PLACE: Council Chambers ~ ~~ CALL TO ORDER ROLL CALL Commissioners Watson,, Dominguez, L'Heureux, Fikes, Jos and Wrench APPROVAL OF MINUTES The minnrtes of February 25, 1975, were unanimously approved as amended. Amendment to the minutes: Page 3, Para. 5,' ending in sentence, "This motion was not seconded." Commission- er Jose stated this motion was seconded by him. WRITTEN COMMUNICATIONS None . ORAL COMMUNICATIONS City Attorney, Vince Biondo, reported on three matters which would be of interest to the Planning Commission: 1) The City Attorney reported that the 1974 sub- division map act now requires precise findings which must be included in the Planning Commission Resolutions. The findings apply to both resolu- tions of approval and resolutions of denial. 2) The City Attorney also reported on staff pr0gres.s to date in completely revising the City Subdiv- ision Ordinance. He stated that the City Council and Staff are conducting workshops in order to complete the ordinance at the earliest practical date. He suggested a future workshop during whic City Engine.er, City Attorney, Planning Director point out the difference between the 1974 Ordinance and the old subdivision ordinan'ce. 3) The City Attorney .advised the Planning Commission of the status of Planning Commissioner's require- ments with respect to the Mosconi Bill on "Government Conflict of Interest Act". He ad- vised the Planning Commission that as soon as' it ' became clear as to their obligations and tQe date they must meet these obli-gations, he would so inform them. PUBLIC HEARINGS -. 1) Case No. CUP-106 - John D. Lusk & Son- Request for approval of a Conditional Use Permit to a1low"bonstruction of a 414 unit mobile home park on property located on the north side of Poin- settia Lane between 1-5 and the AT&SF RR. Planning Director Donald1 Agatep advised the . Planning Commission of the Lusk request for a 30 day extension of their project to allow the ".". ""-1 "." *I " "" - ~"" ""."" Grasher, General Council for Lusk, spoke on behalf of the applicant. He stated they are going to meet with Mr. Lance, Manager of the School Board regarding school facilities. After discussion it was moved to grant a 30 day continuance of CUP 106. The motion was amended. by Commissioner Dominquez to extend continuance to 3 meeting dates from March 11, 1975. The amendment to the motion was accepted by Commis- sioner L'Heureux and it was unanimously approvec to grant a continuance of CUP 106 to the April 22, 1975 Planning Commission meeting.. 2(a&b) Case No. SP-165 and CT 74-24 - Occidental Land Inc. - Reauest for aPDroval of a SDecific Plan to ail'ow a'l60-lbt single family subdivisic over a 40 acre parcel located on the west side c Lowder Lane between Camino de las Ondas and Poinsettia Lane, and a request for a tentative map to allow a 160 lot single family subdivisior over th'e same 40 acre parcel. Planning Director Donald Agatep advised the Plar ning Commission of the request submitted by John Mamaux, agent for Occidental Land Inc., to withdraw their applications for SP-165 and CT 74-24. After discussion it was moved and unanimously approved to allow withdrawal of SP-165 and CT 74-24. 3(a&b) Case No. ZC-152 and SP-25(A) - Robert Watson -. Request for approval of a Zone Change from R-l- 7500 to C-2 on a 6,507 sq. ft. piece of propertj located at 3150 Pi0 Pic0 Drive and request for approval of an amendment to Specific Plan No. 25 to allow that piece of property being rezoned to become part of that Specific Plan for additional parking purposes and to allow an 870 sq. ft. addition to the existing restau- rant building on property located at 3150 Pi0 Pic0 Drive. I Assistant Planning Director Bud Plender, gave staff presentation and Fiicommendation of approval subject to conditions as outlined in :t staff report and explained graphics. After substantial discussion, it was moved and approved to recommend to the City Council that ZC-152 and SP-25A be approved, as outlined in the staff re- ports and that condition #4 be added to SP-25A to read: roject approved by Specific Plan 126 (Col.onia1 4 (4) The applicant shall file a reciprocal parking agreement with the City concerning joint use of the additional parki,ng areas between the subject property and the project approved by Specific Plan 126 (Colonial Mall). .. . NEW BUSINESS. 4) Case No. CT. 74-25 Larwi.n, San-Diego Inc. - Request for approval of a 211-lot tentative -Subdivision Map over 47 acres located on the east slde of El Camino Real, between Elm Avenue and Marron Road in- a P-C Zone. Planning Director Don Agatep gave staff recommendation of 2 week continuance per request of Larwin. Inc., explaining that there are ne-c- essary improvement agreements of Elm Avenue to be considered. Assiitant Planning Director Bud P1ende.r stated th.at the aPPlicant informed him thatey were going to meet with City Engineer ,Tim Flanagan within this week and that a two week continuance should be ample time to resolve these probTems. A request tor approxar of a revisea lentative Map to allow a' 30-lot single family subdivision on. property located northeast of the int.ersection of El Camino Real and Appian Road. Planning Director Donald Agatep gave staff presentation, explaining reasons for. denial as outlined in staff report and also explained . ~ graphics. City Engineer, Tim Flanagan stated that other alternatives for the aliqnment are possible but that this could not occu; until the' City Council amends its Circulation Element and adopted align- ment for Elm Avenue. Horace Falcons, property owner to the'north of the subject property, spoke in fa.vor of the pro- ject. He stated that he too felt the elm Avenue alignment should be changed. to be totally on the Larwi n property. Stan Morse of Toups Engineering spoke representin Larwin. He-stated for the record that Larwin i-s opposed to changing the alignment of Elm Avenue. After considerable discussion,. it was moved and. unanimously ap. roved by roll call vote (6-0) to deny CT 74-5(A P . Staff was instructed to pre- pare the necessary documents and return,to the Planning Commission. '* INFORMATION ITEMS Joint City Council/Planning Commission meeting - There was discussion as to what items should be brought up at the next joint City Counci-l/ Planning Commission meeting. Planning Director Don Agatep stated that the issues should be policy issues. Assistant Planning Djrector Bud Plender advised the Planning Commission of the workshop topics suggested by Councilman Lewis ChaSe, as fallows.: Zone Rev ision (P-C Zone) Open Space Requirements (how to' ma.Tn.tain, landscape, etc.) Architectural Control General Direction for Planning Commission/ Procedure and Methods for .Design Review. Condo.minium Conversian and Consistency Zone Ordina-nce Amendment City Council'. The Planning Commission instructed the staff to consolidate the topics Architectural Control and Procedure and Methods of Design Review into one general topic. Staff was also 'instruited to expand on each topic and to give more insight into each topic and to report at the next Planning Cornmission meeting on March 25, 1975. No-< 1138 recommending City Council adopt General Plar Amendment No. 33 adopting the Parks and Recreatic Element of the General Plan of the City of Car1,sbad. ~~~ .~ 8) City Policy on Mobile Home Parks- - Planning Director Don Agatep explained memorandum on Ci-ty Policy on Mobile Home Parks. After discussion, staff was instruc'ted to do the following pertaining to City Policy on Mobile Home Parks: Make available to the Planning Xommission, as soon as possible, for- their study,, c0pi.e: of the Housing Element Supplement No. 1. Forward a. copy of the CPO Study. on Mobile. ' Home !arks in the March 25, 1975 P.lanning Commission packets. .. It was moved and unanimously approved to forward a memorandum to the City Council advising them of the Planning Commission workshop session to be held on March 20, 1975 at 8:30 AM in the Council Chambers, and to ask for their input as to the existing City Policy on mobile home parks; is it adequate and what is their opinion as to tf suffi.ciency of the present City Policy. Advise them we are antictpating an on-going ,problem with mobile home parks and would like to familarize the Commission and staff with back- ground. It was determined that the time of the first workshop session on Mobile Home Parks .(City Policy) would be -8~30 AM on March 20, 1975 in the Counci 1 Chambers.
