ROLL CALL Secretary to the Planning ,Commission, Donald Agatep, called the roll: APPROVAL OF MINUTES AND RESOLUTION The minutes of May 21, 1975 were unanimously approved as. subm.i tted. The minutes of May 27, 1975 were discussed. Chairman Wrench suggested to the Commission.that in his opinion the mi-nutes did not refaect the gist of the Commission discussion and suggested 'that the minutes be redrafted to more accurate1.y s.tate the points. and matter of concern expressed 'during the May 27th meeting. Cqmmis sioner Wrench also pointed out an error in the minutes on page 5, paragraph 3; in which Chairman Wrench .was credited for a statement which he felt had been made b another member of .the Commission. It was moved. and unanimously approved to -retu'rn the minutes of May 27, 1975 to staff for redrafting. Resolution No. 1157, approving CUP-108, Boy's. Club Carnival, was unanimously approved as corrected: Item #5, Facts and Reasons, of 'Resolution 1157, was amended to read: .. "The compatibility of the proposed carnival to the adjacent commercial development makes the area suit- able for such activity.'' Prior to the vote on the motion; Commissioner's Dominquez and Watson stated their membersh.ip on the b'oar-d of directors of the Carlsbad Boy's.Club and their intent to vote-. .. . ZC-156 City initiated rezoning to Open Space- The Planning Director stated that the hearing i.nvo1ved three parcels which were deleted from the public hearing of May 13, 1975 because of improper .notificatinn on a portion of the Buena Vista Lagoon (exhibits 14, 14a), Pi0 Pic0 Park Site (exhibit 7) and SDG&E Lands at applicants request. Planning Director Donald Agatep gave staff presentation and explained a map indica.ti-ng SDG&E holdings. The map originally presented to the City in 1971, indicated the are.as that'were: to be. rezoned to Public Utilities.. Director A.gatep stated staff recommendation and reasons of approval for ZC-156. After substantial- dtscussion among -the 'Commissioners. as to the advanta'ge and disadvantages of rezoning these lands,to Open Space,-'public hearing w.as opened. Mrs. Dames; 1275-Cynthia, .Carlsbad, addressed the Commission with the question of "what is-the advantaae to the City of rezoning the Pi0 .Pic0 Park to. Open Spice and can the rezoning decision be reversed?" Dir.ector Agatep ind-icaced that the proposed.. rezoning - would bring the zoning and General Plan in conformance per State law. If.-the-City Council felt it was in the, best' interest'of the. City the property could be re- zoned by the-public-hearing process. Ed- babrielsan,'Planning Supervisor for SDG&E, addressed the Commi.ssion, stating SDG&E's opposition to 'rezoning. the SDG&E lands to open space. He stated that much of the land presently zoned Public Utilities (P-U') com- pliments Open Space because of the water surface, beactl front and the agricultural use under the transmission' line corridor. Mr .Gabrielson also stated that the SDG&E Company was currently'negoitating wjth the.Ci-ty on the development of a recrea.tiona1.. park-in the south- eastern sector,' including ball fields.. He stated that park development would have 'to come under-a conditional- use permit .if the lands were rezoned-.to . . Open. Space. Also, dredging' of the land, and the . - . transmission lines'.which mqke up-the. majority of the -land east of the.freeway, are not a permitted-use under the Open Space Zane. - (Director Agate-p pointed 'out -that -dredging .'w.as not cons-idered .a. use but' a maintenance ac'ti vi ty) . -Mr. Gabrielson requested' that the 'zoning of the l.a*nds I- south of Agua Hedionda Lagoon and East of:I-5 remain as is (P-U) and that the General Plan -be.amended from 0-S to P-u. TGd Richmond, representative of SDG&E - generally con- curred with Mr. Gabrielson, stating .that the Open Space Zone does not permit agricultural uses and'that. the P-U Zone was specifically set up to include O'pen Space, recreational and agr.i.cu1 tural uses. 'On the SDG&E land south of-the Agua Hedionda Lagoon and East of 1-5, after substantial discussion about the relationship .of the existing General Plan, the existing and proposed zoning and the existing land uses, it was. moved to recommend a zone chane from Public- Utilities (P-U) to E-A (Exc'l usive Agriculture) because Open Space zoning did not.provide for agricultural uses. 2) Case No. SP-l22(A) Covington Brothers: Request for. approval of a Specific Pl.an allowing construction of 300 dwelling u-nits 0n.a .61'acre -site located at the southeast corner of P.0insetti.a Lane and 1-5. Planni.ng Director .Donald Agatep gave staff presentation and explained graphics, stating staff's recommendation. of approval for reasons .outlined in .the staff report and subject to conditions .of. approval. Bob Fitzpatrick, Co.ving.ton 'Brothers, Fullerto.n, CA, spoke on .behalf of the project. He indicated that the - Specific Plan had been approved and 'the final map re- cord-ed in August o,f 1974. However, .due to the econ0mi.c conditions, they dec-ided. to have Sanford Good.k'in prepare a new economic. study.for the project. The market s'tudy indicated €hat -the market had changed in . Carlsbad suggesting-the high prices of townhouses: Therefore the Spectfic 'Plan was redesigned to 'provide middle priced condominiums by using the same r.ecorded map but revising the floor plans and elevations. Mr. Fitzpatrick -stated that the-price range of the townhouses would -be in the.$35,008 to $40,000 per unit. Approximately 70% of the units will be tw.0-bedroom: Carl Brown, Wiiliam-s Engineering, Tust.in, spoke re- garding the sanitary sewer easement along the westerly boundary of the parcel .from the southwesterly darner- " to the vicinity of lot '148. - He stated he did n.ot.feel. that the .condition for the..easement'was ju.stif.ied. He felt that units would be lost in the ,'project if the sTopes were greater than l%:l;. Tim Flanagan, City Engineer, made a diagram for the Commission to exp1ai.n the problems of the area, and i stated that if the soils tests justified, the. slopes could be Steeped to 14:..1. V-251 Sequoia Paci-fic Realco .- Request for a variance. from Section 21.41.070 of the Municipal Code (Signs-Height Limitations) to allow the placement o'f a'free-standing on-site sign. 'Planning Director Donald Agatep gave staff presentation and recommendation and reasons for denial based on the fact that at .least 3 of the- variance findings required could not be found. .. Ralph Bacon spoke'on behalf of the applicant, explainin the reasons for wanting a higher sign. His reasons included the fact.that the Lakeshore Mobile Home Community cannot be seen by northbound motorists and I- and that the sign is needed to identify the mobile home park location. After substantial dis-cussion .among the .Commission, a minute motion was .made and approved to direct the staff .to investigate the problem of residential direct- ional signs and poss.ibly. incorporate residential-, directional signs into t.he .upcoming .sign .ordinance. .
