivision exhibit which would accomodate public circulation. Dr. Freiburger, applicant, spoke regard project stating that the reason for the variance was because he wanted to build home in an area that would have Drivacv ing the his . He does not want to over develop the parcel. He i..bfeels that the parcel map preseated by staff is not consistent with what he wants to do with the property. Mr. & Mrs Allen Morris, individual's buying one Dortion of the subject Darcel, stated theii desire to limit the division of the lot to only 3 parcels, eliminating future density. Jean Freiburger, applicant, spoRe regarding traffic flow, stating there was a proposed street going east and west that she felt would take care of traffic caused from development of adjacent properties. There was discussion as to what the panhandle lot policy is presently and how the policy can be used to the best advantage of the project parcel and the-applfeant. It was moved and unanimously approved to continue this case to the October 22, 1974 mee ing to allow the staff and applicant time to consider alternative parcel map designs. (d) Case No. 80-a, Ebenezer Church - Request for CUP to allow construction of a Church on the north side of Oak Avenue, approx. 600' east of it's intersection with Pi0 Pic0 Drive. It was suggested'by Director Agatep.that this case be continued as the applicant was not present.
