PLACE : Council Chambers I CALL TO ORDER ROLL CALL Commissioners Dominguez, Fikes, Jose, L'Heureux, Watson, Wrench. Chairman Wrench noted that newly appointed Commissioner Packard was seated with the Commission this evening. APPROVAL OF MINUTES It was noted the minutes of April 8, 1975 were nqt finalized for approval. The minutes of the workshop meeting of April 15, I975 were approved, with the exception of showing €ommissfoner L'Heure absent. . WRITTEN COMMUNICATIONS Planning Director Don Agatep mentioned that written communication all had a connection with items on the agenda and would be dis- cussed at that time.. . ORAL COMMUNICATIONS . . None . PUBLIC HEARINGS , Continued 1. Case No. CUP-106 - John D.,Lusk & Son - Request for approval of a Conditional Use Permit to allow construction of a 414-* unit mobile home park on property located on the north side of Poinsettia Lane between 1-5 andethe AT&SF Railroad. Planning Director Don Agatep referred to the memorandum from staff and the attached letter from the applicant requesting continuance to May 13, 1975 to enable applicant!s. represent- atives and staff to resolve design and land use concerns wit the subject application. Commissioner Jose stated that .in. order to continue an application'to a specific date perhaps . the tentative reschedule of meeting nights should be looked at briefly first. After' deciding the meetings would con- s tinue as regularly scheduled through the month of May, it was moved and unanimously approved to continue this item to May 13, 1975. . ................................ New 2(a) Case No. SP-158 - Lagoon Shores' - Request for approval of a - - .\ Specific Plan for 156.dwelling units on an &acre piece of land zoned P-C aod 1ocated.on the south side of Park Drive between Marina Drive and Neblina Drive, fronting on the north shore of the Agua Medionda Lagoon. The Commission heard the request to allow withdrawal of SP-158 and to hear applicant's new application, SP-168, instead: The Commission approved unanimously applicant's request to withdraw this application and instead hear their new amli- cation, SP-168. L " .... \ - X X COMMISSIONERS CITY OF CARLSBAD Page 2 - Planning' Commission Meeting 4/22/75 , 2(b) Case No. EIR-26.8 and SP-168 - Raca Development Company - Request for certification ot an tlR and approval of a Specif Plan'for j56 dwelling units on an 8-acre pl'ece of land zoned P4 and located on the south side of Park.Drive between Marina Drive and Neblina'Drive, fronting on the north shore of the Agua Hedionda Lagoon. City Planner, Dana Hield, explained the Environmental .Impact Report and staff's justifications .for recommendation of certification.. Ms. Hield also gave staff presentation, ex- plained graphics and, recommendations for approval of this Specific Plan request. Pete Seiersen, representative, Raca Development Company, ex- plained the request and introduced his architect, Bob Marvic Bob Marvick, 17890 Sky Park Circle, Irvine, stated that in meetings with staff they wanted to maintain visibility to th 'lagoon and that is why they condensed this site.plan into tw major structures allowi'ng unobstructed view to the lagoon. Mr. Marvick passed a colored rendering of the proposed project to the Commissioners. He explained that there are twenty additional parki,ng spaces planned for the entrance to the beach to enabl'e public access. Several questions were asked of Mr. Marvick including air space between interior 'walls, floor construction, elevators, beach area and water levels. The 35-ft. height limit was talked about at length; -inasmuch as there'are two specific units in the front and tw specific units in the back designed for interest appeal and lighting where the' units reach approximately six feet over the limitation. Mr. Marvick felt the'project would lose its, '. architectural style without that six foot'extra height being al'lowed for clorestory construction. Pete Seiersen' stated that on several occasi'ons in meetings with staff they were told there was no legal obl-igation nor' code regulations to enforce this-thirty-five foot height limitation. Mr. Seiersen also wanted, in condition #8 of th conditions of approval, the 42-ft. half street section .for Park Drive to include the 10-ft. two-way bicycle lane. Also in reference to condition #9, Mr. Seiersen felt that the 15- ft. improved walkway from Marina Drive to the lagom was not necessary. He felt traffic on Marina Drive would be. totally . for use of developments located on Marina Drive. In con- . dition #lo, he felt somethjng other than standard streets . .would be desirable. Condition #11, in reference to the Commission's earlier statements, he would like to change the * placement of the walkway to the bottom of the slope, the walkway would be closer to the beach. Also, this would create a natural barrier between public beach and the portion of beach ;o be u'sed by the condominium owners. . The Comnission expressed concern about flooding and whether or.not the sidewalks would be under water under normal flood conditions. Commissioner Jose stated that even though this was ah "adult-oriented" condominium, there should 'be a tot- lot and perhaps more of a recreational area than.was planned George. Flanders', 3765 Yvette Way, expressed concern over the .. . visual and public access to the lagoon. Chairman Wrench recomnended taking Mr. Seiersen's comnents to the conditions one by one and respond. Condition #8, it was explained that bicycles do traverse Park Drive, this is a scenic drive and the new subdivision ordinance requires bicycle lanes on all secondary and scenic roads. Marina Drive to . the lagoon, Planning Director Don Agatep statid that in staff opinion, because of the.access requirements of the new sub- division map act, the City should take every opportunity to provide public access to the lagoon. In Condition #.11, because of the fact. that at high tide a good deal of the are is inundated, it seemed to be the general opinion that- the walkway should still be required at the top of the slope. Commissioner Watson addressed Tim Flanagan, €ity.Engineer, asking if he or his staff was present at any of the meetings ,not to his knowledge. " held.'between 'staff and the applicant and Mr.. Flanagan noted . Girard Anear, Fire Department Chief-, noted that condition #1 should be worded more strongly. He especially wants to see "fire retardant roof" added in this condition. George Flanders spoke again regarding the parking and the rendering. He stated he would still like to see more public access . . . Pete Seiersen stated they could physically meet.all the. con- dit.ions of the 'staff report and had talked to Dan Gt-0th in ' Engineering a couple of times on engineering conditions. He .felt some of the conditions would detract from the develop- ment. He emphasfzed that the 60-ft. street access to the lagoon on the east side was perhaps unfair, inasmuch as an- adjacent 50-ft. common access easement is currently shared. with the property owner to the east. ' Public' hearing was closed. The Commissioners discussed the Environmental Impact Report and their main concerns were: (1 ) the fact that 60% of the subject site may not be suitable-without very -heavy founda- tion costs and .(2) the siltation, especially during grading. Planning Director Don Agatep stated than an EIR was essenti- ally a finding of fact, pointing out potential problems and mitigation measures. It was determined that the EIR was complete and a.dequately described what problems.may occur and their best solutions. It was moved and unanimously approved to certify EIR--268. . As for the conditions under the Specific Plan, the Tollowing opinions were -expressed:' Commissioner L'Heureux.felt there was something to consider in condition #15 as addressed by Chief Anear; condition #12 should state "parking at the top of garage ramps is not allowed"; garages should'be either flood proof or pumps prdvided and prospective buyers should , be advised about this possibility; and perhaps something should be spelled out about erosion control. .\ Comissioner Packard Pelt that in condition #8. a bicycle lane was *a necessity and perhaps a.horse path cou1.d. b@ added a1 so. Commissioners L' Heureux, Packard and Wrench would 1 i ke to see a bicycle stand added as a condition. Commissi'oner L'Heureux added that a condition stating grading cannot be started until certif.ication by a soils engineer should be considered. Case No. SP-167 and ZC-154 - San Diego Pipeline Company - Request -for approval of a Specific Plan and Zone Change to a1 low development of a petroleum products pipe1 ine booster station and change zoning from L-C to P-U and R-A-15 0.n property generally located on the,north side of Olivenhain Road east of E.l Camino Real . Planning Director Don Agatep explained that through an admin istrative error these applications were taken prior to a zon code 'amendment which would be necessary first. It was moved and unanimously approved to table this item until appropriat zone' code amendments can be made to allow a decision. 4. Case No. .GPA-34 - Circulation Element of the General Plan - .Consideration of. the Circulation Element of the .General Plan It was noted many citizens in the audience were interested i this Element, and were especially concerned with the closing of Monroe Street.. ,' Circulation. City Engfneer, Tim Flanagan, presented the basic Circulation Element, includinq the history. Staff explained that, even though this wa; the public- hearing of 'the Circulation Element, there would be two side issues dis- cussed. One of the issues would be the request by citizens to close Monroe Street south of Elm Av.enue. Even though thi is not part of the proposed Circulation Element, per se,. policy' for street:closures are' stated in the existi.ng Cir- culation Element. The second issue is the realignment of Elm Avenue east of El Camino Real. This realignment involve at least three properties, and these representatives are in. the.audience tonight. This, again, is not part of the Cir- culation Element, per se, and wil1,be discussed as an item following the Circulation 'Element. However, the property owners in that area may wish to make a statement for ttie record during. the Circu1,ation Element discussion. The question was asked: if the adoption of this E:lement was .approved, would this void all existing specific plans. Mr. Agatep explained that only precise amendments within the .. General Plan would be void'ed. Fire Department Chief Anear stated through streets are neede for fire and police protection. Possible Closing of Monroe 'Street. Mr. Flanagan said"Mr. Rick Phillim, rearesentins a citizens' committee, submi.tted several statements the groip wanted included in the Element. These were not included, since the issues were centered on . the traffic situation on Monroe Street; and it was felt by Engineering that the Circulation Element shoult! adflress .it- self to City street.s in general, not specific streets. To this issue, Mr. Flanagan sta,ted that nothing'in the Circula- tion Element could prevent ttie closure of any collector or local street when it can be demonstrated that there will be . no detrimental effect to the Element. Rick Phillips, 3075 Monroe, explained the history of the citizens' group in presenting thei,r case for closing of Mon- roe to the Planning Commission and to the Traffic Safety Committee. He explained a chart showing where the blocking of the street could be and said they had sixty signatures on a petition requesting the closure. Mr. Phillips showed the Motion Ayes ., '. Baer, 3130 Monroe Street, stated briefly the history of the citizens' group presentations, also. Chairma? Wrench congratulated Mr. Phillips and Mr. Baer, es pecially on their preparation of the changes they would lik to see included. It was explained to them that when this ' matter gets to Ci,ty Council they could consider advocating public hearings for closing of public streets. In answer t a question, Chairman Wrench explained that copies .of these minutes are available in the City Library or in the Plannin Department. -' George Flanders, 3765 Yvette Way, expressed his concern ove . inadequate streets, including Monroe Street, and especially Highland. Chairman Wrench explained that part of the probl in that area are large blocks without interior circulation. Planning Director Don 'Agatep suggested the keeping in mind the scale and scope of the General Plan Amendment. Only major circulation is being considered in this document. Ed Simpson, 390 Moriroe; said he was just interested in .the safety of the kids along Monroe Street, particularly those having to traverse it to go to and from school. .Elm Street Realignment. Mr. Flanagan referred to the denia of S. L: &. B Service Corporation application for a. tentative map on a project located east of El Camino Real at Appian Way because it did not conform to the.Circulation Element. Mr. Flanagan also stated that the Larwin .tentative map, whi is next on the agenda, should not be considered until Gener Plan Circulation Element is adopted. He stated t'hat becaus .of landlocked parcels, it was necessary to get Elm con- structed as soon as possible. , Stan Morris, Toups Corporation, spoke on behalf-of Larwin, stating that Larwin has,acted in good faith, has graded 186,000 cubic yards of soil, has lot 91,000 sq. ft. of land has installed sprinklers and has met all City requirements, as well as satisfied HUD and FHA. If this Elm Avenue.aligr ment went through, Larwin would stand to lose another 35,OC sq. ft. of land, while' the adjacent property owners would -. lose nothing. John McCoy, S.' L & B Service Corporation, 390 Oak Avenue, explained pictures of slopes and the alignment of Elm whick was .done 2-1/2 years ago. Mr. McCoy referred to the .lots owned by his company and stated this alignment was ,not good planning. Public hearing was closed. Conclusions. Thp .Commission determined that this ,Element i satisfactory to accommodate all concerns dis.cuss.ed tonight; and voted with six yes and one abstaining to recommend adopti.on of the Circulation Element to City .Council. In further action, the Cornmission voted to requ'est City Council consider holding a public hearing on the possible closing of Monroe Street. UNFINISHED BUSINESS 5. Planning Director Don Agatep explained ttie staff's recorkend- ations on this item .were: (1) approve the Circulation Element as presented, (2) table CT 74-25 and renotice at sucl time the Elm Avenue question has been resolved; and (3) set to public hearing a proposed amendment to the City's Specific Plan No. 124 zdopted for Larwin (Tanglewood) at the. earliest practical date. Commissioner L'Heureux moved and it was unanimously approve( to table this item and renotice after the Specific Plan hear ing. Larwin's representatives stated they did not wish the item tabled, but continued for thirty days. Tim Flanagan, City Engineer, stated that tabling the item .and not makfng a decision before the time limitation would mean automatic approval; therefore, the Commission approved a motion 'to deny this item without prejudice. NEW BUSINESS . None . DISCUSSION ITEMS 6. Changing Planning Commission Meeting Nights. -The 'Comnis- sioners decided they would change their meeting nights to Wednesday beginning with'the June meetings, if the Council was going to, continue their weekly meetings for some time and if they should concur this was desirable. Planning Director Don Agatep will report back on this. I . 7. Decision as to-which nights the. two special meetings. in -May will be held; the first one for a Sign Ordinance workshop, the second for Multi-Zone Code Amendment workshop. ' The Com- missioners decided they would meet May 7 and 21st and June 4th and 18th, beginning at 6:OO P.M. and will be'no longer than two .hours. 8. Planned Unit Development and Condominium Conversion Workshor (continued). Because of the hour, the Commission continued ' this item to May 7. .\ 'INFORMATION ITEMS I. 9. Revised Subdivision Chqpter. The Revised Subdivision Chapter was given to the Conmiissioners for their .review. Planning Director Don Agatep announed that the joint City Council Planning Comission meeting scheduled for April 29 may not follo! the agenda which the Planning Commission had submitted. They will hear instead a presentation by Mr .. Eugene G. Jacobs on redevelopment . ADJOURNMENT ................................ . The . - .."
