(b) Resolution 1096, Systems Capital. It was moved and unanimously approved to approve Resolution 1096 as submitted. WRITTEN COMMUNICATIONS 3. The Planning Department submitted a memo per- . taining to the League of California Cities meeting to be held on October 22, 1974, Bill Dominguez stated he was going to attend'. Dr. Fikes will not attend the League meeting but wil not be present at the October 22nd Planning Commission meeting. I I ORAL COMMUNICATIONS 4. The subject. of a joint City Council/Planning Commission Glorkshop to be held on the 5th tuesday of any month was discussed. The Plannin Commission instructed staff to communicate with the Mayor and City Council regarding arrange- ments for this workshop. I I PUBLIC HEARINGS 5(a) Case No. ZC-145, Templin Heights - Request for approval of a preannexational zone change from County E-1-A to R-1*-7500 and R-1-9000 on 83.25 acre property 'located east side of El Camino Real between Elm Avenue extended and Chestnut. The Planning Director, Don Agatep, gave staff presentation and recommendation of approval as outlined in the staff report. No one spoke for or against this project, public hearing was closed. After substantial discussion, it was moved and unanimously approved to grant ZC-145. Staff was instructed to retain the applicant's exhibit map on file im the.Planning Department for future reference. CITY OF CARLSBAD Page 2 - Planning Commission Meeting 10-8-74 (b) Case No. SP-160, CT 74-13, Buena Woods I11 - Request for approval of Specific Plan and Tentat- ive Map for 135 Unit development on property located on the east side of Crest Drive between Elm Avenue and Eucalyptus Avenue. The Planning Director, Don Agatep, gave staff presentation and explained graphics. Stated staff's recommendation of approval and subject to conditions as outlined in the staff report. Mr. Jerry Rombotis, representative of Kamar Construction, spoke in favor of the project and I answered various questions presented- by the I Commission. Mr. George Flanders spoke regarding the Size of the Hosp Grove Park site that is to be dedicated to the City. I Mr. Ernest Adler spoke in oposition to the project. His objections were: 1) The area concerned is a natural park area and should be preserved by the City of Carlsbad for a Park and Recreational area. 2) The project will cause an adverse Environ- mental Impact on the area. 3) The project will create a flood hazard. Mr. A1 Bernotas, a property owner in the area, spoke requesting the Planning Commission to postpone this public hearing until after the Monroe Street Closing item was heard. His re- quest was denied. Public hearing was closed. Tim Flana an answered questions of the Planning ommission explaining the engineering standards for flood control. After substantial discussion the following actions occured: 1) Delete condition No. 6 from CT 74-13 as it 2) Strike out "I.. .and require their replacement when necessary", from condition No. 18 of SP-160 conditions of approval. """"""""""""""""""""""""""- (c) Case No. EIR 248, CT 73-2, SP-116, La Costa Land - Certification of EIR and approval of a Specific Plan and Tentative Map for 179 single family lots, 3 condominiums on property - . located in the P-C Zone. Planning Director, Don Agatep, presented staff report stating staff's recommendation of approv- al as outlined in the staff report. There was substantial discussion regarding archeological studies and findings in the pro- ject area. Mr. Fred Morey, Company, spoke he concurred wi representative of La Costa Land i'n favop- of the project, stating th staff. He stated the appli- cant's position on archeological survey and that the La Costa Land Company has hired a firm to make a preliminary investigation of the subject land in regard to archeological findings and that he would be willing to report to the Planning Commission every two weeks, if necessar as to the findings of the investigating party. Mr. Morey consented to the rewording of conditio No. 20 to read "....a report from such an organ- ization which sets forth a program, shall be submitted to the Planning Commission for approv- al and recommendation. Public hearing was closed. After further discussion the following changes were made: 1) The rewording of condition #20 to read I' ... . a report from such an organization which sets forth a program, shall be submitted to the Planning Commission for approval and recommendation". 2) Addition of condition No. 22 to the tentative map for bicycle provisions on Rancho Santa Fe Road to be established in accordance with the City of Carlsbad Circulation Element. 3) Addition of condition No. 9 to SP-116 stating the Interim Parks Agreement be consummated before SP-116 and CT 73-2 are heard by tne Ci ty Counci 1. It was moved and approved to certify EIR 248 and grant Specific Plan 116 and tentative map CT 73- 2 with the above changes. Planning Director Don Agatep, gave staff pre- sentation and explained graphics, stating staff' recommendation of approval subject to conditions outlined in staff report. No one from the public was heard. After substantial discussion, it was moved and unanimously approved to grant zone change 146 fo reasons and recommendations outlined in staff report. P1annin.g Director, Don Agatep, stated applicants reauest to continue this item to the October 22, 1974 meeting .to enable adjacent property owners- to assess the proposed projects impact prior to public hearing. It was moved and unanimously approved to con- tinue this case to the October 22, 1974 meeting. ........................... (f) Case No. SP-163 and CT 74-18, Beach Golony - Request for approval of a Specific Plan and Tentative Map'to allow a 24'unit development located on the west side of Carlsbad Blvd; and south of the South Carlsbad State Beach Park. Planning Director, Don Agatep, gave staff recommendation to table this project to allow the staff time to review applicant's EIR state- ments on beach erosion. Planning Director Don Agatep gave staff present- ation and recommendation for approval of request and explained graphics. Mr. Gary Wrench spoke on behalf of Hughes Air- craft resardinq the landscaping and grading done witlh respect to the possibility-of future parking speces. Mr. Wrench stated that the building permit included a comprehensive land- scaping plan submitted by a laguna Beach firm. It was moved and approved to grant this request per staff recommendation and with the following condition; that Hughes Aircraft submit a landscape plan bd be approved by staff. ........................... (b) Monroe Street Closing - Request by petition to close Monroe Street at the southerly intersectio of Elm Avenue. Planning Director Don Agatep gave staff present- ation and explained graphics. He recommended that 'the Planning Commission report to the City Council on the outcome of- this hearing and that the Council- consider this item as part of a public hearing on the Circulation Element. Per written request, Mr. Rich Phillips, 375 Monroe Street and Mr. William Bear of 313 Monroe Street, appeared before the Planning Commission giving-their opinions and feelings as to why they felt the street should be closed. They stated that the street was used as some- what of a "raceway" by high school students and creates a traffic safety problem. It was stated that it was nearly impossible to keep within the legal speed limit because of the curve and grade of the road. Mr. Prescott, 3303 Bell Lane, stated his views of the traffic problem. After substantial discussion there was a minute motion to instruct staff to consider this item as part of a public hearing on the Circulation El emen t . The Planning Commission instructed staff to have the Public Works Department prepare any alter- native solutions for the traffic problem on Monroe Street as part of the Circulation Element hearing. ........................... There was general discussion regarding density ranges and boundary definitions. After substantial discussion the following r-tio motions were made by the Planning Commission: . (c) Ratification of Amended Land Use Element - It was moved and unanimously approved to grant the Nelson request that parcels on the northeast side of Jefferson Street between Home Avenue and Laguna Avenue be designated on the proposed land use planoeS the:Tcombifetionidistrict RPlH/O;? :!-* It was moved and unanimously approved to ratify the amended Land Use Element with the following additions and changes: Density Ranges -'It was moved that the Planning Commission concur with Council desision on den- si ty ranges. North Downtown Office Area: It was moved that the Planning Commission endorse City Council action on the North Downtown Office area. .I. c. Boundary Definition: It was moved and unanimous, lv approved to add stem (e) under section E. Boundary Definition as follows: (e) However., notwithstanding the above, where- boundarys should occur at the rear of lots. Commissioner Wrench was appointed to represent the Planning Commission before the City Council to make a presentation of the Planning Commiss- ion's opposition to the Rinker Commercial and . (b) Chairwoman Casler stated she would talk to the Mayor regarding the presence of the City Attorney at the Planning Commission meetings.
