PLACE: Council Chambers 4 x x CALL TO ORDER ROLL CALL Commi ss ioners Watson , L ' Heureux , Cas1 er , Fi kes , Jose Present Absent Motion Ayes Absent Commissioners Dominguez, Wrench APPROVAL OF MINUTES AND RESOLUTION The minutes of December 10, 1974 were approved as amended. The minutes of December 18, 1974 were approved as submitted. Resolution 1120 (La Costa Land Company) and 1124 (Larry D. Hunts) were approved as submitted. WRITTEN COMMUNICATIONS Dana Hield, Planner, mentioned that written communications all ha1 a'connection with items on the agenda and would be discussed at that time. ORAL COMMUNICATIONS None Chairman Jose explained that both Don Agatep and Bud Plender were ill and that there were only five Commissioners present. Since a public hearing item requires a vote of four to carry, he stated that anyone in the audience,who felt they may get a denial or if there was any doubt in their minds, the applicant could ask for a continuance. PUBLIC HEARINGS 2a & b) Case No. SP-165 and CT 74-24 - Occidental Land, Inc. - Request for approval of a Specific Plan and Tentative Map to allow a 160-lot single-family subdivision over a 40-acre parcel located on the west side of Lowder Lane (Paseo del Norte) between Camino de las Ondas and Poi nsetta Lane. The property is zoned P-C and is Master Planned at 10 dwelling units per acre. John Mamaux, agent for Occidental Land, Inc., asked to be heard out of sequence. He stated Occidental Land, Inc. would like a continuance now and asked for thirty days instead of the next meeting. The Commissioners agreed and set the hearing for February 11. ,""""""""""""""""""""""""""""""- " 1. Case No. CUP-103 - Larry Rohloff (Agent) - Nazarene Church Reauest for approval of a Conditional Use Permi t to a1 low construction of a church and related facilities on property located at 2675 Highland Drive. Dana Hield, Planner, gave staff presentation, explained graphics and recommendation of approval as outlined in the staff report. Ms. Hield pointed out to the Commission Conditions 16, 19 and 20 particularly. Commissioner Casler asked about the phases and just exactly what type of " - I_ - " ". . b t ,.- A f Page 2 - Planning Commission Meet ing 1 /14/75 structure would be completed with each phase. Commissioner L'Heureux asked if the parking lot was to be completed in total or in phases. Larry Rohloff, Agent, made the statement that they have reviewed the conditions set forth by the Planning Department and agree to those conditions with no revisions and he was willing to answer any questions about the property. Commissioner Casler asked about elevations and phasing. Mr. Rohloff answered all questions posed by the Commission and also indicated that the parking lot would be completed durin Phase 1A construction. Gordon Butler, Building Designer, answered a few questions about the architecture and heights of buildings concerned. Pub1 ic hearing was opened. Ralph Ziegler, 2701 Morning Glory Lane, said when the Con- di tional Use Permit was granted last time there 'was supposed to have been a decorative wall instead of grapestake fencinc and he would like to see this corrected. Also, he looks out . his 1 iving room window at a 1 arge bus and would 1 i ke to have that bus covered. Chairman Jose asked that members of the audience speaking ir opposition please refrain from repetitive statements. Mrs. Joseph Compton, 2715 Morning Glory Lane, stated that at the hearing the last time this item was brought before the Commission, there was a list of approximately eighty names petitioning against the construction of a church at that location. She felt that traffic on Las Flores was much too heavy already, and would not support the traffic created by an addition such as a church. Chairman Jose explained that when the notice of public hear- ing is mailed to the property owners within 300', that is the time for property owners to ask questions if they have any, get their petitions started or whatever their wishes might be. Mrs. Compton asked about the appeal process and she was advised that in the event she wished to start an appeal to contact the Planning Department and they would aid and advise her. Mr. Ziegler spoke from the audience asking how many names of residents had to appear or petition to be effective. W. .I. Crealock, 1401 Forest Avenue, said residents would rather have a church than a large apartment building, but asked specifically. about the structural heights. Joe Martin, 2635 Highland Drive, presented quite an argument not only against this item, but the entire Planning and Commission process. His main concern was centered around the landlocked lots directly back of the church site. When he purchased his property, he did so with the understanding that the City was going to construct a ,street through that portion of the property. When the Conditional Use Permit was issued last year there were to be no church services conducted nor any parking on Highland Drive and he states there have been both. Highland Drive has "no parking" sign2 on the east side and they are ignored; people park on both sides of the street, and, in fact, utilize his driveway to turn around. Chairman Jose questioned Ms. Hield regarding the grapestake fencing and it was explained that there is grapestake with masonry pi 11 ars already on the street. After substantial discussion, Mrs. Compton asked to be heard again and public hearing was reopened. Mrs. Compton asked about the property right next to the chur which is supposed to be public property belonging to the Ci t of Carlsbad. It was explained that an encroachment permit could be issued. Mr. Martin spoke again stating he had been told by the City' Engineering Department that a street was going through from Highland west. The Commission indicated this may have been true at that time; however, things do change and no one from the Engineering Department was present to confirm or deny Mr Martin's statement. Commissioner Watson noted that the City does not normally construct streets. It would be up to the . residents to start a 1911 Act and that in reality the only thing the City Engineer could tell us tonight would be his ideas on the circulation. Commissioner Watson spoke to Mr. Martin directly, telling Mr. Martin the purpose of a hearing the democratic way a hearing is handled and stating that in no way is any member of the Commission predecided on any cas until they have weighed staff reports, testimony and any information. presented on the item. Chairman Jose asked how many were in the audience to hear this item, and approximately forty people held up their hand Pub1 ic hearing was closed. After discussion regarding circulation and determining that the 1 ots in back of the site were nonconforming lots , the Commission decided they would gain nothing by continuing thi hearing until the Engineering Department could be represente It was indicated that there was no provision for churches in the General Plan recently adopted and Commissioner Casler stated that staf.f was working on criteria for churches to be included in the first amendment of the General Plan. It was moved and approved by unanimous vote to grant CUP-103 subject to conditions outlined in the staff report and retur the document to the Commission for pro forma adoption. Staff was also instructed to develop General Plan criteria for churches based on those guidelines contained in the old General Plan and to present a preliminary report at the January 28 meeting. -"""""-"""""""""""""""""""""""""- 3. Geologic and Seismic Safety Element of the General Plan Staff Planner Sandra Lucky expressed appreciation to the Committee, named persons on the Committee, and indicated some of the suggested changes which had been made from input from these people. Ms. Lucky also presented maps reflecting seismic hazards compared to fault zones, geotechnic hazards and land use feasibility. Public hearing was opened. George Flanders, 3765 Yvette Way, expres.sed an interest in whether this was a new site study in this area or did they rely on past studies. After discussion, it was moved and unanimously approved to recommend to City Council adoption of the Geologic and Seism, Safety Element of the General Plan with the following two changes in wording: x x x X X I I Ja. - , I L :x X Page A2, third paragraph - "The terrace is gently and uniformly inclined to the west" should read - "The terrace gently and uniformly declines in a westerly direction". Page A19, third paragraph - "If this hypothesis is confirmed it is a major cause for concern'' should read - "If this hypothesis is confirmed that the Rose Canyon Fault is part 0' the larger fault system, it is a major cause for concern". UNFINISHED BUSINESS 4. Case No. P/S 239 - Henry F. Bachman - Request for approva a one lot parcel map for the purpose of creating a four- dwelling unit condominium. 1 0' Dana Hield, Planner, gave staff presentation, explained graphics and recommendation of approval as outlined in the staff report. Ms. Hield explained that by virtue of the property's substandard street frontage, tandem parking in thc front yard setback is permitted. The reason staff is recommending approval of this item is that it was submitted to the Department before the Condominium Conversion Policy was contemplated by the City. After deciding that the application met all the requirements of the City as they are now stated, it was moved and unanimously approved to recommend to City Council approval 0' P/S 239 for reasons set forth and subject to the conditions in the staff report. ................................ 5. Case No. CUP 80-A - John Amos, Ebenezer Church - Consideration of City Council appeal. Dana Hield, Planner, explained the process whereby the City Council had returned the documents to the Commission and alsc explained the alternatives the Commission had at this time. After some discussion as .to the method of processing this, the Commission moved and approved with a 3-1 vote with.one abstaining to reaffirm their original position wherein they had granted the Conditional Use Permit. ................................ x 6. Consideration of Site Plan and Elevations for Weseloh Chevrolet (Tri-Ci ty Auto Center). Dana Hield, Planner, stated staff's recommendation that this item be terminated at this time. Ms. Hield explained that this item was heard by the Commission on December 18, 1974 and at that time the applicant was requested to return with (1) elevations of all buildings on the property, (2) a com- prehensive site plan showing improvements and including elevations of the area surrounding the site, and (3) a land- scaping plan so that the request could be heard at this time 4 4 -4- CITY OF CARLSBAD Page 5 - Planning Commission Meeting 1/14/75 ., c. Since applicant has not complied, it was moved and unanimous' approved to terminate this application and place it on the agenda again after the applicant submits revised plans. NEW BUSINESS 7. Case No. P/S 230 - Azalea, Inc., by John W. Bartman - Reques for approval of a 2-lot parcel map over a 22.6 acre site, 1 ocated east of El Camino Real between Haymar Drive and Marrl Road. Dana Hield, Planner, stated the applicant is requesting con- tinuance until January 28, 1975. Ms. Hield explained the staff is in the process of advertising for a Specific Plan Amendment which would be heard concurrently with this reques It was moved and unanimously approved to continue this item to January 28, 1975. Recess was called for ten minutes at 9:lO p.m. All Commissioner present at roll call were present when the meeting was again call ed to order. INFORMATION ITEMS 8. Report on Possibility of Rezoning Area around South End of Sunnyhill Drive. Various points were discussed, such as a rezoning would require a public hearing, how the Commission would determine exactly how many residents of the area real1 wanted a zone change, how much time would be involved, etc. It was moved and unanimously approved to direct staff to write into the records that the Commission does not feel at this time that a rezoning of this area is warranted. ................................ 9. Sign Ordinance Draft. Dana Hield, Planner, suggested that this item should be studied when Bud Plender, Assistant Planning Director, was present. Chairman Jose suggested the Commissjon should study- what they have and Mr. Plender could present the item at the January 28, 1975 meeting. """""""""_"""""""""""""""""""""" 10. Rebort on Coastal Commission Process - Macario Refinery. Chairman Jose recommended continuing this until January 28, 1975 when Don Agatep, P1 anning Director, would be able to explain in detail to the Commission the processing steps of the Coastal Commission. Mr. Jose mentioned a meeting he 5 attended this date with City Manager, Mr. Bussey, and City Attorney, Mr. Biondo. Ms. Hield was asked and explained that, by Coastal Commission policy, the City must grant all discretionary approvals prior to the Coastal Commission review on any application """""""""_"""""""""""""""""""""" 11. Parks and Recreation Element of the General Plan. The Commission noted the amendments to be considered. """""""""_"""""""""""""""""""""" 12. Memo re City Beautification. This item was not discussed to any length; inasmuch as Bud Plender, Assistant Planning Director, was unavailablencomment.
