PLACE: Counci 1 Chambers CALL TO ORDER ROLL CALL Commissioners Fikes, Jose, L'Heureux, Watson, Wrench Commissioner Dominguez APPROVAL OF MINUTES The minutas of February 11, 1975 were approved as submitted. WRITTEN COMMUNICATIONS Assistant Planning Director Bud Plender mentioned that all written communications had a connection with items on the agenda and would be discussed at that time. ORAL COMMUNI CAT IONS None PUBLIC HEARINGS 1. Parks and Recreati.on Element of the General Plan - Consideration of the Parks and Recreation Element of the , General Plan. Ed Johnson, Director of Parks and Recreation, told the Commissioners that what they had before them was 'a draft dated February 25, 1975 which included all the input and recommended changes to date. Mr-. Johnson presented an explanation of -the inventory of available land and stated this Element was an attempt to set up a five-year program for the Ci ty.'s economic needs. He thanked the citizens on the committee and Lampman and Associates. Mr. Johnson feel they have an Element that is worthy of the City. of Carlsbad one the City can work ,with and can be proud of. Pub1 ic hearing was opened.. George Flanders, 3765 Yvette Way, Carlsbad, stated he would like to see an actual definition of how much acreage included in the land inventory is useable and how much is water. Mr. Johnson explained that the Element included a chart showing the breakdown. Public hearing was closed. The question was raised as to how much of this text actuall. belonged in the General Plan and how much should be noted as appendix only and not submitted as part af the actual Plan. Mr. Johnson explained that Pages 1 through 26 are a1 that actually should be made a part of the General Plan. Mr. Johnson was asked why the slope percentage on Page 8, Number 2D had been changed from the initial presentation. He explained that after a thorough research it was felt tha slopes of 30% over 10% were good in some instances. Because of the contour it makes a very pretty park; also, it makes a very nice part of the park for walking purposes. A good look at the City of Carlsbad's physical structure is what motivated this change. ' CITY OF CARLSBAD Page 2 - Planning Commission Meeting 2/25/75 The deletion of the 25-year flood plain in the new Element. was discussed. Mr. Morey, La Costa Land Corqpany, explained that the City does not have to accept any larrd for parks. They felt that the 25-year flood plain as it was worded mig limit the possibilities. lihether or not Chestnut and Monroe location for the swimmin pool was far enough along or certain enough to actually sta the location was discussed. After asking when the revision of.the existing ordinance to require dedication of land or provision of in-lieu fees on the basis of per capita residency increase, Betty Wollrich, Parks and Recreation Commissioner, said their Commission wa working on this revision now. After some discussion regarding the grammar, it was moved and unanimously approved to recommend to the City Council adoption of the .Parks and Recreation Element with the following changes: 1. Pages 1 through 26 should be submitted as a part of th General Plan. The -balance of the Plan should be made available and a reference should be made, perhaps in the table of contents, noting that the appendix material is. available. 2. There should be a statement, perhaps in the policy statements, that 25-year flood plain sites could be consj'dered as park sites at the City's discretion. This was favored in opposition to deleting the state- ment that land within a 25-year flo,od plain would not be accepted for park dedication credit for park sites. .. 3. Page 7, second paragraph, last sentence, should read: "These organizations have done the greatest amount of basic research relating demographic characteristics, recreational desires, faci 1 i ti es and space standards. I' 2.. 4. Page 19, Item N, delete the word "with". ................................ Case No. V-248 - A1 bert J. and Jean Frei burqer - Request for approval of a Variance to reduce minimum street frontag from 60 ft. to 20 ft. for a proposed panhandle lot on R-1 property located on the north side of Flagnolia Avenue between Adams Street and Highland Drive. Assistant Planning Director Bud Plender gave staff presentation, explained-graphics and recommendation of denial as outlined in the staff report. Specific planned street systems were discussed, along with. lot sizes in the area. .. Albert J. Freiburger, 1337 Magnolia, Carlsbad, Applicant, said he and his wife felt their request was'a reasonable one inasmuch as all of the property owners immediately adjacent to this property had no objection and because there have been a couple of panhandle lot variances granted by the Planning Commission quite similar to this request. Dr. Freiburger, in answer to questions raised, stated that there are no structures on the lot and the lot size is 72 x 150 ft. George Flanders, 3765 Yvette Way, Carlsbad, said he lives very close to this piece of property and that he liked the """" """ <"-.."I."""... Commissioner Watson appreciated staff's opinion, but felt that Dr. Frei burger or anyone else had a right to develop his property any way he so desired as long as it was not objectionable to his neighbors and not hurting anyone else. Bud Plender explained that a Specific planned street is one designed with the input of the property owners in that area through the public hearing process. Commissioner L'Heureux made a motion that this Variance request be denied for the reason that there has not been sufficient evidence showing that there are extraordinary Circumstances that make granting a Variance necessary or desirable in this instance. This motion was not seconded. Commissioner Watson made a motion to approve the Variance based on the following findings: (1 ) There are exceptional circumstances applicable to the property that do not apply generally to other properti in the same area since the subject property is extreme deep and relatively narrow and the only possible method for division is panhandle lot division. (2) The Variance is necessary for the preservation of a . property right possessed by others in the same area, since other 'panhandle lot variances have been. approved in the general area. (3) The granting of this Variance will not be detrimental to the public welfare or injurious to property in the vicinity,. since there are no property owners protestir this Variance and one neighbor has indicated his approval. (4) Granting of this Variance will not adversely affect the comprehensive General Plan, since the lots being created .are' of l'ower density than might be a1 lowed within the Land Use Element of the General Plan. This was a 3-2 vote, with Commissioners L'Heureux and Jose . voting no; lacking the four votes necessary to carry. After a little more discussion, it was moved and unani- mously approved to continue the item for thirty days to give staff sufficient time to meet with property owners on the block to ascertain if there was interest in an interior street system or possibly work out an alternative program . with the applicant. 8 After the vote was taken, the.Commission discussed ordinance streets and whether or not the staff could present schematics to show panhandles or how this problem has been dealt with in other sections of the City, what kind of lots we are dealing with, etc. ................................ 3. Case No. V-249 - Marcel Portelli - Request for approval of a Variance to reduce the front yard setback requirement in the R-1 Zone from the 20 ft. to 10 ft. f.or the purpose of building a 6 ft. high wall to enclose a court yard On property located in Rancho La Costa on the east side of a .-""""> ."^." . *"" "".. ~."-"."--"-"" _-... Assistant Planning Director Bud Plender explained that after this Variance request was submitted, it was discovered that Arenal Lane is a -private street, not a City street. In reviewing the zoning ordinance, the City requires a' Variancr from City streets only. Since the Home Owners Association would be the only regulating body, staff recommended allowir the applicant to withdraw his request with return of full fees . After hearing the explanation that this Variance request is for a setback requirement where the front yard abuts a private road, it was moved and unanimously approved to allok the appl i cant to withdraw his request and refund full fi 1 in! ' fees. ................................ 4. .Case No. SP-166 - Papagayo Developers/Larry D. Hunts - Request .for approval of a Specific Plan to allow the con- struction of 130 units as an extension of an already approved Specific Plan consisting of 218 units on property located on the north side of Aqua Hedionda Lagoon between 1-5 and the Santa Fe Railroad Right-of-way. Assistant Planning Director Bud Plender explained that we have received a letter from the applicant requesting a thirl day continuance. Staff also feels a thirty-day continuance is in order inasmuch as more input is needed from the ,': Coastal Coinmission. . Case No. ZC-151 - The Captain's Anchorage, Inc. - Request for approval of a Zone Change from,C-1 to C-2 on property located on the northeast corner of Carlsbad Boulevard and Tamarack Avenue. Commissioner Watson made the comment that he wou1.d abstain from any action on this item because, (1) he lives in direcl proximity to the area, and (2) he is in a similar business. Chairman Wrench explained 'that policy .directs. a vote of four on a public hearing i tern to approve it , and the . applicant was asked if he would like to be heard tonight even though there were only five Commissioners present or il he would' prefer a continuance. The applicant s'aid he would 1 i ke to be heard. Assistant Planning Director Bud Plender gave staff presentation, explained graphics and recommendation for . approval as out1 i ned in the staff report. Ingress and egress from the parking lot was ,discussed and this will be from Tamarack only. Malcom McCassey, 33971 Crystal Lantern, Dana Point, representing the Applicant, stated that Carlsbad Boulevard ingress and egress was closed off at the request of the Planning Department. They have already made a traffic flow study, the case already has approval from the Coastal Commission and now all they need is a change of zone in order to have on-sale liquor. He stated that when the property was purchased he had been told the lot was already zoned C-2. There was a ten-minute recess called at 9:05 P.M. All five Commissioners were present when the meeting was again call ed to order. PUBLIC HEARINGS - CONTINUED 6. Case No. ZCA-65 - A recommendation that ZCA-65 be approved providing for the "Q" Qualified Development Overlay Zone. Assistant Planning Director Bud Plender explained this woulc be an overlav zone and would rewire a site Dlan be sub- mi tted. The" site plan is to be 'approved by the Planning .Commission instead of staff, since the Commission knows the reasons for placing the "Q" zone on the property. Site control of difficult properties has been achieved in the past by way of Specific Plans, which means a public hearing at both the Planning Commission and the City Council level. The Specific Plan also means another public hearing at both levels for any amendment to the plan. The "Q" Zone with Site Development'Plan would eliminate most of the adminis- trative processing, yet give adequate control. Commissioner L'Heureux stated he felt such a zone was probably necessary, but whether or not the proposed ordinance as presented was specific enough under devel opmen: standards so as to .provide the Commission with the real tools needed when they look at these site plans. He felt the ordinance needed more work. .. Commissioner Watson at this point volunteered'to work with staff and another member of the Commission to consider this and have that Committee report back at the next Planning Commission meeting. After some discussion regarding Specific Plans,, Commissione, L'Heureux volunteered to work with staff on a comnittee a1 so. .. The Commissioners indicated that they felt a little vague about when it -would be appropriate to apply the "Q" Zone. It was moved and unanimously approved to continue this item to March 25, 1975 to allow Commissioners Watson and L'Heureux sufficient time to work with staff on a study of this item. ................................ 7. Case No. ZCA-66 - A recommendation that ZCA-66 be approved deleting Specific Plans from the time 1 imitation set forth for Variances and Conditional Use Permits. Assistant Planning Director Bud Plender explained that staff is recommending continuance for thirty days on this item also. Home Federal Savings and Loan Association - Discussion of Buildina. Mr. Frank Hope. architect rewesentinq Home FederaldSavings and Loan Association, presented a rendering and slides depicting the "Hispanic Corridor"; buildings already there and the proposed Home Federal Carlsbad branch Various types of brick were presented and Mr. Hope was aske which, other than the used brick, would be his choice for the exterior of their building. Mr. Hope indicated one of the samples; however, he did not understand why any would b more acceptable to the Commission than the used brick which he feels has much more character and is more in keeping wit their image. He stated that Home Federal Savings and Loan Association does feel very strongly about the used-brick. After much discussion, it was moved and unanimously approve to approve the building concept as presented with the exception that H. C. Muddox's 4x12 Face Fremont-Blend brick be used. instead of the proposed used brick. INFORMATION ITEMS ' , 9. Circulation Element Wbrkshop. City Engineer, Tim Flanagan, presented an outline of what was contained in the Circula- ' tion Element. He explained that a petition had been it was felt that neighborhood circulation specif'ically should not be incorporated into the General Plan. Mr. Flanagan asked if the Commissioners had any questions or if there 'was any input they would 1 i ke to see in th.i.s Element. 'received requesting the closing of Monroe Street, but that The question was asked in reference to the residents of Monroe .Street if the Element was not the appropriate place. to handle this, how would guidelines be set up on this issue. Mr. Flanagan pointed out Several guidelines in the Circulation Element that could be applied to a specific neighborhood problem. The Commissioners discussed the possibilities of,adding a section on park and ride facilities, bicycle paths in con- junction with equestrian trails, specifications for bicycle paths, alternate modes of transportation. It was suggested that the San Diego-Los Angeles Corridor study which is now underway should be looked at in an attempt to update this Element, and that Mr. Dale Morrison. should be contacted for citizen input, also. Mr. Rick Phillips, a Monroe Street resident, stated that he and Mr. Bear were representing the people who had signed the petition for closing of Monroe Street south of Elm. Because of their feeling that this area would become a - raceway, they had petitioned the Traffic Safe.ty Commission. ThisXommission-agreed that Monroe should be closed; but when it was brought to the' Planning Commission, the Planning Commission felt it should be part of the Circulation Element. Engineering staff does not agree that the closing of Monroe Street should be in the Element. The residents still want something written into the Element to give them some kind of protection. Mr. Bear passed out material showing elevations and street design of the area. He stated there is an average of 3,000 cars daily travelling Elm Street at that point and because of the grade, it is impossible to see automobile traffic from Basswood or Elm. -~"---r'~"~"--"-"~"".* "" * "*-*""". Simpson, 3090 Monroe Street, spoke from the audience telling how just last night he had-seen a car travel1 ing Monroe crossing Elm so fast all four wheels left the ground. Mr. Flanagan explained the City is attempting to utilize some traffic study funds for this area; however Tamarack alignment and the traffic study for the downtown area came first. Questions were raised about the possibility of barricades, traffic lights, speed berms, et.c. to slow traff i c. The Commission felt that any study should go beyond the 300 ft. designation of nearby property owners and should includc the ,residents of streets such as Donna, Valley, Blenkarne, Wes twood , etc . Mr. Phillips agreed to have some wording available for presentation to Engineering for inclusion in the Element. Engineering will have a finalized draft at a later meeting, hopefully before June, and will ask the Planning Commission to adopt the Element for submittal to the City Council. .. ANNOUNCEMENT City Engineer, Tim Fla.nagan, announced the City is going through a major Subdivision Ordinance revision. This mandated Ordinance goes into effect March 1, 1975. The 50-page packet will not be available u.ntil. Thursday or Friday and if any Commissioner wants a copy for study and review they can contact Mr. Flanagan. This will not come before the Planning Commission. Because of the time element , City Council -will review this as an emergency ordinance. ADJOURNMENT The meeting adjourned at 10:45 P.M.
