Resolution 11 17 approved as submitted Resolution 1118 approved as submitted """""""""""""""""""""""""""""""- WRITTEN COMMUNICATIONS None "-"""""""""""""""""""""""""""""" ORAL COMMUNICATIONS John Mamaux, 1393 Basswood, addressed the Planning Commission with respect to the proposed Macaria Refinery development. Mr. Mamaux asked the Planning Commission to consider an alternative review process which would place Regional Coast Commission as the first public body to hear the application. Mr. Mamaux's proposal is based on the requirement to construct pipelines in the Coastal Zone Permit area and the necessity of receiving a permit for pipeline construction and related activities. Mr. Mamaux stated that the Regional Coast Commission had indicated that a hearing could only be conducted after the City of Carlsbad had certified the EIR for the proposed Refinery pro- ject. Mr. Mamaux requested the Planning Commission recommend to the City Council a City Policy which will place the initial public hearing on the Refinery before the Coastal Commission. Director Donald Agatep stated that the staff had already in- vestigated a number of review process options and that the staff would be making a formal recommendation to the Council in the near future. After discussion by the Planning Commission the staff was instructed to report on the process options and return with a report as soon as possible. Pritten, 330 Chinquapin, addressed the Conhission on the issue of the Refinery and Marine Terminal Facilities as they relate to reconnnendations of Coastal Conservation Comrniss. ion Energy Element. Mr. Pritten pointed out that the Energy Element was going to be heard at the Coastal Zone Commission in San Francisco in the near future. RECON report on Archaeological Findings at Santa Fe Glens - Bernard Maniscalco. 5620 Friars Road, San Dieqo CA. presented the RECON Archeological Report on Santa Fe Glens (CT' 73-2). The report addressed findings and recommendations presented to the Planning Commission on the archeologic investigation. ~~ ~~ After discussion it was moved and unanimously approved to forward the RECON Archeological report to City Council as submitted and recommend that no additional conditions needed tc be added to CT 73-2 """"""""""""""""""""""""""""""", PUBLIC HEARINGS Parks and Recreation Element - Consideration of the Parks and Recreation Element of the General Plan. Planning Director Donald Agatep reviewed the Nov. 26, 197r Plannina Commission hearina on the Parks and Recreation d ~- document returned-to staff-and introduced Ed Johnson, City of Carlsbad Parks and Recreation Director. Ed Johnson reported on the revisions niade to the original Parks and Recreation Element and comented on the Capital Improvement Plan. He expressed his desire to have the Plannin! Comnission's input and any changes they felt necessary be recol sidered at the adjourned meeting to be held December 18, 1974. After discussion it was moved and unanimously approved to continue the consideration of the Parks and Recreation to the December 18th adjourned meeting . Mr. Ted Richmond and Mr. Frank Lilley both spoke regarding their concerns on the draft Parks and Recreation Element. Mr. Richmond requested that copies of the Park & Recreation Elemen. be distributed to pertinent individuals of SDG & E who may have interest in the project. Mr. Lilley made the same re- quest on behalf of Japatul. Mr. Lilley requested that Mr. Owe1 Menard be given a copy of the report for review. Mr.. Richmond and Mr. Lilley both requested at least a 60 day delay in the public hearing to enable further study of the Element drafted by Parks and Recreation. ' """"""""""""""""""""""""""""""- Case No. CUP 102 - La Costa Land Company - Request for approv a1 of a Conditional Use Permit to allow a temporary sales facility under the provision of Municipal Code Section 21.42.06 on property located on the south side of Costa Del Mar Rd. between La Costa Ave., and Arena1 Rd. Director Don Agatep gave staff presentation and outlined graphics. Mr. Agatep gave staff recommendation of approval and subject to conditions as outlined in the staff report of November 26, 1974. The staff was instructed to pre- pare the Resolution of Findings as outlined in the staff report and return the document to the Planning Commission for approval Case No. V-247 - Freiburger, Tuomi - Request for approval of a variance to allow reduction in setback --,-r- - -~ - ~ requirements for the development of a medical buildin! Bachman - Request for appro\ a1 of a one lot parcel map for the purpose of creatin! a four-dwelling unit condominium. Planning Director Don Agatep gave staff presentation and recommendation for approval as outlined in and subject to the conditions as stated in the staff re- port. There was discussion among the Planning Commissioners regarding the absence of a school letter form Carlsbac Unified School District stating ability to provide services. There was also substantial discussion re- garding the lack of an effective condominium conver- sion policy in the City of Carlsbad. After lengthy discussion, a motion was made to approvc PS-239 for reasons outlined in the staff report and ir accordance with the condit.ioas contained therein. Rol call vote provided split decision, 3-3 vote, constitu- ting no-action. A subsequent motion was made to deny PS-239. Again, after roll call vote there was a split decision of 3-3, constituting no-action. After further discussion it was moved and unanimously approved to cont-inue Case PS-239 to the January 14, meeting. Case No. CT 72-38 S.Q. Abbey - Request for approval bf a two-lot condominium subdivision on property . located on the east side of Carlsbad blvd. between Tamarack Avenue and one lot south of Sequoia Avenue. Planning Commissioner Dominquez abstained from discuss ion and voting on the matter. The Planning Director, Don Agatep, gave the Staff re- port and presented the graphics. the Director stated the historical background of the property indicating the previous application had been submitted as Seaview (Bear et al). Review of permit issuance had reduced the original 50 unit project to 24 units and had required an Open Space dedication and an attempt for Sequoia Avenue vacation as part of the Coastal Comm- ission permit. He 'also outlined the recommended conditions.:t)f:approghl. A petition submitted by the neighborhood residents and property owners was presented which outlined reasons t street vacation should not be approved. Tim Flanagan, City Engineer, stated the City's reasons for the proposed closure of Sequoia Avenue (hazardous left turn movement, increased traffic volume on Sequoia Ave..). After substantial discussion it was moved and approved by a vote of 5-0 (1 abstention) to recommend to the City Council approval of CT 72-38 for reasons set fort and subjedt to the conditions of the staff report. The Commission also stated it was satisfied that the tentative map should be approved with or without the street vacation and that the vacation matter be for- warded to City Council for approval/denial of the Sequoia Avenue street vacation before final tentative map approval. It is recommended the matter be set to City Council hearing on January 7, 1975. Case CT 74-19 Jerry Rombotis for Laguna Riviera PartnershiD - Reauest for approval of a 50 lot sub- division oh a 15.211 acre site. Planning Director Don.Agatep gave staff presentation and recommendation of approval and subject to condi- tions as outlined in staff report- of December 10, 1974 After substantial discussion it was moved and unanimou ly approved to recommend approval of CT 74-19 for reasons outlined and subject to the conditions of the staff report dated December 10, 1974. Goals Element - Planning Director Agatep gave staff recommendation that the Planning Commission forward the Goals Statement to the City Council for app-roval. He explained a chart showing overall relationships of individual element goalsato the Goals Document indica- ting their compatibility with the generalized goajs statements. It is noted there was no public representation. It was moved and unanimously approved to forward the Goals statements to the City Council for adoption with the following amendments: I) Item #6, pg. 2 - add. ..... from geologic and seismic hazards. 2) Item. 3, General Policy Statement, shoul read: "An element of the General Plan shall not be amended more than three times per calendar year.'' "v " MISSIONERS CITY OF CARLSBAD Planning Commission Meeting of 12-10-74 - Page 5 The Planning Commission, after substantial discussion of a condominium conversion policy, moved and unanimously approved to request the City Council to enact an Urgency Ordinance that would place a morator- ium on all condominium conversions until such time as a Condominium Conversion Policy or Concominium Conversion Ordinance is adopted. Bud Plender, Assistant Planning Director, stated he would submit a draft Planned Unit Development and Condominium Conversion Ordinance at the adjourned meeting December 18, 1974. It was moved and unanimously approved to adopt hhe Planning Commission Calendar for 1975 submitted by the Planning Department.
